  1. Can you not ask them to look again at your claim? I'm not sure what happens with esa as I don't get that. They put me back on income support as i'm unable to work. I suffer with seizures which can't be controlled and they happen at any time without warning so have to have someone with me at all times. Can't even be alone with my kids, yet they still stopped my money last year. Grrrr! I would contact them again and ask them to look at the claim again as you can't work x
  2. Glad to hear you got it sorted! I also have managed to get my backpayment sorted out since I threatened them with my mp! Can't believe how quickly my MP has replied. I got a letter from him yesterday saying he has sent a letter to the district manager of jobcentre plus and they will be in touch shortly. Should be getting my backpayment on Monday! Still in shock that it's taken over a year to sort this out but I plan on complaining and getting something done about this! Glad you're getting it all sorted. My advice to anyone waiting a backpayment. Threaten them with your mp, they will soon move x
  3. Did they give you a 3 hour callback? If so, you have to ring tomorrow and complain cause they didn't call you back. I've had to do that loads of time recently and each time i'm put through to the manager of the call centre who then contacts the manager of the department who was supposed to call you back. Nine times out of ten they'll call you within minutes of that call. Don't give up, keep hassling them. Keep records of all contact you've had to make and just keep complaining. Believe me they will get fed up of it soon enough.
  4. I'm having the same problem. Won the IS tribunal back in September, ever since they've been saying they haven't received the notification. It has now been faxed to them 4 times and posted to them 5 times and yet they still say they haven't got it. Went to my local jobcentre today and asked them to put a copy on my file and also fax it to the relevant department. They did all this whilst I waited and i'm still being told they don't have it. I've now made an official complaint and asked my mp to become involved. The lady on the phone has now told me twice to stop calling them. So I shall keep calling them and calling them until they are so sick of me they actually get off their bums and sort it out!
  5. When I call we go through to the call centre and they usually say someone is going to call us back within three hours. They have only called us back 3 times the rest of the time we have to ring them again. They are really unhelpful. It's not the back payment that i'm interested in. All I want to know is when my claim will be restarted as I really need the money. They treat me like i'm a benefit scrounger and I hate it because i'm not.
  6. Hi all, I had my IS tribunal on the 22nd September. We won the appeal as the judge said the evidence he had from DWP was shoddy to say the least. A representative from the DWP was supposed to attend but didn't turn up. A decision notice was given to me and one sent to the DWP on the day of the appeal. Now nearly a month later IS are still giving me the run around. They keep claiming they haven't got the notice. It's been faxed to them 3 times from the tribunal people in cardiff, they also sent them 2 copies and i've sent them 3 copies. Yet all I get when I call them is "we haven't received the papers yet". They are so rude aswell, the man I spoke to yesterday basically said even though I won my appeal they still have to make a decision as to whether i'm entitled to the money. I told him that the people we've been speaking to from his department have already informed us that we are entitled to the back payment but he wouldn't have none of it. He spoke to me and my mum like we were dirt. I'm just so fed up of it all now. They stopped my money back in October 10 because they had reason to believe I was living with a partner. I wasn't and have a lot of health problems. Once my IS was stopped I lost my HB aswell. This past year has been a nightmare, i've not got any money or food and I have two small kids. I really do feel like just giving up now. I've had enough of this all.
  7. Hiya, I won my tribunal a few weeks back, they stopped my income support last october. I sent them my decision letter from the tribunal but they are still claiming they've not got anything. They like to take their time and they still treat you like you're guilty even when you've been cleared. Keep calling them, that's what i've been doing. I've had a year of little money with two small kids to raise so could really do with it being reinstated. Good luck, hope they hurry it up for you x

  9. Ok well you know something different from me then as my ex asked at his interview about his bank statements and was told as he doesn't claim any benefit they have no rights to view them. I was also told this by my lawyer.
