  1. A week ago, walked into a branch of N'wide to cancel this direct debit I vaguely remember setting up in September with a college; at the enquiry desk they could not find a trace of it. Similarly it wasn't listed in internet banking.Today it was paid out; £313. I telephoned; they said it was a temporary direct debit, whatever that is, and was irreversible. How could the d.d. have been paid out if it wasn't on the system, and is the branch likely to reinburse the amount as a goodwill gesture, even though I can't prove I walked in there and spoke to the enquiry desk receptionist?

Many must be the familiar with the scenario of; you speak to the SLC, hang up thinking everything has been settled and forgetting it, and then the next day you receive a call from them again just reading off the screen as if the previous conversation had never taken place. You calmly try and tell them about the conversation, they say there's no record of it on the system, and you're back to square one. Meanwhile you get a letter asking for three months arrears or something. Anyway I sent them the deferment forms in time, have a tracking number to prove it which I gave them. I am still getting phonecalls asking for arrears, denying all knowledge of the tracking number even though a week ago someone said they had been received in their other office and would chase it up. All down to poor communication between departments. Do I have a case for harassment and subsequently getting the debt written off?
  4. Thanks, it is a PCN. I am completely unfamiliar with the county court process; can you tell me if the county court enforcement would include payment by instalment if requested; or if you do wish to pay by this method should you just not attend the county court hearing and wait for a letter from a debt collecting agency appointed by the court?

If you cannot pay a parking ticket and offer them a reduced monthly payment, telling them you are dealing with payplan or the CCCS would your Council accept a reduced monthly payment, as a debt collecting agency would? I am trying to find out whether a Council would first issue a court notice for an unpaid ticket or pass it onto a debt collector.
  6. As long as you have proof agreed payments have been made, their lies can be amusing, such as having useless conversations on the phone with them when you're bored. However, the real point is whether or not they can issue CCJ's based on their misinformation...although, you can prove payment in court and make them look silly some might need to avoid a CCJ altogether more than others, like those who don't want all present or previous addresses to have to be declared in court.

After months of non harrassment from debt collection agencies I have recently experienced what seems to be a change of tactics; denying previous repayment agreements, denying receiving proof of wages/benefits, and income & expenditure forms through the post. Even if you sent recorded delivery. The big thing is they can record calls, and their staff types a synopsis of what was said after a phone call but you, the debtor, doesn't record the call and whatever you say was agreed in that call is just hearsay to them later, as you can't prove it. A repayment plan was set up between myself and Sainsburys Bank, and later they denied all knowledge and refered me to a debt collector. I cannot prove the repayment agreemenet was made and do not know whether this is a tactic or a genuine mistake on their part. Also Marlin Financial Services of W Sussex who collect for HSBC are claiming they have not received any repayments, even though my bank statements say they have. They are denying receipt of bank statements sent and proof of wages, despite previously saying they had received them, They are saying they asked me for proof of wages again last week, when they didn't. I can prove the payments were made but can't prove I sent the other details. There does seem to be a lack of communication between departments with them, and if something has genuinely got lost and they are not just denying recieving it, it means you have to take the trouble to send it again unsure of whether they are going to admit recieving it. They have now said they have passed me onto a field agent, who I can show the proof to at the door.
  9. Has anyone received notice from NCO that they will be calling at your home? A Mr P Edwards will be calling tomorrow between 9am and 9pm at my previous address, which they believe I am still at. They have previously rejected my prepayment offer of £1 per month for an unpaid 1 month of a Student Loan due to my posting the deferement form late.
