Oh, sorry! anyone else get charged for two letters from Drakes when in LARGE BOLD LETTERS they state on the first letter "No Further Reminders will be issued" - I have taken them to task over this as how can you send a first letter stating that you won't send a second and then send a second and charge for it. Drakes have sent a statement saying this was a computer error - if you have been double charged in this way then challenge them on it, it all helps make them look silly and just shows how they inflate their charges!
  2. Hi there - I had a similar visit from Drakes, there is a lot you can do as following a little investigation I found out the Bailiff was NOT certifed to collect on a road traffic debt. One thing you should look at is the Bailiff certification as Drakes have employed individuals not certified to collect. My case is currently heading to court naming both Camden Council and Drakes as in breach of Duty of Care - I am awaiting a date for a hearing. There will be additional charges for visits they claim to have made to instruct you in regards to the debt, you may also ask them to prove such visits by way of schedules or physical evidence. Serve them with a Data Protection Notice asking for all documents regarding your case including copies of cetificates etc. Although I have a letter from the Court saying my Bailiff was uncertified Drakes still insist that he was, please don't go by any information they give you. If you visit the ACEA website (the association that looks after them) you will find a statement that they are investigating Drakes at the moment. Please contact me directly if you think I have any personal info that would be of use, I don't want to name the Bailiff directly incase it gets me into some trouble! regards - Marc

My letter to the PPA sent today, it's a bit of a miss-match but I tried to make it sound official, truth is it looks like they go after new advertisers or small businesses whom they think will roll over. The Press and Publishing Agency 4th Floor 1 Water Street Liverpool L2 0RD Tuesday, 31 October 2006 REF: CM2 0JY30/10/2006 Dear Sirs Please terminate any further dealings with my company, Alchemy Training Essex Ltd with immediate effect. It has come to my notice that your company has been implicated in requests for money concerning advertising that has not been forthcoming and thereafter demands for payments not due. There is inference of malice and malpractice within such postings within a private forum. While this does not reflect the personal views of Alchemy Training Essex Ltd, it’s Directors or employees at this time, this information is provided to you for your own investigation. I would draw your attention to postings on ecademy.com from local Liverpool business directors. I must also inform you that the ‘Terms and Conditions’ (herby referred to as terms) breach the Consumer Protection Act 1987 (Commencement No. 1) Order 1987 and Unfair Terms in Contracts With Consumers, Unfair Terms in Consumer Contracts Regulations 1999. Any attempt to enforce such terms will result in an immediate referral to the relevant watchdogs and regulating bodies as prescribed in such acts and may result in action being taken against you. Alchemy Training Essex Ltd and it’s Directors now call upon you to remove our details from your systems and to cease processing our company information by any automated means in line with the Data Protection Act 1998, Rights of Data Subjects and Others, 7. –(1) section (d). Any breach of this act will be dealt with in line with the relevant subsections of this act and will result in a complaint to the Information Commissioner being raised. You will now cancel all and any outstanding amounts levied by your company against Alchemy Training Essex Ltd, it’s Subsidiaries or Holding Company in relation to alleged monies due for advertising and services. Any attempt to collect on such alleged debt as a result of your non-compliance with this request will be referred for formal representation. Should you attempt to register such debt formally with any Credit Reference Agency or take proceedings against us we will counter such acts and recover costs from you. Alchemy Training Essex Ltd reserves the rights to publish details of it’s dealings with you including transcripts of telephone conversations, letters and other data not conforming to the definition of ‘structured data’ within the Data Protection Act. We also retain the right to recharge and levy costs for services such as Special Delivery postage, Company Services and Professional Fees against you in relation to continued communications with your company without such being considered a ‘Penalty’. I hereby represent the formal request that no further communication by your company, it’s employees, subsidiaries or representatives be attempted by means of telephone calls either to our registered offices or to mobile numbers held by our directors or employees. Thanks so much guys, I thought it was such a long-shot that anyone would have come across them, I feel a little more assured that I'm not being paranoid!! it can't be best practice to demand payment within 48 hours of discussing the possibility of advertising. I have dispatched my letter to them today but will keep this section updated incase anyone else has a similar problem. Thank you again, just knowing you read and posted here is a great weight off my mind.
  5. Several days ago I posted my company details on the Business Link Website, more specifically for the Essex Area. I have since had a call from a company called PPA or Press and Publishing Agency at 1 Water Street, Liverpool. They asked me if I would like to advertise in an Emergency Services Annual Magazine, intimating that it was for the Essex Area. I agreed to look at the publication and upon conformation would think about taking a small £95 advert. Their call also sugested that nothing was due for a few months. I was surprised to get a call today asking me to settle an outstading account of £111.00 even though I have not seen the publication I was told would be sent, artwork or indeed a draft of an advert. All this within 48 hours of having spoken to someone I didn't know. Although they have an email address it does not link to a website and after trawling the net I saw postings from some local Liverpool Companies saying they had dealings with them over non-existant Wall Planner advertising. It would seem that this company offers advertising based on Charity or donations to good causes and then simply tries to collect without actually producing anything. Does anyone else have any more information or have you been in contact with them? Their payment request has some outlandish terms and conditions printed on the back that clearly break the consumer protection act and unfair contracts act - period. If anyone can offer me any help or other such incidents involving this company then please contact me so that I can take them to task over this. Thanks all

