  1. 12 years ago? After 6 yrs the account becomes statute barred. send them a statute barred letter. that should do the trick.
  2. Even if they do sell it on to another DCA dont worry about it as they legally cant sell an account thats indispute and since they have failed to supply you with a CCA that is a clear dispute. They will probably chance there hand but send them this letter and then ignore any other letters they send... Dear Sirs, Account No: XXXXXXXX I write with reference to the above numbered account. I would like to point out that this account is formally in dispute with **Original Creditor ** and has been since they failed to acknowledge my Consumer Credit Agreement (CCA) Request, in line with s.77-s.79 of the Consumer Credit Act 1974 (CCA1974). As you are no doubt aware, your continual harassment not only breaches the Consumer Credit Act (1974), but also the Data Protection Act (1998-), the Consumer Protection From Unfair Trading Regulations (2008-) and the Office Of Fair Trading's debt collection Guidelines. Being that the Original Creditor is now in default of my CCA Request and OFT Debt Collection Guidelines, I consider this account to be in serious dispute, especially due to the fact that whilst my CCA Request remains in default (outstanding), enforcement action is not permitted in line with s.127(3) of the CCA1974. Consequently, any legal action you pursue will not only be fully and vigorously defended, it will also be averred as both unlawful and vexatious. As such I respectfully suggest that this account is returned to the original creditor for immediate resolution prior to my seeking legal advice; due to the fact you cannot lawfully pursue any enforcement activities as the account was already in dispute at the time you became involved. If you decide to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, Financial Ombudsman Service and possible court action. I hope that this will not be necessary and an acceptable solution can be accomplished. I would appreciate your due diligence in this matter and look forward to hearing from you in due course. Yours faithfully Sign digitally
  3. Im not to sure where my GF stands with this but as said before the HP was paid off via GAP insurance we had a letter saying this was so but she didnt keep the letter stating this, i mean whos was to know that 2yrs down the line she would be getting chased for it, however MKRR sent a loan statement and on it said DEBT WRITTEN OFF on the 05/03/10 but in the letter they sent with this they state that was the date they took over the debt? Could someone please advise as its a bit confusing. Ive still gone ahead with the complaint to the FOS as the account was illegally sold to them as it was in dispute for months with The Lewis Group
  4. ; Hi minivan, With respect, its my personal view that MKRR are clowns as they have repeatedly ignored my dispute which now the FOS are dealing with..I refuse to pay what has already been paid for, does that make sense to you?? If you have had good dealings with MKRR the well done im pleased for you however not everybody has the same relationship with DCA'S as you have, so please dont take the stance you have or feel personally insulted by my comments.. The end of the day you have good dealings with them, I havent had good dealing with them and by the look of some of these threads on here a lot of people would agree with me. As a former TA soldier myself I know what kind of s**t you can get in being in debt whist being in the armed forces.. What puzzles me is that you managed to get into the army whist being in debt, I myself was refused an S-Type due to the fact that I had some outstanding debt and my outgoings were more than the income the army would pay.. Never mind that thought.. I respect your opinion and id apreciate it if you would respect mine, lets agree to disagree shall we say. Take care
  5. Already done..Ive email OFT and sending hard copies too them and to the FOS.. It does make me laugh
  6. Just another ****** DCA tied to Welcomes apron strings then
  7. Hiya all, Just wondering if anybody has had any dealings in the past or present with MKRR (Milton Keynes Rapid Recoveries).. Since Lewis group failed with my GF CCA request and not heard from them for 2 months she gets a letter from MKRR trying to collect etc, I sent them the ACCOUNT SOLD WHILST IN DISPUTE letter and now sent one back saying they will futher action blah blah blah, so sending them the last letter today and making a complaint with OFT etc.. Let us know if you know anything bout them as ive googled the name but nothing comes up.. Thanks again
  8. I have to agree with you there, they do look lovely. I dont have an ignore pile like yourself as I try and keep mine nice and warm by sticking them in my incinerator:lol:
  9. They called me again this morning and they say there a company called Call Contact and apparantly they specialise in writing off debt from before april 2007... So becareful if you recieve a call from this number..
  10. Thanks for that... Just found the number and all that came up was 0 complaints, no name of any company.... Is it possibly scamers??
  11. Does anyone know this phone number?? 0151 6327710 I get a phone call everyday always around 5-5.30pm they leave a message to call back and when I do the tone I get is a disconnected number.. Any clues anybody??
  12. Just sent off a letter requesting proof about the payments so Ill keep you posted on what they send me in return..
  13. Hi there... Yeah I sent them a CCA back in November and all they sent back was a Credit card application form and later on some terms and conditions and the funny things was both of those documents sent to me had 2 different addresses on them..I think the copies of what they sent are still on here at the begining of the thread...
  14. Well ive already lodged a complaint with the OFT and signed a waiver saying they can use my name and the reason for my complaint as and when they have enough evidence that there being dodgy!!!!!! So I take it they have been known to say payments have been made when they havent??
