  1. Well I dispute it, but if they do send me invoices proving I owe it, would I then be able to counter claim that the company didn't send me them when I originally asked. Therefore I will only pay the invoiced amount and not the additional expenses?
  2. Thanks for the reply. I was a sole trader not a ltd company, I just sold the business and the new buyer did not take on any debts. On the Acknowledgement of Service form which should I just tick; 1, I intend to defend all of this claim 2, I intend to defend part of this claim 3, I intend to contest jurisdiction. I would think 1 or 3. Should I send a copy of the letter I send to the company to the court as well?

I have today received a CCC for a business debt of around £300 + legal expenses, interest etc. I sold my business around a year ago and received a letter a couple of months ago from the claiment, a supplier, about an outstanding invoice . I could find no record of the delivery so sent them a letter asking for details including copies of the invoice and delivery slips. I received no response and completly forgot about it till this mornings letter arrived. I am not sure what to do. Should I write to the court disputing the claim or write to the firm asking again for the information this time send it by recorded delivery? Thanks.
  4. FANTASY CHARGES, I didn't realise mbna, A&L and abbey were all linked. I have various amounts of debt with each of these, probably more than £10,000. I sent them all a letter a little while ago explaining I was having financial difficulty. I also have an egg.com bebt, are these linked to the other companies? I really need to spend some time sorting these debts out. I have had business problems which is why I have these bad debts. They have all happened in the last couple of years trying to keep the business afloat. Never suffered from bad debt before and find it quite embarrassing to be honest. I have got to claim back about £7000 worth of charges from 2 business and 1 personal account also. Need to get me head out of the sand and tackle this. Thanks for the replies.
  5. Thanks for the advice, I will make sure it is a full and final agreement. Although I believe it is just a carrot so I make contact with them, we shall see. hellhasnofury, luckily for me they don't have my phone number. Follow sequenci advice, no one should be harrassed like you are, good luck.
  6. Hi Jeff, I am amazed sometimes by these companies. You would have thought they would have been glad to get the payments, even if it was over a slightly longer time. I have only defaulted for about 3 months and don't think any penalty charges have been added. I may give them a call to listen to their suggestions. Am I correct that I should ask for the debt to be marked as paid in full or some wording of sorts. Thanks

We may also be willing to give you three months to pay this amount, subject to the following payment dates and amounts. £***.** by £***.** by £***.*** by all different amounts If any payment is not received by the due date blah, blah, blah!   8. I have just recieved a letter from mbna to pay off a debt I have with them. It is rather ambigious, all could's and if's. The debt is for just over £1500 and they say I could pay just over £600 as a one off payment or in 3 installments. This sounds to good to be true as I have not had any contact with them to negotiate these terms. I think I may have sent them a letter a little while ago stating I was in financial trouble. They say they will default otherwise and it will be sold to a third party. Anyone had any dealings like this, do you think I should take up the offer or is it just a [problem] to get me to contact them. Thanks
  9. Hi, I have two business accounts with the A&L one of them for about 5 years and the second one (now closed) for about two years. I have added all the charges for the live account, I have to keep my statements for 6 years so do not have to request the amount. It comes to just over £4000 I have an agreed overdraft on this account of £3500 that is always used to the maximum and sometimes over and that is where all the charges are being added. The second account had charges levied on it for failed DD etc. I have not added the total yet as the statements are filed away. The problem that I am concerned about and why I haven't tried to claim the money back is the A&L will no doubt close my account if I am successful. While it might be relatively easy to open a personnel account, that is not the case with a business account. Has anyone had any experience with claiming of a business account? Or if anyone has some advice it would be much appreciated
