  1. Thank you very much for you advice it is all I wanted to reassure me as far as possible that I was making the right decision to plead guilty and go to court.
  2. Hi yes I am a taxi driver. I know the importance of my tyres as they the only part of my car that meets the road so EVERY MORNING I run my fingers in the tyre tread to feel if my tyres are close to the guides that are manufactured into all tyres. When they checked it was pitch black and the inspector checked my tyres before I had even closed my car door to come to the pavement. He called over the officer and said the tyre was under 1.6 which is when I said I check them this morning and showed him how I checked my tyres and he agreed that there is was over 3 mm. he then said that the tyre must of been over inflated at some point. If you look at the photo you cannot make out how low the tread was. I don’t particularly want to plead not guilty as I don’t actually know if it was under 1.6. I question his reading though as he could not even record my car correctly. I own a BMW and he recorded it as a Mercedes which could be an error on his part but that also means he may of made an error taking the reading. Well the fact is if they sent this I NEVER received it and now I am in a position of having to go to court either to defend my case or plead mitigation. Lastly the officer states I had 3 miles left to get home but is actually over 10 miles and yes it saved me inconvenience but if they knew that my tread depth was below 1.6 all the agencies were happy for me to carry on with an alleged illegal tyre. They actually said to take it to a tyre shop and get the tyre changed which contradicts the statement saying it was to get home. I just want some advice on what I can do to not make my situation worse but fair

  4. Yes they took down my details and car is registered at my home address so there is no reason for me not receiving the fpn. I have only a week to put in my plea.
  5. I have received a court summons for having a tire under 1.6mm. I was pulled over in February at a roadside checkpoint in London late in the evening after dark. Tfl Vosa and the police where there and as I got out the car I heard the tfl enforcement officer say to the vosa inspector that this car would be good to find someone wrong with. The vosa inspector promptly said how about a tyre and proceeded to inspect my tyre and stated that it was low. I have no way of proving this now but I did at the time feel that no matter what I was going to fail something. They called over the police officer that read me my rights and took all my details and I informed the officer that every morning I run my fingers in the groove and showed him how and found there was plenty of tread. The vosa inspector said not further into the tire. I was informed by the office that 3 things might happen 1 the team would look at my record and if I had no previous incidents They would take no further action 2 issue me with a fpn 3 take me to court. I decided to sign the slip as I thought considering he saw how I checked the tyre and having no previous incidents they would give me a warning. The police vosa and tfl let me carry on driving home and told me to go get the tyre changed ASAP and have a new mot done even though they clearly knew I have a tyre that was under the limit in their opinion. This I did the next day. Since then I have not heard anything until I got a court summons. I was shocked to see they had not decided to take no further action and even more shocked to see that they say in the document they sent me a fpn. I never received this fpn at all and have gone through all the mail I have for last few months in case I missed it and I definitely have not received it. I pulled out the paperwork I have from the evening and noticed the vosa inspector put down that he inspected a Mercedes and I have a Bmw and after reading the police statement it does not state all the facts of the night and the photo they submitted is dark as black and white and looks like the tread is fine. My question is do I plead guilty as I am not completely sure that my tyre was that low, they let me drive on with a alleged illegal tyre, not receiving the fpn and because of the inconsistency in the paperwork or plead not guilty and state all these facts. The police office recorded the conversation and I am guessing videoed the tyre can I request a copy before I decide or do I have to plead not guilty first Please ask me any questions and I will reply Many thanks for your help

I received a PCN from the royal borough of Kingston upon Thames, I have looked at the video evidence and after visiting the location I have worked out that if they were in one of the usual smart car periscope video combos they must of been parked on a taxi rank or maybe on a short section of double yellow lines just before a bus lane. I have requested the location of the camera (plus how it is deployed ie car or a static cctv camera) and confirmation of the type of approved device used. I did stop so a ticket could of been issued if a CEO was by my car (or told me I could not stop there and moved me on). my memory it was raining and at the time I did not see the road markings at the kerb nor the tiny sign on the bus stop post as I never when that far up. What I would like to know is it allowed for the CEO to in a location like this just waiting to issue a PCN
  7. Hi Would like some advice about 2 loans that I took out in 2005 with egg to consolidate credit cards, car purchase etc after getting a mortgage in 2004. Both loans were for just under £25k each and it was more or less implied that if I took out PPI that the loans would be easier to be accepted for and that I would be able to claim if I was not able to work for any reason even though I was self employed. Roll onto end of 2008 where my ex wife and I started having relationship problems and I started struggling to make the repayments but feeling that I had a duty to repay I struggled on trying to keep the repayments up to date even when I could not carry on working at the end of 2009 when I became a single parent. By March/April 2010 I could not make the payments so the loans went into default officially. I spent the next 6 years struggling to bring up my kids as a single parent and have been chased to repay the loans via lots of different debt collection companies but was never in the position to pay anything So now in 2016 the loans have both been removed from my credit report (such a relief as can start rebuilding my credit worthiness). I did receive a questionnaire for both loans from Canada Square Operations in 2013 about my PPI but because of my financial situation I just filed them as I was worried that it was a ploy to get me to pay money to them that I could not afford. It does state in the covering letter that they that the loans where now being administered by Britannica Recoveries but does not say the debt had been sold to them. It also lists the reasons that they think I would be entitled to a refund for and they are for it being implied that by taking PPI I would get the loans and that when self employed I could only claim if I could not work at all. My question is would it be worthwhile sending in the questionnaire now to apply for a refund. Many thanks in advance Allister

