  1. thanks babybear, i sent the letter out, but obviousally they ignored the cca request, what if they ignored the account in dispute letter, and i have not heard anything, today was the day they were supposed to apply for ccj, how do i stand, if court papers appear, even though i have sent them a cca, they signed for it, but ignored it.

I had a letter today from Bryan Carter & Co Solicitors (that is what it was headed) but at the bottom in small print it states Please note that Bryan Carter & Co is the trading name of Crellins Carter Solcitiors of 111 Queens Road, WEybridge Surrey KT13 9UW So is this legitimate or not, as it is a letter Headed Final Notice, no matter that I send them a cca the other week(which they haven't responded to and neither have Fredericksons the signature was the same for both companies signing for my cca request)
  6. the letter goes FINAL NOTICE you have failed to repay this debt, which is seriously overdue COURT PROCEEDINGS WILL BE ISSUED ON 07 MAY 2008 WITHOUT FURTHER NOTICE TO YOU IF PAYMENT IS NOT RECEIVED AT OUR OFFICE BEFORE THE ABOVE MENTIONED DATE. normal blurb of how to make a payment, and in some instances they accept credit card!!!! A judgement order may prevent you from gaining credit in the future and will remain on the Register of Judgement debt for a period of 6 years at the bottom of the letter in the right hand corner in small letters it says pre-sue
  7. after sending the bemused letter on 9th april, i have had several tcalls a day, and ot this today NOTICE OF INTENDED LEGAL ACTION you are hereby given notice that due to non-payment of the above account, we are preparing instructions for solicitors to commene COURT ACTION against you for the above debt, then the normal blurb
  8. well the plot thickens, i only managed to send tha cca off on 19th april, i sent one to frederickson, and to bryan clarke solicitors (different addresses although 1 was a po box) and guess what? same signature!!!! Had a letter today from bryan clarke solicitors threatening legal action on 8th may, will type up the love letter later when i have got the little ones in bed

  11. ok, i want to pay the debt off, but if paying cabot means diddlyswot, then there is no point, I cant afford to be paying 2 dca's, so i think i need to cancel direct debit, and send cca to monument, and just play the game with again with the new cca, the end result is i want to pay it off, but i'm not gonna do this with the "let's play the game dca's" am i, so Im gonna cancel direct debit with cabot, send cca to monument, but i need help with letter to retrieve monies paid to cabot, it must be at least £105 not a lot I know. but looking at it I shouldn't have paid the xxxxxx a penny, oh how intimidation works well, (might try it with the boss!!!)
  12. i seem to think that the set up of the new account (which was only last friday) i was happy to do so (as no hassle at any time was received by cabot with the previous account) has made them look at the other account, is there a letter, or any help with one, cause i do not know where to start with one please!!!!

Hi guys, long time no mail on this thread, I have a confession to make, I had a call from a cabot, a long time back, (back end of last year) , and i cracked on the phone, (basically I think he must be a religious subscriber to this website) he caught me out, when I thought I was prepared to tackle on the phone, I was getting hassle of the hubby becuase of the constant phone calls that were coming, and decided to take the bull by the horns. ANyway I was totally unprepared (fully armed now), for the total full on ness (if that makes senses), asking what I bought etc did I have receipts, and much more, I tried to remember CAG instructions, but spoke about something in the past tense, which made things obvious, anyway, I was caught I do not want to hide from the debt, but I DO want to pay the right people. So as I had made myself knee deep in it, we sorted out an agreement that suited (I know at this point you are all screaming YOU FOOL!!!!!!) but I do want to pay these debts off, so I can carry on with my family life as planned, and this is holding up. becuase of me (my hubby is squeaky clean no loans no credit card etc.. we cannot even get our house insurance to be paid by direct debit now (unless I change providers and wouldn't know where to start looking). anyway I arrange a direct debit each month, but I had already sent them a cca on 7/7/7, the direct debit was set up and everything was running smoothly, I pay each month, I do not get a call, but today in the post I got this. Shoudl I cancel my direct debit? Why the letter now? I have just set up another account with them, (although different address & telephone number) If they are not entitled to receive my money, can I claim it back, and how. HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

  15. oh not to forger the company that calls itself A debt investigation company. who does that come under dca solicitor intimidation bureau (looked this section up in the yellow pages, it doesn't exist)
