  1. Received a letter a few days ago from capquest in response to my latest CCA request. They have confirmed that Lloyds cannot locate my original paperwork and unless that situation changes, the alleged debt is unenforceable and capquest will cease hassling me. Happy days!! Thanks very much for all of you who have assisted me over the years, I shall be making several dozen copies of the letter for very safe keeping. Now to take a closer look at the Amex account.

  3. Yeah, alas, I thought it was 5 years until I went through some old comms with Lloyds, turns out I was paying them 'til July 2010. Point taken on the thread and noted for the future, haven't been on for ages as it was all quiet on the DCA front whilst they fabricated another one of their Recon agreements.
  4. I've been communicating with various DCAs around an old LTSB CC for years and with capquest having purchased the debt from Lloyds, they are beginning to get somewhat more aggressive in their stance of late.
  5. In addition to the issue mentioned above, I sometimes work away for a couple of weeks and with nobody at home, letters lie around unanswered for a while. It's not worth setting up mail forwarding as I'm living in different hotels on the most part whilst working away. Whilst I loathe the parasites that are DCA's generically and capquest specifically and do everything in my power to frustrate them as often as possible, I don't want to appear to ignore letters when in reality it's a combination of them falsifying their letter dates and me being away from home for a bit. Anything that prevents them or gives them an excuse from pushing my case to the top of the litigation pile, gets my attention.
  6. Great, DCA in question is capquest. There's some freeware software that tracks and confirms when a sent email has been delivered and viewed, any ideas on the name, I think it's pig something?
  7. As the title states, does anyone have an arrangement with a DCA for communications via email? Can I insist upon communications via email or is any such arrangement at the discretion of the dca? I've received letters from DCA's recently where the difference between date on the letter and date received is several days.

Quick update: Called accountants this morning and gave them an ear bashing, they've admitted their (numerous) shortcomings and have agreed to write off the full amount of the invoice, call off their threat monkeys and leave me in peace. So a result! I knew I was in the right all along, just needed some moral support from you guys and gals, so thanks again.
  9. Personal guarantees are pretty much common practice, certainly when dealing with banks and larger suppliers.
  10. Yes it was a Ltd company and there was no personal guarantee in the original contract. All of which suggests it's just a fishing trip by the DCA but if they default me I'll be very pi**ed off. I'm going to write to the accountants today asking them to clarify a number of points.
  11. As the title suggests, I've been contacted by Oriel Legal Group via email stating that if I don't pay up they'll be taking immediate legal action. The debt is disputed, is allegedly owed to a firm of accountants who I used when I ran a Ltd company. My company was closed with no external debts. Three months after the company closed, I received a final invoice from the accountants to me personally (not the company). The invoice related to support to close the business (of which they provided absolutely no support) and some year end forms (which they may have carried out for the business). Can they sue me personally for a business debt? I've checked the contract and there's nothing anywhere which states that I am personally liable for business debts. Should I respond to Oriel or are they simply on a fishing trip?

  13. Capquest is the DCA, heard they're a pretty nasty bunch. I'll treat them like the other DCA's I've dealt with - polite, keep to the facts and hopefully convince them I know what I'm talking about and won't be intimidated by the threat of court action.
