  1. I've only just seen this thread. Is it still relevant? I have a sttayed case that will be dismissed unless I write to the court swiftly. See Camdenite V Abbey
  2. I've just posted on my original thread (Camdenite V Abbey), but thought I should add something here. I've called the court today in respect of a 2007 stayed case against Abbey/Santander and was told that the only way it would not be struck out would be to write to the District Judge requesting a hearing. Is this the point where I give up? I want to fight on but have no grounds for Financial Hardship.
  3. Finally called the court today to be told that I need to write in to the judge requesting a hearing if I don't want my case to be thrown out. What do I do now?
  4. No, not a peep out of Abbey. They're probably too busy sitting in focus groups discussing how the name change has gone Has anyone else heard from them? Two months is up tomorrow (isn't it?) and like many I could really do with being shown the way forward. I saw on the penaltycharges site that there was a template up to argue against a strike out, but nothing else yet. I can't see that template on CAG. and wondered if all the consumer groups are still acting together on this?
  5. Hi all, I thought I'd better reactivate this thread. The two months from the SCJ verdict is nearly up and although I haven't heard anything from Abbey or the court yet, I'm expecting a strikeout application to be submitted shortly. I notice that the Penalty Charges site has now put up a "Defence Against Strikeout Applications" requesting a further month to amend the POC. Is there something similar on here? I couldn't find it. I'd be happy to use the other site's defence but would rather use one from CAG if available. I used CAG's templates all along, and want to be 100% certain it's appropriate to my case. By the way, penaltychargesforum seems to think the new POC will be up in the next couple of days.
  6. But wouldn't those same claims co's be springing up if WE showed them a way through via the court system? There were plenty around 3 years ago, going down exactly the same route as the general public.

  8. Thanks all. Yes, I have written to the Ombudsman rather than the "Casework Support Investigator" I'll be back when I get a response, but will look out for yours in the meantime.
  9. I've had an acknowledgement of my last letter (going full guns blazing about CI) from the FOS, so that's a start. They have another three weeks to investigate, or I'll be sending an LBA to MBNA and then off to court.