  10. Hi there, I had an interview under caution last may for the same reasons. I went along and my ex was asked to go along to a seperate interview to answer some questions regarding our relationship etc. We have two kids together. What I would suggest is you take all the evidence you have that proves your address. They like to snoop through peoples bank accounts, they wouldn't be able to do this with you as you don't claim benefits but no doubt they'll have your partners statements. If she can explain all ingoings and outgoings then that will help. Get people to write statements for you confirming that you don't live together. I'd also suggest getting a letter from your GP explaining all the health problems etc. My benefit was stopped in October and it's taken this long to get it to a tribunal. I won this last week and was also advised that the DWP have been doing this to alot of people. If you can prove that you don't live there but supplying that evidence they wont have a leg to stand on
  11. Hi there, I've just been through what you are going through. I however managed to get my housing benefit reinstated before my income support case went to the tribunal. I contacted the housing benefit department direct and was asked to provide a statement and answer some questions. I did all this and received a letter back saying they were satisfied I hadn't been living with my ex and was reinstating my benefit. Income support have been a nightmare, the person who did my iuc was horrible and kept implying i'm a liar. I appealed the decision straight away but wasn't successful so was told my case has been sent to the tribunal department. This has been going on for a year now and my case was heard last thursday. A representative from the DWP didn't even show up. There was only a lawyer there and he told us straight away that we'd won the appeal. The evidence they had from the dwp was shoddy which is probably why they didn't turn up. I was also informed that my benefit should never have been stopped as I have a disability and two small kids. I'm now waiting for the letter to come through from income support confirming that they'll be starting my benefit again. I really do feel for you, this past year i've been to hell and back. I'm in debt as i've had no money and have had to keep borrowing. I've gone days without food and i've not been able to get my daughter the things she needs for school. My advice to you is, gather all the evidence you can regarding your ex. Get him to write a statement confirming what you've said. Get your GP to write you a letter explaining the health issues, go through your bank statements and highlight and explain anything you think they'll ask about. I got statements from my GP, the housing benefit department, my daughters health visitor, my mum wrote statements for me aswell. If you've had to have financial help, you should also get the person to write a statement, especially if it's a loan that has to be paid back. I hope you manage to get the same result as me. The solicitor also told me that they've had so many cases from the DWP in the past few months regarding people living with partners and nearly all of them were won by the appealent's as the DWP's evidence has not been good.   12. Hi all, I've had a problem with my internet so haven't been able to post. I won the appeal!!!!!! The representative from DWP didn't show up and the lawyer said their evidence was shoddy and my benefit should never have been stopped due to my illness and my two small kids. I'm still in shock, it's been a horrible year and it's been really hard. I'll believe it when I get the letter through the post lol. Thank you everyone x
  13. Hi all, I've posted on here a few times regarding my income support. It was stopped in October 2010 as they said I had a partner living with me. My ex is here on a daily basis as I have some health issues which means I have to have someone with me at all times, especially when i'm with the kids. I've given them letters from my GP, statements from my ex and my mum who stays with me now but they haven't been interested. I've already had one appeal which was last month, they decided to postpone that one as they couldn't come to a decision, this time they have asked that me or my mum attend. My mum is going to go for me as I don't do so well under pressure. Wish me luck, it's been a very long hard year without the income support money and I just hope they reinstate it as it's such a struggle at the moment.   14. I would just like to point out that they did not get a court order to look through my bank account. All they have to do is request this info from the bank and state what reason and they get it. How do I know this? They did it to me!
  15. Hi there, I had an iuc last october and they produced bank statements going back to 2007. Nationwide and my current bank Halifax. They had details of all accounts I held with both banks, including savings accounts which had nothing in them. I was asked to explain nearly every transaction in all of these accounts. I never gave them permission to do this and after the interview I researched it and found out that when you sign your application for benefits (ie income support etc etc) you give them permission to check your personal information (bank statements) for fraud etc. It's disgusting, I was told I should have informed them of any money going into my account even if it was just £5.00 as they would count it as an income. Nearly a year on and i'm still waiting for my appeal to be heard by the tribunal
