  1. is was done by her on-line with internet banking when she was living with us
  2. Hi all help over fraud with TSB and other stuff Got a problem and here goes (maybe some can give me some good advice) All started about 6months ago, what happened was we had my mother in-law live with us, as she had just left her partner. Well after a few months we found out she was lying to me and my wife, and had stole money form us (only £40 from house) And had been planning to get back to her ex partner. So she had just used us for all that time, (many other things happened) so in the end my wife kicked her out of home. Only problem is she is mad (does have mental problems) and is now making all sorts of story's up, and lying to even more to people including the police now In the end she has tried to have me and my wife arrested for theft by telling the police that the furniture she had stored in the garage when she left her partner while living with us, yet she was saying we had took and these items she had no knowledge, lol good news is the police say we have nothing to worry about, as this is a civil matter, and they know they have lied, due to having different statements, and she has already lied on one statement. then she said to the police that I assaulted her partner, as he came to my home to attacked me, and I used reasonable force to stop him. police say i have nothing to answer to, as i used reasonable force, and she has already made 2 different statements, which shows she has been lying. so thats good news, as they have busted her. Also her partners statement is different to her statement. and the next thing is she paid us back money only about £3000 with bank transfer through TSB as we both bank with TSB. the money was for rent since she lived with us (5 months worth) money we had lent her (cash) and for items i had brought for her with my credit card, as she did not have one, and did not like using the internet to buy items. after she had paid this, she then set up a standing order to pay us £100 a week rent and for food, this was for only a month. but now she has told the police that she had no knolwge, and I did this all, and she did not pay us ,and did not set up the mandate,so she is claiming its fraud. the police have told her to report to bank, and let them interstage only question is , what will happen ? what can i do ? can people make these lies up and would banks believe her ? what steps should i take ? as i can not prove that i lent her money, etc etc but the money was paid to us some 6 weeks before we kicked her out, and the mandate of £100 was in force 5 weeks before we kicked her out. she has only done this to try and cause us upset what can the police do about her lying on statements ? and what can i do about the stress over the lies ? also can the bank freeze my account , and take the money out ? any help would be great thx

  12. don't want to try and get any money back, just want to try and get out of the debt- well do my best to so will this letter be ok for a 1st thing ? I do not acknowledge any debt to your company. I require you to supply the following documentation before I will communicate further on this matter. Dear Re: − Account/Reference Number - 1. You must supply me with a true and signed copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for rolling sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 Postal order (Reference ) in payment of the statutory fee. 2. If this debt has been sold (e.g. to a debt collection agency), please supply me with a signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. 4. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. 5. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. 6. Furthermore you are reminded that under s78 sub section (6) whilst the default continues you are not entitled to enforce the agreement in law. 7. We understand a copy of our credit agreement should be supplied within 12 working days. We look forward to hearing from you. Yours faithfully
