  1. Hi again, I hope this is in the right forum but I need some advice on what to do with this letter that I received today from Restons. The letter is dated Thursday July 27, 2017 and it arrived this morning (August 5th) It concerns an overdraft and it says that the client is prepared to consider repayment of the balance by instalments. It also states that Arrow has referred the account to Restons for legal action and says it means we are instructed to issue court proceedings against you. They have sent along an income and expenditure form and have asked me to return it to them no later than Thursday August 3rd! I don't really want to call these people up but it concerns me that they can send a letter and ask me to send something back to them before the date that I received the letter in the post. It makes me think its some underhand tactic to issue court proceedings before I have a chance to respond. In the absence of time travel, what are my best options to deal with this?
  2. I did mean Restons ( I didn't even realise I had put Lowell anywhere!) And I misread the the agreement question - I read it as did you enter into the original agreement before 2007 - no I am not sure when I entered into the agreement but it was definately after 2007 Thankyou

Credit Card When did you enter into the original agreement before or after 2007? After Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Arrow Global Were you aware the account had been assigned – did you receive a Notice of Assignment? 99% Sure I did Did you receive a Default Notice from the original creditor? Not sure Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? My rent payment nearly doubled and I could no longer afford to pay ☹ What was the date of your last payment?   4. Hope someone can offer some advice! On November 26th 2010 I had an unfortunate experience with a DLR ticket machine at Greenwich Station whilst trying to renew my monthly travelcard. It took 3 attempts before I was able to get the travelcard loaded onto my Oyster - the first two attempts the machine just said it was unable to read my card and the transaction was cancelled. However, on 29th November, My bank account was debited with two lots of £82.20 so although one of the transactions had correctly been cancelled the other two had gone through and this is where my problem began. I phoned up DLR customer services who took all my details and promised to ring back - which of course they didn't. I had to call them back! I was then told that I'd need to send them a copy of my bank statement, oyster card summary showing I only had 1 travelcard and not two and a covering letter stating that I wanted a refund. I did this on the same day and posted it out to them. A week later I'd thought I'd check up on my refund - just after the first lot of snow - only to be told that they mysteriously hadn't got my letter and they asked if I could email them the details instead using attachments. I sent them the email that afternoon and next day again thought it would be prudent to phone and check up on my refund...this time they can't open my email (They can't read Word documents apparently). They asked if I could convert them to .pdf files and send them again..I did this the next day as it took ages to get the files converted and again I called up to check on my refund. This time they were able to read my email and would get my details into the system and a refund will take...14 DAYS. this 14 days was up just before Christmas and during the working days between Christmas and New Year I phoned them up to find out what was going on. They were waiting for postal orders but its come in and it'll be in the post to me today by first class mail (29th December). On New Years Eve as nothing had arrived in the post I called again, was hard work took 23 attempts to get through, and was told that the postal order had been sent out on 29th December and had probably got caught up in the mail somewhere but to give it a couple more days. This morning, I phoned up and was told that the postal orders weren't in yet, whoever had said it was sent out last week was giving out the wrong information and they are expecting them in soon. Could I give it another WEEK. Needless to say I went ballistic about being lied to and I said that I'd been patient enough waiting for this refund and asked to speak to the manager - who convienently isn't in til this afternoon.... Considering the amount of time and frustration this has caused me, is it worth me taking them to court and requesting compensation for the time and hassle this has caused me or do I contact my bank and see what they can do? Any advice is greatly appreciated.
  5. Today I received a letter from Hamptons legal. They've written to me for this one last time offering me a 50% discount on the full amount if I pay the entire debt in full or a repayment plan of £40 a month until the full amount is paid off. The debt is for an overdraft facility at the Abbey from about 3 years ago which they just took away with a few days notice. they give me 10 days to respond back to the letter The letter goes on to say this :- We are not required to write to you again to make further offers of repayment or offer further discounts on the amount you owe. If we do not hear from You the next correspondance will relate to any further action which we have decided is the most appropriate to recover this debt. It may therefore be from the Court or one of our agents who will arrange to call on you at your home address to discuss your reasons for non payment face to face and assess your means to repay what you owe. Any suggestions about what I can do? Blakey
  6. Hi All, I got an email this morning from Itunes saying I'd bought a load of apps/music from the Itunes store which has been charged to my card. All very nice...had it been me! trying to find a phone number for itunes support proved impossible, but I did find an email address for them and I emailed them with the situation and they apparently reply back within 24 hours (no sense of urgency) I phoned up the Halifax who told me I've got 4 different charges pending from Itunes - totalling around £110 - its all charged in $. They told me that there is nothing they can do until the transactions actually go over my account....then I have to call them up and report it again as fruadulent transactions They have cancelled my card for me and will send out a new one and the lady on the phone said something about a fraud form to fill in? What happens with this form and how long does it all take - including getting a new card? - oh and whats the chances of getting my money back I tried to get into Itunes to change my details but as I've not used it for so long its not even installed on this computer I've been using since Christmas! I had to install Itunes and found it all in japanese/chinese style writing my card details are there but whoever has got into my accont has changed the postcode and phone number and part of my address - So how did the Halifax allow my card to be used when half my details just dont match... so much for Apple looking after peoples details securely.... I'm still totally miffed as to how anyone would have gotten my details but i'm mainly concerned as to whether I'll get my money back from the Halifax or not... Blakey
  7. Unfortunately, I do have some current dealings with debt collectors. Although for some reason its been remarkably quiet since before Christmas! I've since phoned the few people who may have sent me an item recorded delivery but none of them have. IF it IS a Stat Demand being sent recorded and I don't go and pick it up what is likely to happen? I know that the post office only keep them for a week before returning them! Blakey
  8. Hi all, Might seem a bit odd but I had one of those nice while you were out cards left by the postie this morning for a recorded delivery letter. I am not expecting anything by recorded delivery and now my Mum has got me thinking it might be from a Debt Collector or court. Do they ever send anything out recorded delivery? Blakey
  9. Hi Everyone, I'm writing this on behalf of a friend who placed an order with Sports Direct last week. He ordered an item that was on offer, and it was a buy two and get a free gift offer. The order arrived yesterday and there was the invoice inside that said that the free gift item was not available and the cost of this £0 had been refunded back!! He tells me that had it not been for the free gift he wouldn't have ordered two sets anyway. I dont understand why the free item wasn't listed as being out of stock when he first did the order. Does he have any rights after being misled into taking up an offer that they are unable to fulfil? Any help would be appreciated! Regards, Blakey

