  1. Hi Bec, Please take this advice...."DO NOT PAY THEM".....understand! You both know that you have paid and you can either print of statements from your bank via the internet or pay your the bank for copies which will show your payments and even ask the bank to supply you with a copy of the "in full and final settlement". confirmation of the closure of this debt. Know think of it this way, this and it is a [problem], if this company chases 10 people at what seems to be the average amount of £30,that equals £300, so times that by 100, 1000, 10000.... get the picture, nice little earner. And because it is such a small amount, most people would pay it. But not us, we are out to screw them. Now, Don't forget if they contact you TELL THEM to prove that they own this debt and that they have "12 WORKING DAYS NO LONGER TO SUPPLY THIS" .....OR....THE DEBT IS UNENFORCEABLE!!!!!! Check out all that has been said about this [EDIT - PLEASE REFRAIN FROM PERSONAL ABUSE]hole of a company and if they are rude to you on the phone, stand up, take control and threaten them, i told them to feck off, but that's me! Oh, and when i spoke to Moorcroft, the guy told me that this sounded very odd and to be aware it could be a [problem] and to call ofsted! what's that telling you???? Keep us all posted, but for your own piece of mind get proof from your bank, also call moorcroft and give them any details regarding the phone contract they should be able to locate it in the past history they number is: 0161 4752858.
  2. Hi Bec, Rant continued.... Moorcroft work as follows.....mobile phone company pass your details to moorcroft, they contact you to say hello out-standing amount please pay, you pay, moorcroft say Here you go mobile phone company and thats it....BUT on the occasions were that they/moorcroft "Buy the Debt" they do not sell it on again to a third party.   3. hi guy's, have been thinking about this 2-bit piece of **** company, and the next time they contact me i am going to tell the to prove this debt to a court of law, so sue me! this should make interesting reading, don't you agreed.....AND i live in scotland, so lets see just how much they know about the law north of the border???????? no doubt we'll speak again!!! xx8)
  4. Hi again...here's alittle more info: In debt with Lowell Financial? Know your rights. Lowell Financial can not force you to repay more than you can comfortably afford each month. OFT-Debt-Management-Guidance 2003 section 2.6F If you make a reduced payment, Lowell Financial can not refuse it. OFT Debt Management Guidance 2003 section 2.6F Lowell Financial can not add charges as a penalty for non payment, other than to cover the real costs of collections activity. OFT Debt Management Guidance 2003 section 2.10D If you enter a debt management plan with Debt Line, Lowell Financial should not bypass Debt Line and attempt to contact you directly. Hi again, just found this on the office of fair trading site "Unenforceable credit agreements Borrowers and hirers are able to ask creditors to send them information about their credit agreements. If information is not provided within 12 working days, the debt becomes unenforceable until they get the information they asked for. Sections 77, 78 and 79 of the Consumer Credit Act 1974 outline the information creditors must provide to debtors under fixed-term, running account and hire agreements. Hi, regarding the o/s £30......Yes, if they contact you again tell them that until you receive a proof of debt letter, then they have no right in contacting you and until such letter is recieved and the debt proved then they are in breach of the debt collection guidelines.As mentioned in the following paragraph found on the link mentioned! Because i have just read this:-"Yes Lowell are in breach of OFT debt collection guidelines, by not sending proof of the debt with the letter demanding payment. You should have had a letter sent to confirming that NatWest had assigned the debt and that a Debt Collection Agency was now dealing with it. Type in Lowell Financial ltd in google and pick a link and read this is were i got the paragraph from. Don't let them threaten you, you threaten them with harassement as i will if they ever darken my door again. I am ready for a fight with this (Edit) Has anyone else read the letter sent from Tocatto, is it me or is the gramaticlal phrases strange.....it's almost like a child has written it???? Stand tall my friend, and when they call you, stand up, this will give you the sense of being totally in control, even have a sentence ready for them......all the staff calling are thick as pooh ( experienced today)!! keep in touch.
  7. Have been following this conversation and "HOW DARE" Tocatto, lowells or whatever the spineless face of the company wants to call itself......this company needs to be taught a lesson. I told them to Feck of and stuff the amount owed until they could prove there worth.....i wont hold my breath....lol! Glad to see that there are so many supportive peps out there!! Like you say, we might not be able to bet them, but by heck we can make them work for their miserable ****-sucking jobs and maybe if they stopped and looked at them selfs maybe they might consider others......LOL as if!!
  8. Too many fingers in this pie for my liking! I would contact Littlewoods and ask them who it is you need to speak wth to arrange some sort of payment plan. They can only have what you have to spare. If this went to court, yes you would have incurred charges..BUT a payment plan would be reached via the court in conjuction with your income (this is why you have to complete court papers stating your circumstances ie financial income/breakdown). But, trying to resolve this matter between you and the 2nd party (because Littlewoods may have sold it on, but normally only to one debt collection company)is far better. I have just received a letter from Tocatto Ltd (formely Lowell Portfolia II, and yes they will be connected to Lowell finacial Ltd) asking for £21.77 from 2007. This is the first contact that i have and i know nothing about it but it wont be the last....personal vendetta! Me think something not right????? Always try to resolve debts asap, it is easier to put your head in the sand (got the t-shirt) but facing head on and know the light will come. Dont get down...it does help to talk!
