This particular case seems really odd to me as I had a Payday Loan with Cash Genie for £325.50 (including interest) and couldn't afford to pay it back due to my circumstances, I cancelled my card and emailed them straight away on the due day offering £50 a month and they got back to me almost straight away accepting my offer. They did ask for a goodwill payment of £20 straight away to hold my account and stop further interest accruing until the first repayment amount of £50, I was in a position where I had this £20 so I paid it into their account at the bank that same day. Even if I hadn't have had £20 available they would have accepted my repayment proposal but It would have meant that I'd had to pay further interest for the days leading up to the first repayment amount. I have now made one payment of £20 and one payment of £50 and both amounts have come off my balance. It just seems really strange that they will accept my offer of £50 per month but not yours, perhaps you could argue this in court?
  2. No I didnt use a template, I used my own letter, my thoughts behind that were that It would be more personal. I specifically wanted to make them aware how long I had been rolling over the interest for and the fact that I thought I had been a good customer up until now and that circumstances beyond my control had put me in the position where I could not afford to keep up the payments. I did find my credit agreement and quoted all the specific dates and information for example: Date original loan was taken out, how many months interest I had rolled over etc also making sure they were aware that if they took this into consideration I had already paid more back in interest than the original loan I had taken out with them anyway! I then proposed an offer of £16.50 per month for the next 8 months to be paid by standing order on xdatex and then 1 further payment of £16.50, (but this bit is up to you!) I then finished it off with this - If you are not willing to freeze the interest and charges on my account and accept my reasonable repayment offer and you threaten to take me to court over the above I want to make it perfectly clear that I will see it through all the way through, and claim costs from yourselves if you do not. I request that any correspondence is to be sent in writing, I have attached a letter reminding you about the consequences of telephone harassment. I did find the telephone harrasment letter from this site, just type it into one of the search engines you will find it or maybe another cagger could give you the link? One other tip is to send your letter by recorded signed for delivery, It will give you peace of mind that they received it and they will be unable to deny the fact that they dont have it, the best address for them is Capital Finance One Limited Copper House 88 Snakes Lane East Woodford Green Essex IG8 7HX After you have sent the original letter, follow it up like i said with an email to Barry Silver copying in Micheal Demetriou

  4. Sorry I forgot to mention that bit! I did cancel my card, they are renound for clearing peoples accounts, It didn't cost me anything though I just declared it lost, Also be careful not to take out any new Payday Loans they trade under a few different names and will send you various emails to try and get your new details.

To be honest, they phoned me at work a few times, however I work for quite a large company, I was quite sneeky and informed our IT department that they were a nuisance caller and got them blocked - bit of a tip if you could do the same! In the end they emailed me about 10 times, I just stood my ground, I owed them £130.00, they are very stubbon and do go on about adding interest but I now pay £16.50 a month which will last for 8 months and then I offered an extra month on top to them as gratitude (making it 9 payments in total) the best contacts I have for them are [email protected] [email protected] Send your emails requesting a repayment plan to Barry and copy Micheal in. I have kept to the repayment plan which is realistic and have been making payments now since March and like I said they have never bothered me since. Hope this Helps!

  7. Cancel your debit card straight away and think about getting a new account This company have been known to ''push payments through'' even when your card has been cancelled. They are notoriously hard to get hold of although if you owe them money you may find that they hard to get rid of Id try this email address [email protected], i have managed to speak to somebody through here before, whether its ''Barry Silver'' or not nobody knows. There is a phone number: 0843 216 4323, however they do not always answer. I do now have an arrangement in place with these now at £20 per month, just hold your ground and be firm, you will usually find that they will back down eventually, good luck

Be careful here, if you havent actually cancelled the direct debit, it will go through anyway, it does not necessarily show up until the day it comes out, I wouldn't of thought you could stop this without changing your bank account if they have a signed mandate, I think you may need to ring your bank and check

Anything goes with these cowboys, if you dont receive any money you will probably find that you can't get hold of anybody as if they have fell of the face of the earth, as they will be having ''technical issues'' causing a delay in payments, they seem to have these issues on a regular basis, I think this company is a con, they do pay out the odd loan here and there but they seem to take a huge amount of unauthorised £1.00's from peoples bank accounts. I wonder how much money they have actually made by doing this, 100 people applying a day?? you do the math:-x

I am having exactly the same problem with these at the moment, I keep getting these emails from James Keeble @ capital finance one telling me to apply for a loan today and when i applied last month it said the same - application paused due to outstanding loan, I too have previously paid the loan i had in full, its not really an issue with me needing the money more the fact that i dont want this loan to show as outstanding on my credit file!

I think that this could be a great idea, people dont want to deal with these companies themselves so why not pay somebody else a small fee to do it for you, although I am aware that you are in it to make a profit you will have to remember that alot of people who take out these loans wont be able to afford ridiculous fees etc The other thing I will say is that it could stop people from taking these debts seriously I think that you would have to make people aware from day one that you cannot guarantee repayment plans etc, Also I suppose there is the fact that many people have already tried to be reasonable with these companies and failed so why would you be different to anybody else?

A friend of mine has managed to get in some awful trouble with his council property and could really do with some advice, basically, he went to court around november time last year as he was in arreas with his rent. As far as i can gather the warrant for eviction got suspended and he was ordered to pay £96 per week (which is his rent + an extra £6) to catch up with the arreas of £2890.00 He is a subcontractor and the company hes been working for finished his contract towards the end of december 09 before this he was sticking to the payments, but he didnt start work again until a week or so ago, the problem is he didnt ring them to explain he just didnt bother paying, so now the outcome is theres another warrant gone in for his eviction and im guessing that he will get another court date any day now, he has the right to appeal but hes just been ignoring all the letters, ive looked at the most recent and the only advice it offers is to speak to a homlessness advisor, is the eviction unevitable or is there anything he can do? His wife died a few years ago and he is a single parent with two daughters age 20 and 16 who live with him, he is alchohol depandant and one of his daughters is a recovering drug addict, i feel that this classes him as a vunerable adult but am not sure if that will help him at all, please advise

I think you may need to contact them and find out how much the administration fee is, if this is less than the £54 (2-week) charge & interest then they are incorrect and will only be able to charge the admin fee. Very convinient that they do not put this information in the terms if you ask me they could tell you anything, i would ask for it in writing.
