  1. Thanks for the tip Buzby... I contacted my local MP (Any Reed) and his office have said they will help me get the DVLA off my back A letter was sent and is now being looked into by the "CEO" of the DVLA, a Mr Noel Shanahan... (Oh, and since when did the DVLA become an American style corporate enterprise in need of a "Chief Enterprise Officer"?!?!? It's supposed to be a bloody civil service!! More evidence of the neo-corporatism of all that was once good in this World! ) Anyhoo, before I break into a rant about the state of this fair isle and the seemingly lost cause that is our system of government, here's a copy of the letter the DVLA sent back to Any Reed's office:- A top tip for DVLA issues - Get your local MP's office to send a letter to the CEO of the DVLA - He MUST read it! I've definitely wasted more than £80 worth of their time (I'm sure Mr Shanahan gets paid quite a respectable wage for a "CEO"!), so hopefully if everyone does this, the DVLA will realise it's an inefficient way to raise revenue and put a stop to it! I'll keep you posted of the decision... Vive la revolution!

Hope you don't mind, but I've copied your words and slightly re-worked them into a letter to the DVLA:- ******************************************** Dear Sir / Madam, It seems from your previous letter, that the DVLA are claiming that it is a ‘supplement’ rather than a ‘fine’. It seems you may be claiming this to avoid having to satisfy the relevant legislation. Your previous letter also seems to contradict itself. Whilst claiming that the £80 charge is a ‘supplement’, Mr Green clearly refers to it as an ‘LLP’ which stands for ‘Late Licensing Penalty’ and on that basis it clearly does constitute a penalty and not a supplement otherwise it would be called a ‘Late Licensing Supplement’ or ‘LLS’. Secondly the word ‘supplement’ itself has meaning. In this context it means ‘in addition to’. Since no money is owed in the first place, as tax is not being paid on the vehicle, it cannot reasonably be referred to as ‘a supplement’. The argument which Mr Green presents is bordering on morose. It appears to me that the DVLA are retrospectively producing interpretations of various laws in order to justify their efforts to harass defendants via the use of DCAs. The sentence which Mr Green writes in the third paragraph is also misleading. Mr Green states the following; VERA specifically states that the monies owed under Section 7A may be recovered as a debt to the Crown, therefore it is a civil matter. Mr Green is implying that the DVLA do not need to prove the case first. On this point he is almost certainly wrong and the opinion he is providing appears deliberately misleading. Whilst the debt on conviction might be owed to the Crown the issuing of the LLP may not constitute a debt since the DVLA does not constitute ‘a recognised judicial body’ as specified under the European law to which Mr Green refers. As such the DVLA have no authority to turn the allegation of an offence into a legally enforceable debt. Regardless of what Mr Green appears to state (and Mr Green should actually warn any defendant that he is not legally qualified to give his opinions) the DVLA would still have to show, in court, that I committed the offence in question. I have discharged my legal duty by sending the original V5 document. The DVLA will have to prove, beyond reasonable doubt, that I did not. If the DVLA wish to pursue me in a civil matter, purely for an outstanding debt, then I will inform the court that as far as I am concerned, the debt does not exist.   4. Oh yes! I've now been sent the following letters from both the DVLA and Bailiffs (After sending the letter template on this forum):- And from the Bailiffs:- Seems I am not a criminal, but I am being extorted by the Secretary of State, on behalf of the Crown, for £80 because I didn't declare a scrapped car off the road. The fact that I sent them the V5 means nothing to them. The DVLA clearly won't listen and are now trying the tactic of simply selling the debt to a private company, who are using threatening language and charging additional costs! Any ideas on my next steps? I'm thinking of writing a letter to the Secretary of State asking for a "pardon" or "clemency", but naturally he won't be able to take this decision on behalf of the Crown, only enforce the fines Maybe I should pop round the Queen's house and see if she'll have a cup of tea and a chat about how her government are extorting money from innocent people. Or maybe this is just one of the tipping points in the revolutionary process that we can't stop as individuals?
  5. Hi Crem, I did notify them straight away. I didn't read the small print telling me I had to chase them up. I didn't get proof of postage for this reason. I'm thinking of using the letter template in this forum so I can do exactly as you suggest - see them in court and prey the magistrate is on my side. Not sure there's any more I can do!
  6. Crem has responded in another thread with the following:- When did you notify them? If it was at the time of the scrapping and within the valid VED at the time, then you have fulfilled your duty. I think I would send one more letter in answer to them confirming you notified them correctly and on time and state that you dispute their claim and that you wil not enter into any further communication with themor their agents over this shortof discussing the matter in court. I did notify them by posting log book the day the car was picked up by the scrap man and taken away (This was over a year ago now!). Should I use the template provided in this forum or follow Crem's advice above and simply tell them I don't want to hear anymore until I'm in front of a magistrate? Is there anything I can do to strengthen my position to avoid any liability when it comes to court? If they fine me £1000 after court hearing, can I go to prison in protest? I'm kind of hoping this happens so I can bring to light this extortion racket worthy of the mafia! Thanks for all your helpful comments - nice to know I'm not alone in this.
  7. Thanks Conniff - that makes much more sense. The letter is headed "Specialist Bailiff & Debt Recovery Agents"! They'll try anything to scare people, and this is OUR civil service!
  8. Sorry - didn't realise it was MY responsibility to read the small print on a Government agency document! We may need to do this with private companies we don't trust, but I am of the opinion that our Civil SERVICE should be trusted to have OUR best interests at heart!

Hi, I sent my V5 logbook in when my old car was scrapped over 2 years ago!) but after writing a letter to DVLA, in response to a SORN fine, explaining the situation, I had no response and my case passed has simply been passed onto the Bailiffs "Philips Collection Services" who are demanding I pay the fine of £80 or face imprisonment or a £1000 fine!!! What can I do? I do not have spare cash to fund the government in their pledge to rid us of terrorists!!! Any help, much appreciated!

What can I do? I do not have spare cash to fund the government in their pledge to rid us of terrorists!!! Any help, much appreciated!
