  1. No - I really didn't want to do this but they have left me no Option, I just wanted to get on with my job.. No warnings no disciplinary just straight dismissal. I mentioned this at the capability meeting, and I have to put it in with my appeal.
  2. I have the text messages I have screen shot them and have them on my personal email. I have the shaz email. Unfortunately when I asked to check my emails I couldn't locate any others.
  3. I was wondering if I could get some help of anyone. 4 weeks ago out of the blue I was taken in the office and handed a letter to say the company wanted to Have a meeting with me about my performance and gave me a copy of the capability procedure. I am not in a union and was allowed a representative with me, I chose an ex boyfriend who worked at the Company, but was told at first he wasn't allowed to attend, at this point I had a breakdown and the dr signed Me of sick. I've been off work approx 4 weeks sick, the 1st meeting got cancelled due to my mental health, the second meeting even of sick I was asked to attend. These are the reasons for my capability and the meeting. 1) sending an inappropriate email to a intercompany which had to lead to a apology in may 2012 The actual email was in red capital letters and not offensive just asking them to attach the parts list with the goods, but the Red capital made it offensive, I written an apology. 2) during a stock take I didn't listen and basically used the info I wanted. Thus was nov 2012 There was a mess up and the supervisor sent the wrong info to the supplier To be counted, I have emails to prove this. 3) I didn't do my time booking. Feb 2013 I had to go home early due to my child being ill. 4) I put pressure on the stores by not picking parts I was asked to pick. Feb 2013 I am a material planner, picking parts really isn't my job but there was a problem with this A colleague had started it and I arranged for the rest, the kit wasnt complete so I spent 2 hours Overtime sorting it out and checking I had to ask stores for additional help with heavy items that Required a pump truck. I went to the meeting and highlighted my thoughts to be told I was being dismissed because They really couldn't micro manage me. I have had 2 appraisals since working there and the only matter they brought up was I don't always listen. I was not told at any point so was in complete shock. I have worked for them less than a year. Over the last 11 months I have been subject to bullying and sexual harassment by my immediate supervisor, When I started dating a guy from the company he changed and this is why I think this has happened. Sexual harassment bullying incidents 1) At first he used to call me Sharon stone saying I didn't wear nickers, I have an email saying hi shaz, my name is Nothing like that. 2) he used to always try and stroke my legs and my neck I used to flinch and pull away (no evidence to proof this) 3) he sent numerous text messages to my personal mobile phone which I have including:- - "did you sleep with student" - he wasn't very well so I told him he should go bed his reply " thought you would never ask" - I wasn't very well he asked me to send a pic, his reply was you look pretty bad but I would still Give you one. That was prior to my relationship with my colleague. 4) one morning he asked if it was a coincidence that me and my colleague clicked in 2 mins apart 5) he was constantly bullying me about my hours, I am a single mom and wanted me to do overtime, This overtime affected my tax credits, I did do some. I spoke to HR to clarify the hours procedure. 6) he asked one day why mine and my colleagues clock ins were 10 mins apart when we have lunch together, He came back went for a cigarette, I don't smoke. 7) he sent an email saying my colleague had managed to do something he hadn't Got me up. 8) he spoke to my colleagues manager regarding our relationship. And said it was a good job I didn't work Directly with him. I feel all this has come about due to this, and he was jealous of my relationship, I plan to appeal the dismissal, Based in the info I have supplied could I take this to a tribunal based on unfair dismissal sexual orientation ? Any help would be great fully received and thanks for taking the time to read this. I was employed by the company 22/5/2012 and dismissed 10/05/2013 I have till Friday this week to appeal.
  4. I did argue the point that i thought we were flying on US AIR as stated on our Invoice. The Judge was nice and did have a go at the Virgin Woman she went off on one and he said it was not criminal proceedings LOL. I think the Judge should of awarded more but i WON and they LOST.. even if it was lower then expected. It shows we don't all give into them. Oh and if im allowed a nice bottle of whiskey will be coming your way. And there is no way i want to even think about appealing.
