  3. It was buy it now I know how to take action, I just need to know before I start if the Distance Selling regs apply to a product sent from Germany - Thanks for the reply though Can anyone else shed any light ?
  4. Hi, I know in theory all member states of the EU should have a harmonised law applying to DS Regs, can anyone confirm if this it the case? Problem is we (read my partner) bought a (reasonably pricey) pram for our newborn (born a week ago today!) on ebay from Germany, the thing has arrived but there are a number of problems with it. The main thing being the bloody thing is huge and the front wheels appear to be the non "swivel" type ! Which is not good for us as she will be going on the bus etc. The ebayer is a business and does a returns policy but I am worried about getting shafted on the postage both ways. If DS applies then I am entitled to a refund on the postage too, and I believe the seller needs to arrange for their own collection of the item unless otherwise specified ? Thanks for any help you guys can give me ! Other probs with it anyway including the car seat having "used" looking scuff marks and no manual, but still, the other points above stand. Cheers, Phil.
  5. I am gutted, I was going to go after Midshires but have dragged my feet since November and now looks like I've missed out! Was going to use the cash to settle a debt as well - hopefully we will get around it...
  6. It was 3% year one and 2% year two so yeah it was bollocks. Thanks for clearing up re the liquidation damages clause, I hadn't read about that yet which is where I found the grey area.   7. My concern is that the amount of interested lost in that period I should of been tied in would roughly be equal to the penalty I was charged.. which would make it proportionate.. so would that be legal?
  8. Hi, I am looking to pursue Birmingham Midshires for an ERC approx £2800. It was fixed rate for 2 years, I bailed around 8/9 months before the end of the second year and was thus charged 2% of loan amount. My concern is that my mortgage was interest only, so the £300 a month I was paying would of come somewhere in the region of £2500 etc if I had paid til the end of the second term. Does this mean interest only mortgages won't really work this with this type of action? Please advise as this would be excellent news for us to pay off our remaining date.

  10. Hi all, Basically my car went into a garage last year as I stupidly ran it so low on oil I managed to completely balls the engine. A local firm told me it's best to rebuild it etc and that they would give me a 12 month warranty. It hasn't been right since, and after a few months it was still using oil AND starting mis-firing! It went back and took a ridiculous 2 weeks to get the valves changed, this was after a week of them denying the warranty, telling me that the guy who gave it out had been fired and that even that they had changed trading names so the warranty wasn't valid! I luckily checked on companies house and got their annual return to confront them but they denied saying it and honoured the warranty. Anyway, I got it back, took it straight for an MOT, and it failed on emissions!! (It's a 3 year old car by the way). It failed on Hydrocarbon, Carbon monoxide and lambda. Anyway it went back in, they first wanted to swap the engine but they conveniently couldn't give me any paperwork for the new engine... so they said they'd rebuild again, after another two weeks of phoning and chasing them up and the guy telling me numerous times it's in pieces and bits are in his hands and they are waiting on parts etc, we drive up there to find it locked out the back in a lock up, UNTOUCHED, and the boss on holiday!! F*cking ridiculous! Anyway, after a grand total of 4 1/2 weeks I got the car back, straight to MOT centre, and AGAIN failed on Carbon Monoxide emissions!!!!! Surely I can't be expected to return the car to these monkeys again? Since day 1 they have had my car for a total of 10 weeks, and if I give it back again, they will just string me along giving me bull**** stories and it will back and probably still not be fixed! Can I get it fixed elsewhere now under the circumstances and bill them, or how do I proceed? Thanks! Phil

  12. Yes that is a copy of what they sent back saying they intend to defend. I got my DG Solicitors letter on the same day

  14. After speaking to them, I faxed them a letter requesting it formally and today I got a settlement letter for the full amount. To be honest I didn't want to bring in the confidentiality problem because I am up to my neck in currently going through a new mortgage and this will cover nearly all the remaining debt I have when it's done.
