  1. Hi there, How many of you check your online files and find there are countless unrecorded entrys relating to searches made by you or the likes of Checkmyfile. At least equifax and callcredit group them by personal and actual credit searches but experian decide to throw them all in the same pot. For example experian can say you have 29 searches on your file. But upon closer inspection you only have say 4 actual credit searches. The rest are made up of identity checks, quotations, car insurance, national lottery Direct Debit checks. basically receipts of searches made for identity checks by companies.. But mainly unrecorded searches, made by yourself for your file. Of course we get told that these searches are not seen by the lenders which i accept. My question to them is, If im the person who inintiated the search and placed a marker on my credit file for access to my own data. I should be in a position to want to remove it? As i was the one who initiated the search myself.. I dont need the CRA to check with a company who made the search to remove it. I made the search myself! Ive sent Equifax a message asking what the score is anyway on a request like this. Should get back to me in a few weeks!! Thoughts please.
  2. Hi there. quite delighted with this result. May have found a particular loophole so thought id tell all on what happened.... Had an account with HSBC earlier last year. then moved to A&L through their switching service. Including a Paypal Bank funding Direct Debit. Hit a problem in December where paypal took payment for an item late and it resulted in me being overdrawn for 17 days for being £1.24 overdrawn. ending in an £85 charge in Jan. This had a knock on effect of then taking me overdrawn again which then charged me £65 in Feb. I was able to top up my account with this charge payback so only left me overdrawn for 4 days. Resulting in an additional £20 in march. This was affecting my credit score to the point where i had a mortgage declined. The only way of securing an appeal with the decision was to see if i could get the charges reversed. So i did some digging. I checked my original paypal direct debit mandate that i received when i set up the account with HSBC. When the account was switched to A&L it was switched to a new reference number. I was never ever notified of the change. Which resulted in the direct debit being invalid. Therefore all payments taken from my account under this direct debit were unlawful. Which also meant, Because of this unlawful direct debit i was taken overdrawn and then charged by A&L. I contacted A&L who at first advised that this wasnt an acceptable excuse for demanding payment back. I kept on at them demanding a refund under the direct debit gaurantee which they then passed me through to a lovely lady in their Direct debits department. She checked back on the original switching papers and confirmed that the switch inadvertantly changed the rererence number. They should have advised of this change but they never did. This then resulted in them admitting it was their fault and so then refunded all the charges they had made on my account due to this invalid DD. So the morale of the story. if you have switched accounts and moved your Direct Debits over with the account creation. Check your mandates and make sure the reference numbers match to what you have on your new account. If not.. you have them. if the particular DD caused you to go overdrawn at any point..claim that money back. Obviously you will owe the refunded DD money to the particular claimant. but the bank charge money is yours to keep. I got approx £185 back this way. A&L are also arranging for my credit file to be amended to show no problems in the months it hit me I first contacted A&L about this Tuedsay 21st April. By friday i had all the money back in my account. Of course i will be depositing the money for Paypal into that account but it was a way round the hold on charges out there.   3. Hi there, Not sure if this is the right forum. If not can mods move to the right one for me. ta. anyhoo... im looking to buy a 3 bed semi new build just off the m57 in merseyside. I got my mortgage promise off Halifax and went ahead with the initial enquires. The deal went like this. im buying under the 75/25% scheme. on a £122k so i only need a mortgage for £93k approx. Big banner stating "£99 and move in!" They pay £500 towards legal fees All carpets, curtains and blinds in with deal. Oven and hob in kitchen. So obviously i went ahead and paid £100 reservation fee. In order to qualify for the 75/25 i have to use their preferred solicitor and mortgage advisor? Few days later i get a letter off the preferred solicitor who wants £150 to start things off. This is for the search fee. they want £700 approx off me. the builder will pay £500 at completion.... I then meet up with the mortgage advisor who wants about £315 off me to send to Halifax for the valuation report. Thing is.... Ive read that all new builds need a HIP which contains all the searches that originally were done by the buyers solicitor. why am i being asked to pay for something that should already be done already? Am i having the wool pulled over my eyes? As the sales rep at the development never mentioned anything about this HIP which they should be providing free. Nor the fact that there are fees payable after i pay my registration fee. I was expecting to pay £99 and then not worry about other fees untill i move in. Whats happening here?
  4. Hi There. Can CML Info on one's Credit file be challenged? I have CML info that is expiring next Feb. The Listing is marked as satisfied. But I have no listing for defaults or anything associated with the listing company Abbey. I have disputed the fact on Equifax but they tell me that Abbey have informed them that i need to contact THEIR solicitor. Surely under the Data Protection Act Abbey as a company need to ensure the data is correct. I shouldnt have to go round chasing their solicitors for a change to the incorrect info. Is there any way i can challenge the company to prove the listing should be there in the same way we can CCA a creditor. If they cant substanciate the info it can be removed from my file.
  5. It is possible i believe. They are only examples that i used. I was particularly looking for Moorcroft Cases involving BT. Thats what im looking into at the moment. The problem being was the search was ignoring the BT aspect. As you can specify the minimum letters searched on in the administration panel of vbulletin. Further to this it doesnt necessarily need exact phrase search right. Moreso search for the same words in a thread. Rather than search for each individual word in the entire forum. Not one for teaching granny to suck eggs of course. I used to run a 3500 member clubbing forum using vbulletin as the backend. So know the pros and cons of forum management. Thanks for the quick reply however!
  6. Hi There. I was wondering if CAG could improve the search facility. I have been on the forums for some time and found that searching for info is pretty tiring. As the results display nothing for what ive searched on. For example if i want to search for a particular phrase used in common Mackenzie Hall reply letters "MOORCROFT BT" ""We have contacted our client for a copy" the current search facility searches on every word in the search and displays the results for each word. Obviously the words with less than 2 letters is ignored. Your search result still doesnt go nowhere near the particular subject one is looking for. So a search facility for all keywords contained within a "example" would be a great help.
  7. If you have CCA'ed them and no reply after 12 working days. Stop paying. Untill they satisfy your CCA Demand.
  8. Yes the info will be marked as default on your credit file for 6 years. Whether its satisfied or not. If you need it clearing off you would need to go down the CCA request route. If not hang on another 12 months.
  9. need to add theres nothing on the credit file relating to any defaults or things through abbey national. only this CML data.
  10. Heres one for you. I currently have reposession info on my credit file. The 6 years is up next Feb 09 I have recently sent Abbey National a letter regarding the incorrect info on the CML data. the debt should be marked satisfied as the debt ended up with a surplus. I managed to get about £5000 myself and the other 5k going to my ex (spit) wife. Its still marked as not satisfied. Obviously im chasing this up. Heres the question. Can i CCA them for the original mortgage agreement. Hopefully if they cant come up with this can i then demand that they remove the CML data on the grounds that they cannot back up their claim. Hope someone can help.
  11. Ive just sent off the standard CCA to these gits. only 3 days left of the 12 and havnet replied. so quite interested in how you are getting on with them. Quite a story actually. had a car through lloyds UDT at my old address. got reposessed years ago. then saw a default on my file at my new address for about £2600. account closed. dated september 2006 nothing has been signed at my new address. So CCA'ed them them to see what they have. I know ive got them by the short a curlys!
