  1. The judge went through everything and dismissed the claim due to them not having any evidence I was the guarantor !! Absolutely chuffed and couldn't have done it without the help of everyone one on here - you are absolute stars and I will be making a contribution for you to continue your good work once I receive my next dole money.   2. I won't ignore what you said Ganymede - can I just ask again - If it goes in favour of the claimant and I ask the judge for 28 days to pay and I pay it within that time is it not recorded/expunged from my credit file?
  3. Hi Andyorch - I should have clarified that the claimants application for relief from sanctions was heard yesterday and his sol have emailed me saying that his clients has been reinstated and that the matter remains listed for trial on Thursday, 10 August 2017 at 10 AM. Ed

Thanks for the reply but does this mean that the judge can put a CCJ on me at this hearing or will he give me time to pay the rent arrears before he imposes the CCJ - me and my wife are very concerned as we don't want a CCJ appearing on our credit file? If the judge rules in the claimants favour then I will get the money from somewhere so I'm not concerned about a charging order. Thanks Ed

Can I get some clarification on what the judge can do in the hearing this Thursday - both me and my wife are concerned if at the court hearing the judge rules in favour of the claimant can the judge impose a CCJ against my jointly held property there and then ? If so if this CCJ is then paid in full can it then be wiped out on my/ my partners credit file? Thanks Ed
  7. That's what I figured. I still think I should not reply to the sols email though - is that right ?
  8. They have an email sent from the sols on 21/06/17 to [email protected] advising that they act on behalf of the claimant asking them to deduct the court fee of £335.00 from their firms fee account number (xxxxx).
  9. They paid it to the wrong court - the court where the tenant had possession proceedings.

I received a call on Monday afternoon 31.07.17 from the county court were the case is due to be held advising that the claimants application for relief from sanctions for non payment of the hearing fee will be held 7th August 2017 at 2.20PM and asking if I wish to attend and oppose this application. I need some advice - should I oppose it and if so on what grounds. Also the claimants sol sent me an email asking if I wasn't going to oppose it to let him know - copy of body of email below minus names 'Dear Mr X, I understand that xxxx of the xxxx County Court has contacted you this afternoon to advise that my Client’s application for relief from sanctions will be heard next Monday 7th August 2017 at 2.20PM. If you do not oppose my Client’s application, please confirm so by return in order that I can advise the judge of this at the forthcoming hearing. If you wish to discuss matters with me, please do not hesitate to call me on the number below. Kind regards,' Thanks Ed
  11. Oh well my witness statement has gone now, will have to hope the judge let's me use the fact that my name was not on the AST in court even though I didn't attach it, but I did refer to it but not as exhibit 1a or something. Ed

  13. Hi Andy I have already sent my witness statement. I don't know what you mean to send my documents that I wish to rely on. I don't have anything that his sol have not already sent with the POC? Ed