All, Back in September I had a special delivery item sent to me which arrived while I was at work and the postman had thoughtfully decided to sign for it himself/herself and put it through my letterbox whilst writing "Signed for you" on the envelope. I wasn't pleased and complained about it and never got a response back. An identical thing happened with a recorded delivery item just before Christmas and again, I phoned in and complained and received back an apology along with a book of 6 stamps. Back in September, with the first incident, the signature of whoever signed for the special delivery item was mysteriously never available until now. (I kept the envelope and therefore still have the item code) When I checked it, Mr. Postperson has signed it with my own name - well more sort of printed it. Its not my signature and anyway I can prove I was at work at the time it was signed for!!! I wouldn't have minded so much had they signed Fred Bloggs or even their own name but I think its completely out of order that they should pretend to be me! Can I take this matter further with the Royal Mail or as I'd already complained about it (before the signature appeared) is there nothing I can do? Blakey06

Hi Everyone, for the past month or so I've been receiving a lot of totally blank voicemail messages - Sometimes 3 a day and it was getting infuriating at its filling up my mailbox so I'm not getting important messages. The calls are often first thing in the morning (around 8am to 9am) and early afternoon around 2pmish. My Caller ID gadget thing from BT has given up the ghost so I wasn't sure of the number so I used the callback option from within the 1571 feature to find out who the heck is calling.... and its Robbers Way! Needless to say I didn't speak to these guys and put the phone down. Are they allowed to leave blank messages like this, and can I do anything about it? Blakey
  12. Hi All, Hope someone can offer some advice as I'm a bit confused! Firstly, I've got a letter from Robbers way solicitors - Horwich Farelly - asking me to call them within 10 days to make payment on an overdue account which is an old capital one account and the usual threats are listed if I don't respond back to them. The Cap one account was defaulted back in May 2006 and is for just over £1500. After getting this I thought it might be a good move to check out my credit file on experian, There I find I have got two CCJ`s... One I know about and has been satisfied the other is for around £250 - dated 3/11/06. I do not recognise this second CCJ at all so I phoned up Northampton Court to see if they could shed some light on it for me They told me its for a Capital one debt and it should be paid to Howard Cohen solicitors! I'm now not sure what to do, I never recieved any court papers or anything from Howard Cohen and I've been living at my address for many years!!! Any suggestions on what to do to try and dispute the CCJ and also help with Horwich Fonzerelly would be greatly appreciated. I was tempted to try and find the phone number of Howard Cohen but thats probably not a good move... HELP! Blakey

Hi everyone again, in the post today from Beneficial Finance / HFC bank is an annual statement for my "loan" its got all the amounts that restons were after on it and says at the bottom of page 1 that new regulations require all lenders to provide customers with an annual statement and they can only show transactions from october 1st 2008 regardless of when the account was opened. On page two is written HFC bank is required to send you this annual loan statement consistant with the legislation under the consumer credit act 2006. For information your account is currently being collected by Restons solicitors limited. The balance quoted on this annual loan statement is the contractual balance of this account. The balance quoted by Restons in their correspondences may contain additional charges and fees payable related to the costs of recovery. The balances you are required to pay to settle and close this account in full is the balance quoted by restons. Should I be worried that Hfc and restons are going to do sonething despite the strike out? Or are these annual loan statements a genuine thing and its just a standard statement sent out? blakey
  14. Update :- Paypal have e-mailed me and as a good will gesture have refunded me the bank fees! Sorted! Just wish there was another way to make overseas payments without costing an arm and a leg...I notice now that paypal charge a 1% fee for gift payments to friends and family as well... oh well. its cheaper than Western Union Blakey
