  1. Well I have to say Tim's a gentleman, after a short twitter conversation and explaining whats happened to him he's cancelled it completely for me. A great weight off my mind! Thank you Tim!:clap2:
  2. Hi all, went over the Dart back on 13th August and we forgot to pay until the evening of the 22nd, 9 days later! OK, yes hands up, stupid us, we simply forgot as we've been having a bit of a rough time of it lately and life simply got in the way. However, we paid as soon as we realised. But now this morning ive got a charge certificate asking fore £105 and saying ive ignored a pcn from them sent on 23rd August (the day after we actually paid) giving me 28 days to pay 70 quid. I never actually got that letter at all, it offered me £35 if paid within 14 days which Id happily have done but now they want £105 plus more action being threatened if i dont I cant find an appeals process, i cant afford 105, id happily pay the 35 frankly to get it off my back but dont know how i should go about this can anyone please help me? googling i found a site http://www.trafficpenaltytribunal.gov.uk/how-to-appeal/ which seems to imply theres a 14 day grace period anyway for first offences ? Quoted from the site "A spokesman said: ‘The first penalty charge notice issued for any vehicle for non-payment of the charge will offer the driver an extra 14 days to pay – and pay for any crossings they have made since. ‘This measured approach strikes the right balance between being clear to drivers they need to pay Dart Charge and giving them every opportunity to do so." So im at a loss here and hoping someone can help.

  4. Oh and should the SAR go to HSBC or the solicitors? I'm assuming the solicitors as they should have all the information?
  5. Thanks again rebel. What's my best option though re the claim as if HSBC have up to 40 days to reply re a SAR I still need to do something with the claim don't I? Also, how does the ppi and penalty charge angle help me? I may be being thick here but other than possibly claiming back these if I can it's the claim I'm initially worried about if you see what I mean? So, I'll sort a SAR out right now anyway, but as to my replying to the claim, what should my first action be?

Thanks guys for the help so far. re ppi, I have no idea if I was sold any of this on any of my cards or loans to be honest, certainly never asked for any as (at the times) I was in a secure job (nursing in NHS) Of course there's no such thing anymore Other debts, yep, loads, ie about £2K with a tesco card, an overdraft with my old bank of £1500 an old egg card of £4000 etc all of which I'm "conversing" with interrmittently including having informed them of my situation (ie not earning) and asking them to write off the debts given my foreseeable earning potential :-/ All my debts though are, I believe the term is, non priority debts? i.e. none are council tax, heating/electric, mortgage etc. It's all been very hard this last year and depressing to be honest and I've not been as strict about pursuing a resolution on all these debts hanging over my head to be honest and as a sort of new year resolution Ive started to man up and sort out these things but then this landed on the doorstep this morning and feels like a real set back. I feel like sticking 2 fingers up and telling them to do their best, I have very little in my possession in my name, ie. a scooter for travel, a car for travel, neither one worth more than £1000 or £1500 each, after that there's the house which is joint mortgage with the wife and I'm worried they may try to do something with that?

Hi all, I was wondering what the best course of action is as Ive just had Northampton County Court Claim form through the post and never had one of these before and am a bit worried to say the least! Its for a hsbc card from a few years ago(agreement dated 18/01/2006 according to the letter) and the debt seems to have been sent to DG Solicitors of Birmingham who are claiming for the amount plus then interest at 8% pa. What the hell do I do? I'm not working at the moment, havent for some time now since my business closed 2 years ago Due to personal family circumstances and to save my marraige I am now a house husband and do the odd shift at the local hospital on their bank, but of course they are under financial pressure so it's been months since I had a shift there I was supposed to do a course last year to get back onto the Registered nurse register as at least then I could get some more shifts at other hospitals relatively locally too but this got delayed first to November by the university, then 'til February and after chasing it up only early this week they are now looking at March! But that's another story. I just need to know what people think I should do. I can't deny the debt in that I know I took it out, I did contact them when I was having probs with it all over 2 years ago and they were unhelpful and wouldn't let me make token payments etc so I ended up putting my head in the sand and thinking sod them, that and going through a depressing rough patch and family trouble which we've thankfully salvaged. But now I don't know how to reply to this, I can't see a defence as such other than saying I have no money to pay the debt basically. Any advice is greatly appreciated

