  1. Well i wasn`t offered my money back, but a replacement of 1 of the same value, So thats what ive gone for. At least the guarentee starts from afresh. Thanks for the ideas (as i refused a repair point blank)
  2. The DPC Co survey"should have shown dampness in bricks" as being a cellar though unless tanked there will always be damp present. The floor/membrane failure could probally be cured by asphalt flooring (cheapest option). as for 10months with no visable sign of damp, The bank i worked on had nearly 10 years of no sign.after tanking. Its took that long for bricks to perish enough to become absorbant,or as i more likely suspect a drain failure, (its the sand thats got me thinking this), sands waterproof so when mixed with water, it doesn`t absord it, it becomes it. and flows away.now with drains resting on this and the void created by the sand erosion under drains (they tend to break) and being a cellar drain (below ground level) water tends to make its way back up the drain. If i was you i`d aquire a 4in drain bung (to seal OFF DRAINgrid top Get 1 from hire shop,and a sump pump (probally cost you £50 ish for weekend) Plug drain with bung,pump water to an external drain (these will be on a different line and level)after level has gone to bore hole, water will flow from brickwork for a few hours (if this slows down) take pump back and keep bung :o ,as its the drain, say you cant find it and it`ll cost you about a tenner. and dont spill water down there as youve nolonger got a drain.
  3. i worked at a firm at M/cr Airport like this (we were weekly) somtimes wages went in bank on friday/the following monday,tues, even once a wensday.(though friday was payday, sometimes it was cash, but worse of all we got cheques 1 monday (5 days clearance) well we striked (unofficial) "only greivance we could do" as new labour laws it take 100 years to be able to strike officially:eek: , but the owners contract with the Airport was for 24/7 emergency building cover (just the hour we was on strike) was enough for his contract to be threatened (we always were paid on friday noon after that) . Though i did leave 2 months after that (cowboy Co).
  4. ACT OF GOD been there wore the teeshirt. I was renovating an old TSB Bank into flats in Bootle, The basement "Vault" was prone to flooding during high tide. So TSB (then) had membranes fitted all around basement (TANKED) correct terminology, Now a row of terraced house`s were connected at the uphill side of this old bank,and because of the TANKING the building became a form of DAM. and being the bottom of a hill,a good DAM. So after removing some masonry to inspect after neighbours had complained to enviromental Health, I seen that water was building up to approx 5ft ,then backflooding into next doors basement,and so on along the row. So Env Health thought they had a case (against TSB) who had works done 10 years prev, but alas (water was saline) mersey estuary,on certain high tides, with good rain "water table overflowed" and judge bounced it, So 1 of the neighbours tried sueing surveyer only been there 2 years, and as its not a persistant common fault and wasn`t visable at time of survey the judge bounced that claim as well along the ACT OF GOD LINES and building propertys in underground streambeds the builder might be at fault (though 100 years ago) i doubt the builders still alive . ps you will probally find the water is either seeping through brickwork, or backing up the drains "if as you say a membranes fitted to concrete" though this core hole will certainly be a future problem now", being so near to the beach i`d opt for drains. and are you sure no pits "landfill sites ,have been filled in in the last 5 years or so, as ive seen this here in M\Cr,an old claypit filled in,water table rose 12ins in 2 years.
  5. I purchased a new 42in plasma from Cash Generator on the 26/11/06. The screen lost its picture yesterday (sound only), Ive had this problem since i got it (but managed to always get it back on by powering it down) but even this fails now. I`m not 1 for taking goods back "hence its been doing this for a month and not been returned" but now its dead and at £750.00 i think i deserve better. Its a german "no name clone of a plasma" so i cant find a manufactor on the net "to see if its a common problem". Now as i say i`m not 1 for taking things back (ive never took anything back) Where do i stand (do i phone them) do i have to accept a repair,(if so do i have to take it to them 40kgs+) as theres always a risk of damage in transport, how long is acceptable as repair time, or do i demand a replacement, or refund.
  6. simple question really, many times ive read about offers from Nat west and Corbetts and replys of i`ll accept as part payment (HAS ANY SOLE EVER HAD A PART PAYMENT):o If not is`nt it a complete waste of time and money (stamps stationary) to reply to these offers in the first place. Ive now got the standard Cobbetts (our clients believe your challenge will fail in court letter) hang on a minute "who`s the lawyers here" Ronnie corbetts or Nat west, clients telling the legal team who`s gonna win. but because your a nice guy, and a fellow MANC ,Ive managed to get my boss to swing you £650 , but dont tell any1:wink: .(as weve spent your other £500 on removal fees to our new office) OHH YES SURE I WILL ACCEPT. i WAS ACTUALLY IN CONTACT WITH M/cr county court yesterday and was informed my case in penciled to be in front of a judge in about 3 weeks time, So i guess its time for an offer,(and obligeingly it appeared) I`d rather have my PLASMA TV in a lump sum anyway , but even this i`m willing to sacrifice/gamble if any Legal peeps on here want a guinea pig and know of any way i can force a court case out of Cobbetts rather than they settleing up seconds b4.
  7. Sent Ronnies (corbetts) the sarchy template (in the toilet bandits thred) I know it was classed as "TOO PERSONAL" but hey they probally bin em anyway. But to my suprise i received a copy of Their AQ (FATBEST) though it was 90% blank, just the small claim track, I never sent corbetts a copy of my AQ just the court, . When do i get a court date "last day of fileing was the 26/09/06 or is it in the lap of the gods.

