Hi thanks for both your responses.. is there anywhere i can go or check to be sure? i would ideally like to move out before the end of this month but as i havnt given notice i am unsure where i stand.. i dont want the landlord chasing for another months rent, as i wouldnt beable to afford to pay a months rent, a months deposit and a months rent on a house that i am no longer living at!!
  2. the tenancy agreemnet started on 27th nov 2008 (this is the 2nd one the 1st started 11/07)... it has a 6month clause where either myself or landlord can give notice after this time. the notice is dated 15/06/09 and states i must vacate after 27th august. my deposit is in a protected scheme. so now i have notice do i still have to give 1 months notice or can i just leave anytime before 27th aug?
  3. Hi I have an assured shorthold tenancy and i have been given a section 21: notice requiring possession. I have no arrears, i have always paid my rent on time. The reason for possession is because the landlord wants to sell the property. Thanks Michelle
  4. Hi If someone could answer my question i'd really appreciate it.. My landlord has issued me with a notice requiring possession of my home, it is a 2month notice. I am looking for somewhere to move but do i still have to 1months notice? In my tenancy agreement it states landlord has to give 2 months written notice and tenant 1 month notice but as the landlord has given me my notice do i still have to? Also if i go ahead and give my notice but dont find anywhere suitable within that period what happens if i go ahead and remail in the property? Thanks in advance for any help.
  5. hey tomtubby yes my cheque was returned uncashed, probably because i sent with it proof of the fact i am receiving income support. just waiting for the dreaded NTO's to arrive now!
  6. Hey everyone I got a phone call this morning from TAPAS informing me that Ealing had failed to supply them with any evidence and that I had won the case!! I didnt even have to attend. Why didnt they just accept my appeal in the first place? Oh well i won even if it was by default. Thanks for all your advice, its great to have so many people offering free instant advice your all stars! xx
  7. Hmmm not really sure Al i guessed that it must have been on the dot, the others are all time recorded on stil images. But the PCN has the date and time 18:29:00 none of the still images match this time tho!
  8. Opening a dispute is like a console for yourself and the seller to try and come to an agreement, Considering the above facts and his previous feedback it is very unlikely he is going to come to a mutural agreement with you. So to save time i advise you just go ahead with a claim.
  9. I have had similar experiences on ebay before both as a seller and a buyer. Paypal have always favoured with the buyer. Open the dispute and escalate it to claim straight away. You will have to return the item first, be sure to do so via recorded delivery and provide the tracking info to paypal. You will eventually get your money back time depending on whether the seller co-operates or not. Good luck, let us know how you get on.
  10. Hi Just a quick update for you... I went to court for the appeal hearing and the magistrate upheld my stat decs for all cases. So now i believe that the council has to re-issue the NTO's and call off bailiff action. I am waiting for the NTO's, do they have a deadline to issue them?
  11. Ok i have taken all advice on board, i cant thank you all enough. I will attend the hearing tomorrow. My case will be that: It WAS after 18:30 at the time of me parking How do we know if the clock is 100% accurate? Have they compiled with section 2.3.12 of the code of practice for CCTV enforcement? Do you have proof? Fingers crossed!
  12. i just checked my DAB radio time as that is automatically set (from where i dont knw?) lol and that is almost 2mins faster than my phone which is near enough the same as the clock in my car. i have alsways thought the time in my car was a bit ahead, i set it this way to try get places on time. i guess it is just going to be at the discretion of the ajudicator whether he/she thinks this is unfair and agrees that ealing councils clock could have been out. I will let you all knw tomorrow how i got on. thanks for your advice.
  13. On the original PCN there are 2 pics with 2 times, 18:30:13 and 18:29:56 on the rejection of a appeal letter there are also 2 pics 18:29:07 & 18:29:56 so i am presuming the earliest the camera caught me there was the 29:07 still less than a min tho!
