  1. My daughter got an almost exact text. See here; THE EQUITA REMOVAL UNIT HAS BEEN BOOKED TO REMOVE YOUR GOODS TODAY AT 1PM. STAY HOME OR TO PREVENT ACTION CALL ME ASAP. MR **** She had to leave work too but was to afraid to go home. (She is paying a council tax shortfall of circa £300 at £80 per month by agreement. There have been no court proceedings as they have not been necessary. I called on her behalf and of course there was no reply and "Mr ****" message service was full. I called Equita who had been given the necessary permission to discuss matters with me and initially they refused point blank to talk to me but after two days of calling I got someone who would. This someone then refused to tell me who held any licences to operate as a debt collector nor would this person go through screen notes with me let alone post them to me in hard copy. They are bullies, nothing more and I have advised my daughter, who has just had her work hours cut from 29 pw to just 16hrs, to notify Equita that the changes to her income mean that all she can afford now is £1 per month.
  2. Two things. First, Lambeth yesterday could not even find the reg number but thats Lambeth! Secondly and more importantly, praise when due. I was contacted by someone senior at Phoenix who had investigated the matter. He was aware of the paucity of information received by me and apologised for his agents behaviour and is aware of just how slapdash Lambeth can be. This chap and I managed to reach an understanding and I was given assurances which I honestly believe will be kept to. Once senior management at Phoenix became aware they acted swiftly and decisively and nothing more could be asked of them so there you have it, there are decent people in the industry. Many thanks to all for the advice.

As for my being a little forthright, I was in hospital, (my planned shoulder replacement was cancelled because of the stress brought on by this, raising my blood pressure to 200 over 120), when these conversations took place and I had already been told by this man "you bleeding WILL pay and I'll be round your house to collect" so although I was defensive with him at no time was I abusive, insulting or threatening like he was. Remember too, there was no indication on his sheet of paper as to what this £513 was due for other than "Lambeth and court costs" and I'd not been aware of any court case.
  4. My point exactly. The price is set so how can this man say that "NOW Im going to earn a lot more money from you" ? Recording sent. A policeman neighbour tells me that if I had a record of both calls then added together they amount to demanding money with menaces, unfortunately I have only the second.
  5. The man wasnt "rude". He was threatening and abusive. He made himself very clear and his tone was menacing. This is especially worrying for someone like myself who is very much limited by disability and relies on carers. As for paperwork, I got one letter and telephoned a number in Worthing of all places and explained things to the lady there. That was all I heard of it until this thug showed up telephoning and telling me he was going to make a "lot of money" out of me. Surely, nobody can be expected to be an "earner" for a private individual. I have tried to find your email address to send the recording but am unable to. Can you give it me here?
  6. Been in contact with phoenix today. They asked for recording of abuse and it has been sent and received. I have no problem with the fine once the various cases are heard regarding entrapment by Lambeth council, (Clapham Park Rd buslane cashcow), but the threatening, abusive words used are a no no. Do these "enforcers" answer to any licencing body?
  7. Yes, certainly will and further, I didnt mention its the notorious "trap" bus lane at Clapham Park Road.
  8. I had a 5 year battle and won a 6 figure sum and without a solicitor in sight. I contacted NHSLA directly and they were actually helpful. The trick is to keep it simple. Get your own report done. Ignore talk of it costing 1,000's it shouldnt be more than 3 or 4 hundred. Get a list of approved experts from NHSLA and go directly to the expert yourself with your story and med records, submit the report to NHSLA and they are obliged to counter it by getting one done themselves. It's plain sailing after that and the 3 year rule shouldnt apply or count if NHSLA are aware of your claim.
  9. August of last year. There was paperwork through the door which lists allsorts of costs including "exceptional costs agreed by court". I have no knowledge of any court case.
  10. I have a Lambeth PCN which I replied to saying I was unsure of dates as I'd sold the car. I heard nothing for six months then today got a note pushed through my door from Phoenix demanding £500 + !!! On calling the number provided I was told to "listen, you little prick", (I have it recorded), but chose to end the call instead of listening. Am I obliged to deal with these people?
  11. Ive just had a demand from Phoenix. Ive also just been called a "little prick" by their caller. (I have it recorded) My PCN was from Lambeth council, I didnt dispute it but asked for time to pay but heard nothing until today. Now they can whistle for it.   12. My point exactly! Once registered a boat is given a "carving" or number plate. The number plate for the paperwork boat is now on the physical, actual boat.
  13. Thanks. Their trade body has the broker himself as a senior member and committee member! Ive had a letter from their solicitors and sent back a chapter and verse reply of nothing but solid facts. He didnt like that. He responded to me within hours without any "Dear Mr H" or "Yours etc" and it doesnt seem kosher for a solicitor to send angry emails rather than spend days formulating a letter. He certainly didnt have time to check the factual info I sent him, it took me 5 weeks to get it from 4 different agencies, MCgA, HMRC, Catalina Yachts USA etc so I think his cage is rattling.
  14. Ive traced both boats back to the day they rolled off the production line, 10 months apart. The previous ownets refuse to answer any of the five attempts ive made to contact them,( a married couple), and the broker refuses to pass on messages. Further, today i found that the broker contacted the surveyor hired by and paid £450 for a survey by myself, and asked him for a doctored copy of the survey. I also found out that the surveyor sent him a copy! I think that as i was the surveyors client that he should act only on my instructions but im unsure. There was no contract as such, just a statement saying "I am (surveyor name) and i have been instructed to survey (yacht name)by (my name). Has the surveyor broken rules too?
  15. I can say this. There was a yacht with a HIN ending in C090, (for HIN read the car equivalent, VIN), which had run aground and was significantly damaged however it had documents verifying that import, VAT and other duties were paid. It also had more than the minimum 5 years continuous history papers, necessary if the yacht is to be mortgaged or used as collateral for large loans etc. The actual physical yacht has a HIN ending in A191. There is no paper record of this yacht available other than on the survey I had done. Im not allowed to make assumptions of course but it has an odour about it! Further, HIN ending C090 was imported into this country in June 1990 from USA. HIN ending in A191 didnt roll off the production line in California until January 1991 and there 60 boats built in the intervening 11 months or so.
