  1. I didn't send a payment as the template i found here stated something along the lines of 'as per your updated t&c's i have not sent payment as you state this is now not required.' However, surprise surprise today i received a letter in response to my chaser letter dated 21st november advising they did not receive my original request, and asking for a fee of £10. So i am guessing this is required and will send promptly. I sent both letters recorded, and cannot find the receipt for the original one, which is typical!! However it looks as though they are listening now so hopefully it won't be needed. Thanks for your response.
  2. Hello I sent Vanquis a SAR from a template on here on19th September 2012 by recorded delivery giving them 40 days to reply.. I hadn't heard anything by 8th November so sent a failure to respond letter threatening court action by recorded delivery on 8th nov asking for a response within 7 days . (Also from a template on here) It is now 21st November and i have not heard a peep out of them. What happens now? Many thanks Hayley
  3. Good afternoon I have a bit of a situation going on with Npower currently. I switched to them for electricity after a sales person coming round and pressuring me into it. My payments were £50 to start off with which was about right for my 1 bedroom flat (I live on my own). However over time the payments were going up and up until i was paying £70 a month. Unfortunately last year i became ill and had to leave my job. There was a period of a few months where i could not afford to pay them anything so i built up a bit of a debt. Then i set up a payment plan with them for £96 a month (£70 usage and £26 to cover the debt) - They insisted that this was the minimum they could accept, even though i showed them proof of my benefits of £204 a month, to cover everything. However i paid it although it was a big struggle and this left me in arrears with my rent shortfall of £170 a month. However a couple of months ago they sent me a letter with my 'new payment schedule'... of £245 A MONTH!!!! i called them up and asked why, they couldnt seem to tell me apart from insist that it was correct and that they couldnt accept any less than that. I told them i was poorly and couldnt possibly pay any more than i already was, but they wouldnt budge. So in the end i switched to Southern electric, who have given me capped payments of £40 a month, based on my usage!! I now have a final bill from npower of over £700, demanding payment within 7 days. I have no idea what to do and where to even start. I now have to prioritise my rent after almost being evicted so i have very little to offer them. What i would like to know is:- 1. I believe this bill is not accurate - i have printed out all my online bills and some say ESTIMATED, what can i do about this? 2. Once i have sorted out an accurate bill, can they take me to court if i make an offer of payment by standing order and if so what is the minimum amount i can offer? Just to sum it up i am not disputing that i owe them something, as i had the debt there before my payment plan, BUT i kept up with my payments, and now that i am with another company, the only thing i should owe them is the remainder of the debt pre payment plan, as i had paid them up until i left them for my usage. So i have no idea where they are getting this figure from!!!! Any idea how i can proceed? I am finding this very difficult as i get very tired because of my health and i just cannot think straight.   4. When i took out my Vanquis card i was in full time employment and i do vaguely remember the advisor talking about the repayment option plan so i don't really have an issue with this. What i have an issue with is in July last year i was diagnosed with a chronic illness and as such had to leave my job. Since then i have been on benefits. When i became unemployed, i wrote to vanquis outlining my situation and asking to go on a repayment plan to which they agreed to at around £7 a month. However, i have been paying this regularly by standing order, but i am shocked to log into my online account to find the balance has increased from around £300 to around £400?? They have been regularly adding charges on to my account, even though i have been on a payment plan! surely this is what the 'repayment option plan' is designed for, to stop them doing this when you become unemployed due to a disability?? They are fully aware of my situation and i sent evidence etc. What can i do about this? I have sent a subject access request to them and i plan to reclaim the unfair charges on grounds of hardship and the fact i am on a repayment plan! I wanted to know whether i can claim back any repayment option plan fees because quite simply it has not done what i paid for in the first place. Any advice greatly appreciated Hayley
  5. Also i have their 'repayment option plan' on my account which is showing on my online statements... is this not designed to freeze interest when you are in financial difficulty??