Well this is a turn of events I had a knock on the door today by someone from this company all he said was i left a letter for you, you have not made contact and are you going to pay I just said no he said ok and left Anyone have any ideas just seems a bit weird Lastly can advise me about one other thing i have a company car which is parked on my drive can they do anything to it ie clamp it after all the car does not belong to me Any advise would be gratefully recieved Many thanks in advance

I am not sure but i never recieved a court summons at all and when i called the courts the lady i spoke to told me that they have to send me any details that they have so that i can defend myself I thouht that was the case as i have over the last couple of years had to o to court to resolve custody of my son and i needed then to reply before the court case could go ahead Maybe it is different but i would of thought that as i had a letter form them showing their culculation i could show this to the court aswell as explain that i have done every thing that i could to resolve this

Can anyone help I have just recieved a letter from this company stating that a debt collector has vsited my house to collect payment for arrears owed to a council for over paid housing benifit There is a long story to this but the shortened version is that my wife and myself were recieving housing benifit and council tax benifit where we were living up untill ot 2004 when we moved out i called and cancelled our claim for housing benift and gave them our new address (which was my parents so i knew i would get any mail) the housing benifit section even said that they would inform the council tax dept of my move etc. Roll on about 6-8 months later i get a letter at my parents informing me that council tax was about to take me to court for not paying my outsanding council tax. I call the council tax dept straight away and asked what was going on they informed me that they had written to me at my old address (which i no longer lived at) but because this was a court summons it took my address from somewhere else in their system hence why i got the letter. I paid the full amount outstanding there and then (even the court summons fees) to ensure that there was no further action taken and that was that as far as the council tax saga goes. I asked to be transfered to the housing benifit section to check that they had the correct address and they informed me that they only had the address that i had moved out of (funny how the council tax dept had my parents address which they had got from the housing benifit section). They then procceded to inform me that i owed them money as they had cancelled my claim from a date before i had moved out due to not getting a reply to letters that they had sent me. I told them that as they were sending letters to my previous address how was i to reply after all i had taken the time to call and cancel my claim and inform them of my new address that even the council tax dept had which they had given to them. They said that i could appeal which i did and after posting an appeal letter that they said they never got and a hand delivered letter that again they had no record of i resorted to sending them an email with a copy of the appeal letter attached with a delivery and read request (you not going to believe this they could not even open the word document) so i then had to copy my letter into the actual email and hurray they had it (this being feb 2006). Now you would think that things would now start running smoothly but no they sent me a reply stating that i had not appealled within the time set down in the letters (which went to my previous address the whole reason i was appealing) but they did send me copies of the letters While i was preparing to send in another apeal letter i did get a surprise whichwas that they had reculculatd my housing benifit and that they had no culculated that i owed £1.68 so with a sigh of relief i called up o pay the outstanding amount only to be told that it had been paid and that my account no had a zero balance Horray you may be thinking but that woud be jumping the gun I the recieved a letter at the address i now live at (my own house well the banks anyway) in ju 07 stating that i still owed them money i called and was told that i had a zero balance again to which i informed them that i had this culculation and it showed i only owed £1.68 and that when i called to pay it was told that it had been paid and was at a zero balance then i got a letter saying they had an order for recovery of award from a county court right out of the blue in oct 07 i called the court and they basically told me that this was the start of the proceedings and that i should get something from the council I am willing to go into court and explain the situation as i feel that i have been unfairly treated by the council and that they just do what they like Anyone know what i can do about the dca as i dont want them taking my pocessions especially as now that i am a single father my son and i have been through enough in the last couple of years Sorry i did say it would be short but this is just the overview Many thanks in advance
  11. it is not a problem not being able to get credit as i plan to stick to using cash from now onwards just want to get the other cards cleared as quickly as possible so any ideas would be gratefully recieved many thanks in advance

Hello have been reading the site and have just joined to see if i could resolve some of my credit card debt I have just been approved for a short settlement of £3,800 with Virgin (MBNA) with which i have a debt of £12,525.80 so about 30%. ( i never responded to there letters emails txts and calls since october so may have just been deperate to resolve the matter anyway they could) I recieved the letter stating that i had to make a payment by 28th May of £400.00 then another £400.00 by 25th June and finally £3000.00 by 20th July i have just made the first payment and set up post dated payments for the remaining two payment. After these payments the rest will be written off and will not persue the matter either themselfs nor will they pass the debt on does anyone have any experience with this and can i rest easier now about this debt finally i have a number of other debt that i would like to resolve these being Halifax £7,500 never missed a payment Cahoot £5,000 never missed a payment Marbles £10,000 missed a number of payment but have made the last 3 payments but would like to tackle this debt next has anyone had any dealings with marble (HFC) and would they agree to a short settlement of the same term i also have a couple of loans with egg for about £12,000 each (£24,000 in total) which i am paying and are upto date (about half paid but will run til nov 2009) aswell as a overdraft with first direct £10,000 which i pay every other month when they call saying i have missed payments i was going to see if i could top up my loan (pay the same amount but extend the length of the loan hopefully anyway) and offer short settlements to my credit cards as the intrest is pushing me over the edge and causing sleepless nights as you would expect any advice would be welcome
  13. thanks for the reply i am more interested in trying to get an agreement with each to write off part of the debts i did not know if anyone here had any dealings with any of the credit card companies and what the chances were of achieving it
