  1. Hi I've previously posted about our situation but it has just got a lot worse. My Husband has been on sick leave for over a year with work related depression. He has been paid full for 6 months (policy is 6 months full, 6 months half pay and then 6 months ssp) at the 6 month point he and his line manager filled the forms in for unum salary protection. He was told that this had kicked in and was still recieving full pay. In december he only recieved half pay and when checking with the company they told us that he had been paid in error and that he had used up all his 6 months half pay and ssp and that the salary protection hadnt actually been set up. The company did send a letter (at the end of december after the half wages had been paid) but to our old address. my husband has updated the address countless time but they are still payslip and correspondance to the old address. The company are currently trying to sort out the salary protection but in the mean time we have not been paid a penny, we've not had the form from them either to set up any esa (not even sure if we could claim that). In the interim we have asked the company to pay him his full holiday allocation and they were trying to sort out a bacs payment of this amount so we at least had some money. Today we have been told that they cannot pay him holiday in a lump sum and can only pay him this money if they sign him back to work but he remains off for the full total of holidays - equivalent to about 7 weeks and they would then pay him as normal next pay day (end of feb) once the holiday had been paid then he could be signed back on sick leave!! This would then class as two seperate occasions of sick leave and would then probably invoke further disiplinary action (currently on a stage 1 due to length of time off) is this even legal?? can we demand that they pay this owed money in a lump sum? we are completely at our wits end now and really dont know what to do. we only have my income which does not cover bills and living costs and a small child to feed. the company dont seem to care! i'm not sure how much more stress we can cope with please help!   2. Thanks you for the replies. We have never been told to submit the sick notes to DWP at all, will look into this ASAP. We are going to try and get an appointment at the citezins advice today and work out where we go from there. The whole situation is putting a huge strain on us both, we are vey committed to sticking together through this but it is not easy I've just remembered another thing he was put on a stage one disciplinary in oct due to the length of time he had been off. He was told he could appeal this descicion and a letter would be issued in 7 days. That was oct 2011 and we are still waiting now. He was going to appeal due to the fact they they have done nothing to help him return to work and he has said all along that if he is put into a different dept he would return immediately. He has reiterated this many time both to his line manager and to Hr. The most annoying this is that no one seems to want to take ownership and do something to get sorted During his whole time off the company he works for has been through numerous changes and he has been passed from one line manager to another and it's only been in recent months that the current one he has has actually been moderately helpful in the fact of contacting him and arranging well being chats, but even he does not seem to be moving things forward as we would like. What is really disappointing is that he has been a committed employee for ten years with a very good work record behind him but this does not seem to be taken into consideration at all. Currently we are waiting for Unum to agree to pay salary protection but we have no clues as to which way this will go. We are also trying to get them to pay his holidays that have been owed for the last year but when speaking to payroll they have somehow missed the cut off for pay day. We have suggested an emergency bacs payment but still they say they are looking into doing this. I will check into the legal cover thing I may be covered under my own epmployee's package or my home ins. He is not a member of any union as they company themselves will not recognise a union.   3. Hello, hope you can give me some advice My husband has been off sick for just over a year with stress and depression due to the job role he has been doing. He has been with the company for over ten years and was moved into a sales dept when the role he had been doing had been closed so it was either move into this sales role or lose his job. Fast forward this time last year, my husband could not take any more of the pressure for not hitting targets(he's in no way a salesman, never has been, more focused on customer care) end up at the doctors (after much persuasion from me) and signed off work. He is still off now. He has said all along that he is happy to return to work but not to that dept. his doctor agrees, he has spoken to occ health, they agree and he has seen the companies own doctor who also agrees that at present he is unfit to return to work unless he is moved department. The company's stance on this is that while he is off sick he applies for other roles with in the company and await the outcome of these applications as they don't move staff around departments. (we know for a fact this is not the case) He has been on full pay for a year, 6 months was his companies pay policy and the other 6 months were what we thought were income Protection payments, the paper work had been sent off and as far we were told it had all been sorted out. He got paid at Xmas time and he only rec'd half pay. It turns out that the company had not sent the paperwork to the insurers and he had been paid incorrectly for the last 6 months!!! They have now submitted the paperwork to the insurers but we have no clue if he is going to get paid anything at the moment, no body can tell us this, they are also saying that he might have to pay back the last 6 months pay. Can they make him pay this back as it was their error? We are experiencing severe financial difficulties at present. He was also not told that he would only receive half pay, we only found out when we went the bank Also there have been numerous other problems such as not sending payslips to his current address (we moved home while he as off) changing his contractual hours and pay with out informing him (this has been rectified and the monies owed paid back) throwing his personal belongings that we're in his work locker away, not giving him any support, he has to chase everything up ever step of the way. I suppose at the end of all this i am asking can they make him apply for different roles, rather than just place him into a different role and can they make him pay any money incorrectly paid to him. We have had such a nightmare with the company, that my husband feels that he has no option but to apply for jobs outside of the company as he has no support. Sorry if this has been a bit of a ramble but there has been that many problems from his work in the last 12 months that we are all over the place with things now Many thanks in advance for any advice given
  4. oh ok, My brother is a bit dodgy sometimes in that he'll tell you anything to get you to do what he wants. I wonder if there is anyway of finding out? Just dont want to be stuck with a bill for his telly and playstation when we have our own family to provide for.