I need to get a life :o My Brother-in-law now has brought his statements round now (2 accounts with LTSB 1 joint and 1 his own) both 6 years back,:o he`s been hammered with the OD useage fees (approx 1.5k on this alone) and a new 1 for me ( FEE account charge) ????????? Can some1 clue me as to whats this (or more importantly) is it claimable I`m gonna start charging the next lazy git to appear with reams of paper and claim sheepishly "i dont know what to do" and you do !
  9. After such a sweet and meaningless defence submition from Corbetts and a CPR part 18 req i wonder if we could reverse the situation. Serve a CPR 18 on the banks requesting "how the charges are compiled" how they get the figures. Charge the banks for out time /effort/staionary/stamps going about getting OUR monies back. (me ive spent well over 10 hours on this claim) and normally get £10.00 per hour, out of hour time ( has gotta be Double time) and all that electric i`m useing. Set up a buddy system "Legal Adviser" This person charges the same as solicitors, His/Her costs would make a nice dent in the banks profits. and all the alledge cost could all go to charity. I`m sure ronnie CORBETT`s crew aint working for free

  11. My MCOL was up last wensday, and true to form (ronnie CORBETTS) filed their Defence on friday. This was in the form of 6 page`s of Garbage, with the USEUAL CPR 18 request, PROOF OF each and every charge, ACCOUNT Number, list of charges etc. Now i was about to recycle this (as I COULDN`T FIND ANY TOILET ROLL :o ) when 2 thoughts struck me. (well actually 3) 1. These request must be MASS PRODUCED as of late and the ink might still be wet, though this might be the apt place for this reside , my Ma used to say always wear clean undies "as you might end up in hospital after an accident" and it would look quite odd to the staff "a transfer of Corbetts transcripts" ON MY RUMP. 2.Perhaps its in our interest to comply with there request. (doubtful i know) but read on. If we have sent detail to corbetts (all chg details/dates/account details court fees etc) they can opt to settle b4 court (this not MCOL) but actual small claims court, as theres extra fees involved, and ive read a lot of the capitulating 1 or 2 days before court, Though i can`t make out if the settlements were down to (sending details to corbetts only) or corbetts and court, or court only. 3. I need to fit that toilet roll holder:D . Now i received the Court transfer doc`s yesterday, and the AQ due back by the 26/09/2006, now i`m claiming £1450.00 (and not sure what fee for this amount) but am i correct in thinking the fees are gonna be £100.00 as when i add any fee to the claim amount "it`ll go over £1500.00, and the £100.00 fee will come into force anyway. - SO DO I (a) Send CORBETTS my details as above (b) Send to Corbetts and Court (+ fees ) © send Court only (+ fees:-( ) (d) do nothing ,head in sand, thinking i`ll make em sweat. (e) emulate Corbetts and send everything in late as possible. DAVE.

Well the 28 days are up Today the 6th, what a shock no defence yet submitted with money claim, CORBETTS ronnie and Co must be up to the useual sh1t, file defence 1-2 days after the deadline ,WHY i aint gotta clue , as i aint giving up this far in ???, and this abuse of the legal process is tantermount to **** taking of the judicial process (after me being buisness like and professional in my dealings throughout,) whereas i would have loved to blast the bank over the THEFT of money from me, as i`m just adding 8% onto the original total of MY MONEY THEYVE ileagally BORROWED

Hi after fileing my own claim from Nat-west (court pending) My sister has asked me to do hers (as though i know much more):o anyway i got her to get her statements, Ive been mulling through this lot and cant be sure how LTSB mark out a difinitive CHG. Is this a bit of subtifuge on there part (or the norm) as say statement for 02/08/01 to 03/09/01 has 3 sets of CHG`s o.draft interest 0.16(this i know is theres) o/draft useage fee £5.00 (i dont know if i can claim this for her) unpaid DD (This i know about) under the bottom line the first 2 appear(as chg`s for 02/08/01 to 03/09/01 but the O/D useage fee has grown to £25.00. Then i look at on the next statement 06/09/01 to 03/10/01 (3 days missing??) and OD interest same and useage fee £25.00 but not under any line this time. as ive never had an O/D i dont know if its reclaimable (£25.00 useage fee)and also she has a few O/D EXCESS fees are these claimable.
  14. Well filed Moneyclaim Online on the 04/08/06 and ive recieved an acknowledgment of service on Fri 12/08/06 with a 09/08/06 date on it corbetts stateing they intend to defend all this claim. So is it now as letter states 28 days from when ???? 04/08/06 or as i assume 09/08/06 for them to file a defence, and when do i start adding interest at 8% to the lump sum (the total i submitted to court in the first place) is this the 04/08/06 or do the courts add this,as with the " p*ssing me about standard attitude" i`m now sorry i never got my own ambulance chaser as if peeps started doing this, then cost to Nat-west /corbetts would increase dramatically,(with their fees) and i assume very few would get to court to be able to claim this..
  15. Many thanks for that calculator, just looked up my LBA and it was sent on the 17/07/2006 so it looks like there 14 days are up antway, how time flys when theres fun to be had;)