  7. Claim Settled in full, some administration error meant that they only refunded the bank charges and not interest and court fees but I am assured there is a cheque on the way! BRILL
  8. Ok guys, the bailiff Watch Dog site is NOT a pay site, it is a collection of people just like the London Motorists Action Group, but we have had problems with Bailiffs. In my case Drakes extorted money from me without following protocol. I am told the watchdog will be featured on the forthcoming Bailiff program as a source for people who need help. Alison has taken on many of our cases, all free of charge, in order to show these people that they cannot just bully and demand payments that are not due. As for it being a loophole for those of us who don't want to pay?? Camden Council now can't tell me when they issued their 'Notice to Owner' (something I have disputed all along) and my original parking ticket was over a 5 minute time descrepancy on two residents day permits. Without proper notice they refered my case to Drakes who then broke the law in their collection. I think it is sad that anyone should begin to rubbish good work just as it starts, maybe some of you who have had problems would like to email support or help?

I had a 5am visit from Drakes a few weeks back to clamp my car and demand £600+, they did not follow protocol and although I had to pay to stop the car from being uplifted I have found someone to help. Please visit [link removed] and the [link removed]- Alison who runs both sites has helped me start action against Drakes for not following the law, she has also managed to get Camden Council to sit up and listen with regards to the initial ticket issue. Even if you just need some advice then talk to her (she will call back if you fill out the form) and is trying to make the Bailiff's sit up and take note. Drakes failed to follow at least 7 areas of law when they called, and even before then, in their initial correspondance and demands. Alison acts on your behalf and gives them only 7 days to answer, not the usual 28 days. I felt like I had been banging my head against a brick wall, searching page after page on the internet until I found her site. On the day they clamped I lost revenue as I am a self employed trainer and felt sick to my stomach becuase I didn't have the money to pay, they clamped me at 5am and gave me till 9.00am to pay or they would uplift the car. In the end I had to place my dog and then myself in the car to stop any action while I frantically called friends for help. I never saw the Bailiff, and he refused to come in person until the fine had been paid, I never even saw his ID Badge or Autority to Act, he did everything over the phone. I have met Alison and she is lovely, seriously it sounds like a 'story' but she took notes and helped me get everything sorted while our dogs played outside (I even got homemade pie) - her and her partner are fantastic and prooving to be a real pain to the likes of Drakes. My letter to Drakes was sent this week so we should have a reply by next, also Camden finally sent a reply to my original repesentation that they had 'misslayed' after she spoke to them. Don't let Drakes or the others get to you and if you have a demand letter, start parking your car away from your house (I wish I had done) but get in contact with Alison now.   10. Oh Forgot!!! sent Data Access Request to Natiowide Credit Card, they have not made the initial reply deadline, so I will file a complaint with the Data Protection Comissioner. I also noticed that the 10.00 fee I sent to them has been credited to my Visa account as they say they do not charge for copy statements. I have pointed out that they were incorrect in doing this as the cheque was sent specifically for the purpose of the DAR and not as payment to them.   11. Natiowide tried stalling tacktics with two letters from the Member Services Department, as of today, 20th, I have filed my Money Claim online to start the legal process. They are also refusing to close my Bank Account? is that a first?? because they miscalculated charges due to be applied when I cleared my overdraft and made the request and now the account is in overdraft again. As soon as this part is over I will start the process to reclaiming the new set of charges.

Standard letter of Bank Schedule Charges in the post today dated the 29th August, have completed the 2nd letter showing intent to claim if no refund, will get reading on the Court Procedures so that I can be swift in the action.   13. Many thanks for all the post's here on the site, I have just got my last 6 years bank statements tonight, very thoughtfully bound with numbered inserts (it's nice to know they still like me). I am sending in my first request tomorrow for £2997.50, fingers crossed. Keep up the good work everyone and remember to feedback on your experiences, it's only reading what other people have written that gave me the confidence. Essex Geezer