Hi all, well, I basically lost my job, then lost the business (a year ago) I was running, since then Ive been doing work as a bank carer but not getting much work at all, we're only surviving as the Mrs has increased her hours at work. All my credit cards debts are in the hands of DCA's and have been for months and I'd been paying a nominal 1 to 5 quid but things are getting out of hand now and they are looking to bully more money from me, bit difficult as my months wages last month was literally £44 :-/ I've rung a couple up and they're being arsey asking for a financial statement so they can go on accepting my £1 payments, on top of this my old bank account went over the overdraft limit a month ago due to a £2 payment trying to go through when I had only got £1.88p in it, for that they bounced it and charged me £35!!! When I spoke to them they were unbelievable beliggerant and I've basically told them bugger off and have moved to a safe bank account as im trying to get back on my feet! So, now Im at the end of my tether frankly and thinking is bankruptcy better but Im married with 2 kids and dont know how that would affect her financial status. I found the My Money Steps website and have filled it in but it's telling me to offer the same token payments and send a financial statement, I did it as a sole earner and not including the wifes income as all debts are mine. Oh and they are ALL non priority debts if that makes a difference and come to a total of just over £14,000. I'm wondering now whether to write to them all again and state my situation offering £1 monthly with the statement as is, ie without my wifes income as thats personal surely? Or do I have any other recourse? Any help or advice is appreciated
  10. thanks for the reply Cas, i'd love to take the "lesson learned" angle as a positive one but all this was down to the other half hiding the fact this had all been hidden and I only found out when he visited the first time back in May, this was AFTER it had been to court / summons / passed to bailiffs. The worst thing is that she's done this before several years ago!!!!!!

Right excuse me if i ramble im a bit peed off to say the least as Ive had a bailiff from Constant and Co (milton keynes) turn up this morning about our outstanding council tax bill from last year that the mrs hid from me. Soon as I found out about it I wrote to them to open some form of negotiation and offered 20 quid a month to start, that was May 13th, had no reply of any form and this morning he's arrived with a truck to take my motorbike! I called the police to ensure there was no breach of the peace too. Now, in the end the wifes managed to get her dad to pay on the credit card but a £700 debt jumped to £1023 and i asked why and he said because weve had to pay the truck man. Before signing the notice of seizure i asked him if there was anything i should be aware of (in front of the policewoman) or anything i should be concerned about and he said no. as soon as i signed he then pointed some bits out to me including the following charges £46 levy fee £12 walking possession which is basically charging me for him NOT taking the bike in the end £115 for him just turning up!!!!!!!!!! £24.50 redemption fee which is basically charging me for them NOT taking it away to sell!! FFS, Im at the end of my tether and just feel I need to complain to someone about this they dont have a complaints department at Contstant and Co, I asked! Is there anything I can do here at all does anyone know?

Hi all, well my Classic Scooter Repairs business has failed and shut over the easter bank holiday and now I have a problem with a customer and am now looking at some form of legal way to get my money from him. The shop closed for good on the easter bank holiday weekend but before it did there were still 2 scooters left there belonging to customers. One wasn't finished, the other was and the guy couldnt come get it for 2 weeks. Well, I didnt want them sitting left locked up so some administrators / recievers could have them, after all they weren't my property they were someone elses. I told the fella that needed the work doing I would get it finished at my cost and deliver it to him, which I did, job done. However, the one that was finished is a problem, and probably a legal one at this point! Short story is that he'd come off it some time ago and didnt want to go through the insurance, and didnt want to report the off to the police (apparantly a range rover ran him off the road coming round a bend on the wrong side) Anyway, its a particular model 1963 Lambretta Series 3 with a chrome ring, all the headset was wrecked completely and there was some damage to the legshields and rear runner and panel, while the panel and leggies weren't totalled the headset was. So, it was with us for several months as we were unable to source a decent quality 40 year old headset, thought I got one at a autojumble at wicksteed in december which looked great until we had it in the parts washer and discovered that some clever dick had shaved the bottom off the headset turning a non chrome ring into a chrome ring but it was slightly askew. To be fair the kinda thing many would be happy using on their own scooter but not on a customers. Ended up getting one that was proper locally and bobs your uncle, though sprayings not easy in the cold weather! So, all in all we'd had the scooter for about 8 months with one thing and another though its been ready now for him since the middle of march and its been one thing after another. So, it owes the business (which doesnt exist anymore) £680 all in for all the bits and the work and I'd like the money to pay off some of the debts left over but the guys messing me about. Basically initially there was no problem, I could deliver it to him, then he couldnt make it, then he wanted his brother with him to be sure we'd "done what we said", then they wanted to come to me to pick it up check it over, then it's "I have no comeback if something goes wrong" So far he's cost me nothing but hassle and he accuses me of having it for ages, I feel that he's calling my trust into question, he's aggressive and the latest is that he wants to organise him his brother and a mechanic from cambridge way to come check it over and that's going be be another 3 or 4 weeks! Im proper sick of this and Ive been storing it securely at a mates but thats now costing me £30 a week, he says i can store it in my back garden but then what if it gets nicked, my insurance doesnt cover it and ive told him that. So, we've told him maybe he should come get it and we'll have to go down the small claims court which I think may be my only option now to be honest unless anyone can think of any other solution or avenue I can pursue? Please someone must have some idea of where I can go with this or point me in the right direction? I'm genuinely at the end of my tether.
  14. Thanks for the quick replies so far, ill get reading on that link but re the letter re job seekers allowance etc, Im not on the dole nor am i going to apply for it right now as I am applying for a couple of jobs already part time which im fairly confident of getting at least one of.
