  2. I didn’t think I’d need to as it’s a generic question re the court hierarchy and using same level county court judgement summaries in the county court? I’m not looking for advice at this stage I’m just getting my ducks in a row.
  3. I’m starting to collate a witness statement for a parking charge hearing and just need some clarification on the bundle documents. With the references to case law, do I need to include the whole judgement summary or just a copy of the relevant section contained within it. I understand the courts hierarchy so it’s reference other county court examples of strike outs by a district judge? Thank you.

Hi quick follow up I’ve placed the defence and completed the DQs and wondered if anyone had any case law or specific quotes for the consideration period and the grace period that allows the 15 mins combined. We've not got a hearing date yet but I’m just getting all my ducks in a row. I’ve got the BPA code of practice and the .gov Parking Code of Practice, which nicely shows a matrix of suitable times, along a nice local news article related to the difficulty parking in that car park where it took the journalist 20 mins to park and another 20 mins to get out? I’m okay with the court protocol just needing additional reference points around the initial consideration and Grace periods before I move onto contract between parties , signage ( which looks compliant) and other aspects. I don’t for one minute think this will get to a hearing but just trying to get as much prep done now to save my time as this is for a friend and I’ve got a long vacation planned later this year and Sods Law says that’s when it’ll come in… Thanks..
  5. Thanks for the replies. Interestingly when I looking at the car park notices and their positions etc I did see a very large private lorry loading some goods and also parked in such away as to block about 4 cars from getting out their places, I can’t get the defence down to three lines…is there a link for this please?

  7. Thanks for the fast response. I looked at the sticky but he’s not kept any of the notices and just ignored them until now when he’s received the Northampton claim. I will complete what I know and upload anonymous claim form will that be sufficient? .
  8. Hi, I haven’t used this forum for ages but it helped me loads in the past. Im now helping an elderly friend who’s ignored a parking charge notice and now has a CC online claim against him from U.K. Parking Control Ltd. Regardless of rights and wrongs he was 13 minutes over the limit. At the time he was infirm waiting to go into hospital for an operation and various friends and neighbours, used his car to do his shopping. He’s unable to confirm if he was driving. I understand they will need to prove he was driving and if so he was aware of the contractual terms, so I get the points regarding the defence but as I haven’t done anything like this for years I would appreciate a little help in positioning a holding defence and also the time lines involved. The issue date is 13th May, I believe service is 5 days so that’s 18th . Acknowledgment is 1st June and defence by 14th June ( I’m just checking I’ve got these right, anyway we’ve filed acknowledgement so here we go. I’ve looked to see if there are defence templates but can’t see anything appropriate so any help would be welcome. Thank you
  9. Sorry, I'm not being evasive. It's an old MBNA CC debt that's now owned by Cabot, I have a copy of the original agreement which I obtained from MBNA about 10 years ago and there are no prescribed terms so it can't be enforced by the court. I entered into an agreement to make payments and have made these for the last 6/7 years every month with out fail and ignore any correspondence from them to review, This letter is a little different because it gave me 14 days to call them or they would instruct a solicitor ( in-house paralegal I expect) to pursue the debt. My question was to see if these letters lead anywhere or just fizzle out as most do. I am aware that once you reply or answer a call then it triggers you to the top of their " pester" list, however, if they push this across to their legal dept i may need help to compose a suitable letter. Hi Andy Thanks, I'm not too fussed about the claim as I've dealt with them before, albeit a few years ago and it was just a feeler to see if these letters get followed up so i could prepare myself. I had the letter a couple of weeks ago and they put a 14 day deadline on it. The debts under £2k so I feel it may be just blustering to get me to call and agree a higher monthly payment. The irony is I'm not really much better off than when we agreed it 6/7 years ago, so I could call them and go through the rigmaroll of the income and expenditure, its just that i dont see why I should.   12. Hi I haven't been here for a while and therefore a little out of touch with current practice. Thanks to the help of CAG I managed to win my battles with DCAs quite a few years ago. I have an old credit card debt which is off my credit file and owned by Cabot and for 6/7 years have paid them a nominal amount each month. They send the odd letter asking me to up the payment but I never respond as these are computer generated and I prefer to let sleeping dogs lay. Just had one threatening potential legal action if I don't contact them. I just wondered if they every follow through or if this is best ignored. They don't stand a cat in hells chance of a CCJ as its an old CCA agreement without prescribed terms, however, I do acknowledged the debt and I am making payments. Just interested to know if anyone's had one these and whether they do follow up? Thanks B.
  13. Hey that's interesting is that a fact. If the debt is off the credit file it can be put back on?
  14. Sorry my assumption is they can report to CRAs using the same default date. I edited the post above before I saw your reply ....the statute bared will be later because I made payments after default. If debt is not on your files now it can't be put back.
