  1. the money was never handed to me. the landlord had it paid directly to him. i have never had a copy of the rent deposit agreement. when i moved from that property to a housing association property, i recieved no letters about the rent deposit.(i was never asked to return it) the only correspondance i have had is the court papers this last week. i fail to understand your lame attempt at confrontational banter.
  2. hi, heres a breif outline about my problem; i was living in a one bed flat as a single man.(after my divorce) i have three children from my marriage, and one after the other they left my ex wife and came to live with me.(two teenage girls and a 9 year old boy).i needed somewhere bigger to live, and approached the local council.they basically told me, they could not help me and that i should stay in private rent accomodation.after a long period of time arguing my case, they offered to help me with a rent deposit of 500 pounds.this was on the 13th oct 2003.since then i have managed to rebuild my life and have managed to be housed with my new partner and two babies.i also still have my eldest son with me.during this time (from 13th oct 2003 to date) i have forgotten about this rent deposit agreement.i have now recieved a claim form from my local court.to save time and the threat of any further action i have started to pay of this so called debt.(weekly) in the claim form they say they have sent me letters and an invoice, whitch i have never recieved as over the last 7 years i haved moved house 3 times as my family grew.i have contacted the local council and they say its not their fault i have not recieved the relavant docs over the years.i am wondering if this "debt" is statute barred and/or can be written of? any help or advice is appreciated. chubbs :grin:
  3. ashurst llp have just telephoned me. i was asked if i had entered my ammended poc to the court. i replied "not as yet .......but i do have untill friday at 4pm to do it." ahhhhhh was the reply. i wonder what they are up to now ?????
  4. chubbs been reading...........not sure if this is of any use to me (or you)? passage from the defence submitted by a & l. 8) it is denied that the charges, or any one of them, are punitive in nature and / or a penalty. the charges were incurred as part of the banking services provided by the defendant and calculated in accordance with the defendants terms and conditions agreed to by the claimant. 12) in accordance with the defendants standard bank account terms and conditions agreed to by the claimant, the claimant agreed to pay charges levied by the defendant for banking services provided by the defendant in the course of the banking relationship.blah blah blah. 16) as to any allegation (if any) that these charges are penalty clauses, they are not.the charges are administrative fees levied by agreement in the cicumstances set out above blah blah blah. 19.2) the terms relate to the price or remuneration as against banking services supplied in exchange, as explained above and therefore constitute a "core" provision.blah blah blah. i just dont know if this is what is needed.i still have a day or two before i discontinue officially. any ideas?

Finding the door locked, he peeks in the keyhole and sees his father in bed with the nanny.. He gives up and goes back to bed. The next morning, the Little boy say's to his father, 'Dad, I think I understand the concept of politics now. ' The father says, 'Good, son, tell me in your own words what you think politics is all About.' The little boy replies, 'The Prime Minister is screwing the Working Class while the Government is sound asleep. The People are being ignored and The Future is in deep ****.'
  7. hello people. bad news im afraid. after a long period of reflextion and thought.i have decided the risks are to great.i therefore will not be continuing my claim at this time.i feel i do not have a good chance of staying in the small claim track,and if i am allocated to multi or fast track, i can not afford to loose and pay the costs.i would rather live to fight another day.and im sure ( hopes and prays ) it will come. it is with a heavy heart that i have made this decision.but i feel it is right. i would like to thank all the people who have helped me get this far.without your help and support it would not of been possible. :grin: the alliance and leicester freedom fighter is down...but not out! i will keep tabs, and if by any chance i can take up the fight again.i most definately will. thank you all............................

  11. sweet. i like this.well done on the years charges and interest.good luck for the next stage.i have my case in court again soon.managed to get the strike out adjourned so i can enter new pocs.
  12. i am currently working on my application for fee remission.very simple form.the upper limit for some one like me with three children and a partner is £26,790.my total annual income with benifits is nearly £7000 under this. so it looks like i will be able to claim the remission.no more expense at present for me.need to work on the allocation next.still not sure what track i am on as the judge said i hadnt been allocated as yet.