  5. My dad and my fiance are references for this, we were told by him and brighthouse that thier details were just for a character reference as such. Is this the case or are they garentors (sp) and would be liable for payments?
  6. Hi My brother has a few items from brighthouse and has missed a couple of payments. He had enough cash yesterday to pay but because the money was not in the bank (he had cash)nhe couldn't pay so asked my mum to pay on her debit card and gave her the cash. I was a bit dubiuos about this as was worried if he doesn't meet the payments again would my mum's debit card be used for future payments? Does anyone know if they keep payment details on file?   8. i can confirm that capita are a shambles, i used to work for them and no-one knew there ar*e from there elbow!i didn't work onTVL but i got offered a job as an enforcement officer when i was made redundant- rubbish pay for a rubbish job and a lot of it was commission so i guess the more you bullied people the more commision you got. Turned them doen flat!
  9. Hi I got a Tommee Tippee electric steam steriliser for my baby 10 months ago and last night the heating element would not heat up and therefore not sterlise the bottles. I would take it back to the store but i no longer have the reciept/packaging. i have contacted tommee tippee and i am awaiting a reply but was just wondering if anyone had any advise in case they come back and wont due anything. you need to sterilise until baby is 12 months old so i would have thought that this would have lasted more than 10 months.   10. Thanks vortex i'll advise him. he has spoken to his econ rep (internal advice thinggymambobb) but as it it she who sets out the bonuses she wasn't very impartial. Apparently the company he works for does not recognise the unions. Whether this is right or not who knows the company seems to set there on rules then change there mind.
  11. Hi there my other half has worked for a telecommunications company for nearly 8 years now. The department he was working in has moved to India and therefore his job role was ended and he was put into another department where he now has the opportunity to earn bonuses. He was told in his training that he would be put on bonus straight away as the norm for new starters is to cap the bonuses for three months but because it was a forced move they would be put on bonus. He has been given the monthly stats sheet for the team which everyone gets and his bonus stands at £597 for his first month on the team. which he would be paid. A few of the other members of the team (who have not made bonus this month as per stats) have started to complain to the manager and team leader that it's not fair that he has gone straight on bonus as they had to work there 3 months before getting full bonus. His supervisor called him last week while he was off as he had a days hol to inform him that the line manager had now decided that he would have to work his three months first before getting full bonus and he would only get a nominal amount (£100) and that maybe he would be re-imbursed for the bonuses earnt but couldn't confirm. no-one seems to know whether he would be getting the other 500 and also this month he has earnt £150 bonus in his first week of this month. The oppposite rotation were told that they wouldn't get bonuses but also weren't put on the stats sheet for bonus payments. As my other half has the stat sheet which shows his bonus amount and the fact that he has been told from day one he would get this does the company have any right to withhold this money,and if they do do they have to pay him the full amount after the probationary period? Wouldn't mind so much if it was just a few pounds but it's quite a lot and has the potential to be heading into the thousand+ mark after the three months. Any help/advice appreciated and sorry for rambling!! Michelle