  5. Please can a mod confirm if its ok for me to send legal a Bottle ? This is to thank him for all his hard work in helping me.. I was peed off at first but then i think I WON.... And they must of paid their solictor quite a bit.. So it was worth it because it messed Virgin about and she missed her train LOL
  6. Basically Virgins terms and Conditions covered everything.. he accepted the claim for the suitcase. Didn't accept the car hire or fuel which i thought he might not They asked me to prove if the flight was safe, they would of had to have a safety certificate so they refused the internal flight. He could understand Disney with the photos ect Bahamas he said that the only thing effecting the holiday was the pool which would of effected our holiday but seems we had no issues for the food and drink he could not award us a full refund. Virgin basically kept making out we had paid a average price for average accomodation and u had enjoyed the food and drink ect ect. Thats how he came to his decision, i tried to fight as hard as i could.
  7. Did you fill out a report in resort with the Rep. I would make a complaint to them in writing and see what they reply with. Did Paul get the name of the person on the telephone who confirmed it was a deluxe room ?
  8. Thanks. It was hard work in court we were in there all day. The judge took 90 mins to come to a decision. We were in ourt 11-13.00 then back in at 14.40 till 15.30 The judge did say how well the case was set out thanks to legal. I couldn't of done it without him and very thankfull. I would still like to send him a nice bottle of something if it is allowed.
  9. Well Im back, After being at the court all day. The Judge took 90 mins to decided what to do. I won my case but he did'nt award much money. He awarded me the total sum off £749.99 Plus interest. Virgin Moaned that because the claim was over stated the costs were alot higher than they should of been so i was only awarded 50% off the costs. All together i will get just shy of £1100. Thanks for all your help everyone, A donation will be made to CAG upon reciept of the cheque.
  10. Thanks all and especially legal pickle. I will be back on this afternoon and let you know how i got on.
  11. Thanks for your help. I will go through it all again in the morning, So its clear in my head.
  12. Is this better ? 1. I am claiming for a new suitcase has mine got damaged by the airline. I was very upset because this contained my wedding dress. 2. Had we known that the time in the Disney “Conorado Springs resort would of been like”, we would have never booked it. Because of this we flew into Orlando airport, rather than Miami airport; and spent approximately £40 in the fuel for the vehicle travelling between Orlando and Clearwater; and vice-versa. 3. We were told by the “hotel” in the Bahamas that they do not charge for transferring passengers from the airport to their “hotel yet we were charged a transfer charge. 4. According to the tickets for the flights from Manchester to Orlando return, the charge of the ticket comes to £125.30 each [£40 + £13.40 + £71.90]; but we were charged £147.30 per person, we were overcharged a total sum of £44. 5. We rented a vehicle from Virgin Holidays for 10 days – whilst we were in the USA –Had we have known of the building works in Disney we would not of gone there. . As such we claim a refund of the 3 days that the vehicle would not have been used. 6. I claim the full amount £312 we paid for the Disney “hotel”, due to the nightmare of the building works. - we were woken at approximately 8am to the sound of drilling and banging. We discovered there were major renovation works going on in the room 3 doors from our room. The workmen were refitting a bathroom suite, fixing mirrors and shelves to the room. Outside of the room on the landing there was lots of tools, these included drills, planers, saws and various other electrical equipment. There was also an electrical lead running along the floor which we had to walk over. 7. If we had known before what Breeze Bahamas would of been like I would not of booked it. - the pool we found brown **** on the surface of the water. The shower did not work and the Jacuzzi only worked in one area where there was only sufficient room for one person to sit. We witnessed 2 people hurt their feet on the metal stairs leading to the pool; the stairs had a protruding sharp metal edge. There was also a light in the pool floating on the surface with a wire connected to it. We were extremely worried for their safety. The towel staff were very rude and unaccommodating when giving out towels. Our room was on the ground floor and the curtains didn’t seem to close properly, so on the 1st night we had to use our suitcase to keep the curtains together so no one could look in. 8. If we known how much of a scary hell the flight would have been to the Bahamas we would not of booked to go there. When we boarded the Aircraft for our flight, we noticed some loose wires to the left of out feet. The aircraft was 27 years old and the cabin was very dirty, the aircraft also seemed to fly right, then straight, then left, then straight; constantly for the whole flight; which terrified us completely, The tickets for this flight stated an amount of £444.15 each [£888.30], but we were actually charged the sum of £530 each [£1,060]; hence we were overcharged by the sum of £171.70 I also claim the sum of 25% of the monetary value of the stress, aggravation, hassle, lack of enjoyment, distress and upset caused to both myself and my husband.
  13. Is this okay, Is there anything i have missed or need to do ?
