  1. Hi, Thanks for asking. I won my tribunal and was placed in the work group. The tribunal was with two very nice ladies who put me at ease and were very fair.
  2. Leemack, Is it correct that he can reapply for DLA before his tribunal date with the same medical condition before 6 months of being turned down? Thank you.
  3. Thank you ,something to think about. My husband was turned down after two years on high mob and care to zero but all the same illnesses plus deafness. He tells doctor of his joint pains and gets prescribred painkillers and anti inflammatorie for 3 years. He has hearing aids and needs help to cope.now has a letter from his gp backing him up, hes a cortezone, athroscopy, mri, physio, blood tests and xrays He is waiting for a paper appeal as it will be quicker, he had a date of Nov for the oral tribunal. He has pain, depression,iliteracy, anxiety, innsomsia . He doesnt feel ready to face a tribunal face to face si I will let you know what happens, whenit happens.
  4. Is this correct, there is no waiting period. So if someone gets turned down for DLA they can immediatley apply again. I was not aware of this. Wouldnt this make the whole process go round and round for ever? What would the point be of appealing then? So if I was awarded mobility and not care, could I safely apply for the care element with out an appeal which could put my whole claim in danger of being changed for the worse. Hope this makes sense, just taken a sleeping tablet.
  5. If you need help to hear people speak to you and have to have help understanding language then that could be classed as help. I wouldnt think that mobility would be awarded but it would be wrth putting in an application for the 'care' part of DLA. I think you have to be at a certain level of deaf too. You dont know if you dont try.
  6. When I was waiting for the 13 weeks for help with my mortgage I applied to the building society for a mortgage holiday for 3 months which was very useful. It does not effect your credit rating. I think most mortgage companys will do that as long as you are not in arrears. Good Luck.
  7. I rang the day before my tribunal just to check everything and was told that medical stuff I had sent was not on file. I even sent it recorded. I got to the tribunal early, took the paper work with me and the clerk photo copied it and gave it to the tribunal. I had used a highlighter to show up specific points but this did not show up on the photocopies. My tribunal was the first one of the day and they kept me waiting for a bit and then called me in. I was worried that they would not have read it all but they had obviously read everything. I had made the mistake of not being very detailed on my ESA50 , when it said how far can you walk, I had written - not very far. So I was questioned a lot about the answers I had given. When my time comes again I will take a lot of time filling in the ESA50. The tribunal ladies were lovely, there was just 2 of them and a lady at the back taking notes. They will not discuss any new medical ailments you may have had since your ATOS medical. I won and was so relieved and had my first proper nights sleep for months. Good luck.

I dont get any cash paid into my account but I had sky tv when I was working and when I could no longer afford it my son who watches it more than I do said he would give me the money to pay for it. My son gives me keep, he is down as a non dependant on my claim forms so do not get any DWP help with my mortgage. I dont get any other regular payments, just help now and then. If I have an unexpected bill then the kids help out, they have good jobs and I am struggling. They buy me nice food and treats, I know I am very lucky.
  9. The council issued the ticket. I think a complaint to the police could also be in order as when my friend pointed out an obvious lie the police woman said she was impartial.
  10. Can any one tell me what is classed as income. For example we have Sky television and the bill comes out of my account but my son actually pays for it and helps with all of the bills and mortgage. My kids who dont live at home regularly bring me nice food and pay for things for me or give me money towards a big bill or car tax. Is this income? They dont give me a set amount on a set day or anything but just help me out as and when. The DWP can easily see that there is no way most of us could live with out a bit of help.
  11. The insurance company has to pay the benefits back if the person is claiming benefits because of the accident. It will be paid back but not by you. This doesnt come out of the actual payment that the injured party gets. I dont know if your benefits are stopped or if the money is treated just like any other saving though.
  12. My friend recently went into a shop, bought a small item in a box but before leaving the shop realised it was broken. She tried to return the item only to be told that this was not the item that was purchased and had been swapped. Because my friend made a fuss the police were called and she was searched and threatened with being taken to the station. CCTV was looked at but as they had a blind spot in the store my friend was told that she would be contacted when a more senior security person could view the whole stores cctv. They didnt ring her so a week later she went back to the store, the manager wouldnt come to see her but she was given her money back. I belive that cctv was checked in my friends favour , i think the police were called in the hope my friend would just leave quietly. She got a parking ticket because she was so long in the shop, searched and questioned in view of other customers and accused of theft with absolutely no proof. She never once left the shop. Is she entitled to compensation.
  13. Hi, I had to do essential work on my old house, I borrowed about £20,000. I moved into my present house while still working. When I lost my job the DWP told me that although they agreed the work on my old house was essential to my family, as the house improvements were for another house then they would not help me with the payments. It is a crazy system. I am now struggling but stuck here as I cannot get a mortgage even on a cheaper house while unemployed. The mortgage company told me to go to the citizens advice if I was having trouble and they would help me with a budget. That is not much help, unless the citizens advice can help me print money then there is nothing that can be done. You will soon realise like I have that there is no real help out there for house holders no matter what people tell you.
  14. Being deaf brings a lot of problems. If a person cannot hear people talking, traffic, alarms or telephones then every day help is needed. Of course he needs proof that he is deaf. The mobility is something else. I did not say he needed help with mobility for his hearing. What point are you making?
  15. Hi, I won my case at tribunal but was put in to the working catagory straight away. I went to tribunal in Aldershot and they were really good. I was given the decision letter to take away with me, sent a COPY, make sure its a copy, to the DWP and got the extra money and back pay quite quickly. This was spring last year so maybe they have got further behind now. If I was you I would ring every day and ask to speak to a supervisor. Make yourself a nuisance. I know what stress you are under, I didnt sleep properly for months. Good luck x
