Just an update folks, I received a telephone from DWP back in July who asked if we wanted to supply any further information. I said that I had requested a SAR and when I received that I would make a decision on my partners behalf. SAR arrived and its unbelievable that the DWP and ATOS dont listen to doctors letters. Anyway never got round to submitting further information for appeal. A letter arrived last week stating they had decided that my partner now scores over 15 points and therefore the appeal would not proceed. In my opinion this is what they will do will a lot of people. Anyway partner and I are ok. (for now)

Not sure about a technical issue, however fact is clear the employee owed employer money back and she agreed to pay back from salary. If she had not agreed to pay from salary then you could argue an unauthorised deduction from salary. This does not appear to be the case? -

Your empoyer did make the payment in error and recalled, and they can do this. You must have known they were going to ask for it back and they woulf not get it out of the 3 days owed. The bank have done what requested by BACS and they are not at fault. It leaves you in a negative position but very little you can do in my opinion. -
Does ISCS not mean "Income Support - Carers Service" normally used when full payment cannot be paid due to other qualifiying benefit?

My understanding is that only one of you can claim for housing benefit in the property. Who is the lease in the name off. If/when your mother added her name on then you are entitled to HB until that date. From the date of change in circumstances then you or your mother will claim the rent. Are you your mothers carer? If so then you may be entitled to a 2 bedroom rate. If not then possibly a discretionaty payment from the council. My understanding is that if to family members share the same house then only one can claim Housing Allowance.

Each giro will state on it what period it represents. There should be a letter in with it saying what its for. Its unlikely to be duplicate payments unless its a clerical claim. My understanding is that payments would be checked before sent. Why can't she phone and find out what its for. If it is wrong and she spends the money then the DWP have the right (in law) to claim this money back. -
Once car is collected contract iscancelled. Any deposit you paid is pro rata down and will be returned to you.

The issue I have is my partners first ATOS examination states no prospect in circumstances for at least 12 months. I watched documentary recently and it was stated it was unreasonable at such short intervals. -

They are a loan matching service, and there website is misleading. However, does say within their terms and conditions what they do. It might be tough but at least they are going to refund it. You could raise a dispute with your bank stating you were unaware they were charging...if thats what you believed. -
You can advise them within a reasonable time - ie can be a few weeks either side.

I'd get my credit sorted out before borrowing anymore. Its unlikely infact impossible that anyone will lend money in these circumstances. Rebuilt your credit rating them change over to a better lender.- 9 replies
