  1. Hi All, Just wanting to know what I should do. I lived in a house with my brother up until 2006 then got kicked out (it was my mums house - long story). Anyway, about a month ago, I got a letter saying that me and my brother owed council tax on the property from the end of 2006. I asked for dates as it was paid up-to-date until I left - she confirmed it was when I wasnt living there. I informed her I wasnt there and she replied "well, you pay on time at the property you are living at now and we cant find your brother, thats why its been sent to you, would you like to make a payment arrangement?" I told her Im not paying it as Im not responsible then I got in touch with my brother (who I havent spoken to properly since 2006) and told him to get it sorted. I got a summons to the magistrates court and, once again, told my brother to get it sorted. He assured me he had, that he was paying on a monthly basis and knew all the ins and outs of the debt so I assumed he had contacted them and didnt attend court. Fast forward to now and I have just been sent a notice of liability. What can I do? I have provided the council with the address I was at the most when my brother, sister and mum made me homeless and I am damned if Im paying a bill I did not accrue, how can I challenge it?
  2. My brother had a mobile in my name with 3 mobile and run the bill up, 3 wouldnt cap it I phoned them and told them I wanted to cancel as soon as the contract term (12 months) was up. It was up in November 2006 (and I no longer lived with him at the address the phone was contracted to). since then, Ive found that 3 mobile continued the contract for about 7/8 months after that and have passed the debt to Lowell, along with an early cancellation fee, the amount owed is approx. £700!!!! I wrote to Lowell and got all the information they had on this debt, telling them that it is not my debt, and got the info saying I had been billed for some time after the November in which the contract was up. I wrote to them again and asked when the contract was up and they said November 2006. I pointed this out to them and told them the debt they were chasing did not actually exist. Fast forward to now, they havent stopped sending me letters and now Advantis have sent a letter on their behalf - a "notice of Intent to Commence Legal Action". I have a good mind to tell them to take me to bloody court so they can have egg on their faces, but what's the best way to proceed?
  3. Im so fed up with this now, so any help at all would be great. Back in 2003, I opened an account with T-Mobile. All my payments we kept up-to-date and they never had a problem with me. In 2007, I got my normal monthly bill and it was for £350 (normal amount was £30)!!! I was fuming with this - it was due to internet use (it used to go on when in my pocket) BUT these were advertised at 20p per day, unlimited so it shouldnt have been this much and I went in to my local T-Mobile shop to dispute this. The person behind the counter said he would make a note of it. Anyway, I heard nothing from this until this year, when I applied for a credit report. Now, Im getting lots of letters from Lowell, saying I owe the money. In order to delay them, I sent them a "prove it letter" and they basically say they dont have to prove it as its a mobile phone company and putting a SIM card in a phone is accepting a contract. Today, I got a letter from them saying "Your last chance to pay is escalated", saying that if I dont pay within 21 days, action will start against me. My credit file has defaults on it from them (from 10/01/2008, updated 22/09/2011). I dont mind paying them what I feel I owe but it is nowhere near what they say. What can I do? Also, my brother took out a mobile with 3 in my name. The contract ended in November 2006 (paid in full) and they have continued to bill me until August 2007 (even though they were informed In October and months before that it was to be cancelled in November as they wouldnt transfer it to my brother's name). This has gone to Lowell and they are chasing me for it, even though I have informed them (and they have the paperwork to that effect) the contract was up in November and paid in full. What can I do about this? Theyve also put defaults for this on my credit file and this debt doesnt even exist. Please help.
  4. Ive just checked my credit file (Im looking to go self-employed so needed to know if I can raise funds to kick start it) and here's what I found. Before I begin I want to give you a bit of background information so Im not judged too harshly. I lived with my parents and found out I was pregnant back in December 2005. Out of wedlock and coming from a religious family I was told to leave (well, no, I got a text message at work saying I wasnt to return, not even for my things and police would be called if I did), so I only had the clothes I stood up in. I spent all my money from my job (minimum wage) getting somewhere sorted. I didnt return to work after maternity leave. 2 DCA's have logged defaults against some old debts (the original debts have now fallen off). Can I challenge them to remove these (as I understand only OC's can do this)? I have 2 old mobile phone accounts, both in my name. 1 is genuinely in dispute, its to t-mobile but the DCA has said that t-mobile have not dispute logged (I went into my local store to dispute it). How do I go about disputing it? 1 is 3. It was for my brother but was in my name (he was 17 when I took it out). It went on long after I was made homeless (stupidly, I didnt cancel or anything but I did have a lot of other things on my mind). How do I go about getting the length of the original contract? The reason being, if it was a 12 month 1, I had already challenged it before I was made homeless and told 3 that I wanted to cancel at the earliest opportunity, and I wanted it capped at the contract amount (my brother was running it into hundreds of pounds and not paying me back). I also asked that they put it into my brothers name when he turned 18 (7 months after it was taken out) but they refused. They didnt cap it, as requested, and, it wouldve meant the contract wouldve been up a month before I was made homeless. Any help would be much appreciated as Im in a catch 22 - I cant set up my business with these debts but I cant pay them until Im earning.
  5. I have moved and not heard anything from T-Mobile. I received a letter from Lowells a couple of weeks ago saying that they were collecting this and I sent them that letter you suggested. They havent sent anything from T-Mobile saying the debt has been passed on. What now?

  7. Received a letter from Lowell today asking for money (and they sent me my last statement) on behalf of T-Mobile. Long story short - I had a contract with T-Mobile that ended in 2007. I went on the internet on my phone, as, back then, it was advertised as 20p/day unlimited usage. I could only access the internet through my phone and used it as I had poorly baby and googled her symptoms to avoid doctors visits. Anyway, the bill came in at just under £300! I went to the T-Mobile shop in our town and complained. He said he would look into it and get back to me - my complaint had been logged. I told him payment would not be made as they were advertising falsely. I didnt hear from them or use my phone again and it was cut off shortly afterwards. Now, the statement has a £130 early termination fee (they cut me off) and they have told me they know of no reason I am withholding payment. My dilemma is this - I have run up a bill but not to that amount. I want T-Mobile to knock off most of the internet charges (I didnt really go on it but you know what old phone internet connections were like so I was on a long time when I was on) and I will pay the remainder of the bill. How do I get this underway? Do I ask Lowell for the bill previous to the I received then contest it or just contest it? By contesting it, am I admitting liability and have to pay it all back? What's the best way forward? Any advice would be great.
  8. Hi everyone, I worked for a limited company and went to a tribunal back in 2005 (I know, a long time ago but there are reasons for me taking so long to get advice). I won on the grounds of automatic unfair dismissal (I took pre-arranged time off from my holiday entitlement to look after a sick family member) and was awarded over £6000. After the hearing, during the 8 weeks you have to wait before you can do anything, the company moved to another EU country, and ceased trading under this Ltd, setting up a company in a new name. As they did this, I was stuck as to what to do. Can you get a CCJ against a company that is no longer in England? I am so confused as to what my rights are now. I have written to the insolvency place to get advice from them but would appreciate any other advice anyone can give me. Thanks