Hello Well to cut a long story short i took out a Vanquis card around 18 months ago whilst i was in full time employment, to build up my credit history as i was 23 and hadn't previously had any history. Unfortunately last year i was diagnosed with a chronic illness and had to leave my job, since then i have had to live on ESA benefits for my poor health. I advised Vanquis of this straight away and last year i set up a payment plan with them. However even though i am paying this every 2 weeks by standing order they are still adding charges and interest on top, and constantly calling me several times a day even though i have told them not to. I don't see the point in paying it any more as with every little bit i pay, charges and interest are being added on and i am being put into even more debt so it is not making a difference. I have sent them proof of illness and my income, and yet they are still making the situation even worse. Finding this all very stressful and i don't need it when i'm poorly, i have been paying all i can with the repayment plan and can't do any more. My questions are; - Are they allowed to do this and if not how can i get the charges removed/reclaimed? - Where can i go for advice, and what would you do in this situation? Many thanks your help is much appreciated.

Thanks for your reply sillygirl1 i will definitely use one of these options then asmilecostsnothing - The charges are for 'rolling it over' but they happily ignored my emails/letters from back in december and just kept adding the roll over charge and interest on. They are leeches and happy to ignore you but as soon as you are late paying it's 3/4 calls a day and numerous texts. I think it's because i mentined i a 'leaving the country in april' - only to visit loved ones but they don't know that!!!!!!!!!! Why aren't cheques a good idea? I'll go down the standing order or tranfer route.

Hello, To cut a long story short i was forced to leave my job on medical grounds last year, at which time i had an o/s loan of £250 with payday express which i had been rollling over for months paying £50 a time. In November i emailed advising of my situation and asked them to consider a repayment plan. I received a message advising they needed proof of illness, benefits, bank statements etc. I sent these but my countless emails got ignored, plus my letter sent by recorded delivery. I just kept getting the same automated message asking for the info again, so was going round in circles. In December they went and swiped £50 out of my bank account, which is a weeks worth of benefit for me - so they left me with nothing to live on despite being fully aware of my situation and state of health. I emailed them to complain and advised that i now consider the £50 to be part payment of the balance of £250 to bring it down to £200 as they were WELL AWARE of my situation but chose to ignore me. I then cancelled my debit card with the bank so they didn't have the opportunity to do this again. I have emailed them twice more, the last email saying i can offer £10 monthly to the balance of £200, this is my final offer and if they do not want to accept then feel free to talke me to court. I am sure any court would see £10 is excessive in my situation. They have finally emailed me today with this: ___________We would like to inform you that we are willing to accept your proposal for a repayment plan arrangement for the amount of £10 per month. This would confirm that you will be making monthly payments of £10 per month to clear your loan of £315. It would be greatly appreciated if you could inform us of the date each month that you would like to make your payments, as well as the payment method in order for us to set this up for you. Once we have confirmed this information we will send you confirmation of your repayment plan. We will stop any further action on your account until 06.03.2012 to allow you the opportunity to reply to this email.______________________________ So finally after 2 months they have responded.. but i am not happy with paying the £315.. as by ignoring me they have simply added charges on. the last thing i want is for more charges to be added but would just like to know where i stand on this and whats the best way to go about it. My options are: 1. Pay £10 monthly until i have paid £200 then send a letter advising i now consider the debt to be settled and to take me to court if they are unhappy with this where i will provide evidence of having contacted them etc, and expose their unfair practices and high APR'S. 2. Advise them now that this is my intention and then risk going roung in circles again and more charges being added. 3. Send a recorded delivery letter with a cheque for the first payment, outlining my above proposal and advising if they cash the cheque they are bound by the terms of the letter (is this legally binding??) and then if i get any further harassment after i've paid the £200 i'll be contacting a solicitor. Am i within my rights to dispute the amount? Any advice would be greatly appreciated, i have a long term illness and this is really not doing me any favours chasing after them all the time. Hayley x
