  1. Nope - it came from the OR without me doing anything to instigate it. I presume because I didn't own property or have any other assets, mine was a relatively simple/straight-forward case. The letter included a questionnaire to check on updated income/expenses and said that the OR would write to all my creditors and ask if they objected to my being discharged early. I guess they all said nope...
  2. Just thought I would share my news. I applied for volutary (individual) bankruptcy in December 2008. The Order was granted on 22 Dec 08. I live outside the UK now and the OR did the initial telephone interview - heard nothing more until I received the questionnaire to complete ahead of an early discharge consideration. Then in late June 2009 my bankruptcy was discharged. So the whole thing took just 6 months - I was beginning to think they'd take the full year. I owed money to 4 creditors and I had/have no assets to my name which I guess makes things simpler to deal with. The relief is great - to know that debt which was crippling me is no long there means I can move forward now!
  3. Hi Tawnyowl I just clued into the tail-end of your thread. I, too, had dreaded facing the inevitable of bankruptcy - the shame, the stigma etc. But I can honestly say what a relief! Why didn't I do it sooner? In my case, after having the petition filed at the High Court (I live outside the UK now), I've only had 2 contacts from the OR - the first being the telephone interview which went surprisingly well. It was not overly formal, didn't probe into everything and wasn't at all judgmental or uncomfortable. Then I heard nothing until a couple of weeks ago (the time lapse between contacts was about 5 months - excruciating!) when the OR wrote asking me to complete an updated questionnaire to allow them to judge whether I am eligible for early discharge. They will be contacting my creditors to ask for any objections. Hopefully they'll be so swamped with other bankrupts and defaulters (who hopefully owe more than I do!) that they will not object. I just now have to wait a few weeks to find out how that went. Hopefully then I will get the early discharge and be free. It truly is like a weight lifting from your shoulders isn't it?
  4. Does anyone know if bankruptcy will impact on being a Registered Nurse? I know some professions do not allow you to continue working once you go bankrupt but from what I see, they are mostly public-office or accounting sorts of positions. Any ideas about nursing?
  5. Yay! I was declared bankrupt in December 2008. Apart from the initial, brief telephone interview, I have heard nothing else from the Official Receiver - until now. They just sent me the IPO Questionnaire which I have filled in and returned. They are considering filing the paperwork to grant me an early discharge, but need to discuss any objections with my creditors. I know this will be different for everybody according to their particular circumstances - but the letter from the OR said the process of seeking objections from creditors can take several weeks. If anybody out there did get an early discharge, how long did it take from receiving the IPO Questionnaire to being granted the discharge? I have just 3 creditors so am hoping it won't take too long. Thanks guys!!
  6. Cheers Gaz. I hope there isn't a face-to-face as I live in Canada now and was told by the IP that anything else the OR needs will be done by phone. Can I ask if your bankruptcy is now discharged?
  7. Hi everyone. I've heard of people who apply for bankruptcy, go through the initial telephone interview with the OR then hear nothing further from the OR. Is that usual? When people have heard further from the OR, how long after the initial telephone interview was that?
  8. Thanks Gizmo - I called the bank and that's exactly what had happened. The money is apparently on its way back to Canada...
  9. yes - my partner is just setting up a sole-name account for future payments to go to. I should explain the money was my partner's money being sent to cover my partner's bill payments.
  10. Can anyone shed any light on this? I live in Canada and recently applied for bankruptcy in England from where I emigrated. I live with my partner who is not bankrupt. We have a joint bank account here in Canada and also one in England. My partner has credit card balances and loans in England which still need to be paid so each month we wire money bank-to-bank from Canada to England to cover those payments. I recently sent another payment which has not arrived in our English bank account. The account has not been frozen to my knowledge. Where has our money gone? Does anyone know if in these circumstances the Official Receiver might have intercepted it and taken it, even though it is to pay my partner's monthly payments? Any advice welcomed!!
  11. Can anyone help me? I petitioned for (individual) bankruptcy in the High Court, which was granted in December 2008. I no longer live in the UK nor own any assets there (or here in Canada), have no savings, no property, have no money owing to me etc etc - I basically have nothing for them to seize and no estate. I understand that the Bankruptcy Order is good for 12 months, but if the OR completes its enquiries sooner and is satisfied with its checks into your estate, the bankruptcy can be discharged early. My questions is this - has anybody who owns nothing of interest to the OR and has no estate ever been discharged early and if so, within how long of the Bankruptcy Order being entered? Thanks everyone! Canuck_bc
  12. Hey everyone! I'm new to the forum and hope you can advise me! I moved to Canada 2 years ago and despite every effort to reduce my UK debt, spiralling interest rates and ever-changing minimum payment requirements from credit cards put paid to that! I'm now applying for bankruptcy back in England under their 'so long as you lived here in the last 3 years' provision. Has anyone else from Canada ever done this? I'm keen to know if the Official Receiver follows up on your accounts etc in Canada as well as England and if so what are the practicalities of it all? My bank account is joint and my partner is not declaring bankruptcy - is it easy to lift any freeze put on the account when it is required to pay all of your living expenses? Also do they take into account your spouse's/partner's earnings when determining what you can afford to pay your creditors? I have so many questions!! I'm using an assistance company called MyVesta UK to represent me to save me having to go back to the UK - anybody had any experience of them? Thanks guys! Hope to get some feedback from you.
