  1. Hi, does anyone have an email address for Capital One, i accepted their offer of payment of my charges 2 weeks ago, the account i had with them was settled and closed in June this year so any monies owing should be paid directly to myself, i have heard nothing from them, i have written to them but still heard nothing, i know Barclays have an department that deals with these i was wondering if Capital One did?
  2. Take a Charge on the Property? Can you explain what that is
  3. To be honest she is very stubborn, and I wouldnt trust anything she says. She says she has, then she says she hasnt, the only ones likely to though i think would be the abbey given the history on the account. I think we will let it take its course, without signing the consent order. Least that way we still have a say over the house.
  4. It has been two years since he left her. She works as a personnel Manager for Asda and we assume her salary is around £28k, the house is worth £185 £190k Mortgage was £115k Secured loans of £10k and £30k on the property, My partners credit history isnt the best and as they are still financially linked, then I would assume hers would be in a similar state and it is also know that some of her debts are consolidated through the Credit Councelling Service. She has been Paying the Mortgage Since he left as well as the Secured Loans, plus she has recently got to the CSA as it now getting double what he used to pay her for maintenence
  5. One dependant who is 6, Lives with the mother in the marital home. All he wants is his name off the mortgage, so that we will find it easier to move out of the flat we are in. He is willing to walk away from the marital home, as long as his name comes off the mortgage
  6. I visited legalzone.co.uk free service posted the questions above, and got a response the next morning. They advised not to sign the consent order, for his ex partner to apply to the abbey first and she will have to go through credit checks etc and prove her finances that she can take it on. But we have doubts. Otherwise if i sign it, the deeds can be ammended (my partner would lose any right over the property) but he would still be on the mortgage so she would have it all as she wants. Liberty to apply then implies that it can go before the court then to let them decide.
  7. He has had two solicitors during the course of the Divorce. He hasnt benefitted from anything they have done, so once the actual divorce was finalised he finished with the later solicitor. So dealing directly with Ex Wifes Solicitor. I believe the consent order when its signed by my partner and Ex Wife then goes before the Judge is that correct?
  8. I will get my partner to discuss the Consent Order with His ex wifes solicitor as If he is removed from the deeds but still named on the mortgage then It doesnt benefit us really. He will lose anything he may have been entitles to regarding the house if its signed over to her, yet he still cant move on and get a further mortgage if its still taken into account. Thank you all.
  9. Hi Forum I am wondering if someone is able to offer any advice. My partner and his ex wife have recently got divorced. The marital home is still the remaining issue. The solicitor is drawing up a consent order, whereby my partner will not be responsible for any part of the mortgage or secured load on the marital home. As we are yet to receive the consent order.. .I am writing this in hope someone has experienced similar. Apparently my partners name is coming off the deeds, but due to his ex wife's current credit status cannot have his name removed from the mortgage as such. Is this possible to be removed from the deeds but yet still be named on the mortgage but not be responsible financially if it goes wrong while his ex wife is in the house? I am looking at this with a view to my partners credit score, if we try and move from the apartment we're in or generally apply for any credit.... obviously if I am not responsible for the mortgage then when lenders search, surely it should be discounted/overlooked but how is this done? Would he have to send a copy of the consent order to Equifax, Callcredit and experian to let them add something to his credit file. If anyone can shed any light on this matter it would be greatly appreciated.
  10. My sister is a Manager of a First Choice Travel Shop and i booked all my holidays though them, i have just booked an £1100 to Egypt and have had no confirmation of my booking only a copy of the invoice and thats it, you dont need a confirmation letter, you have an invoice with all the details on, you will get your tickets 4 weeks before you travel, you can either go in to collect them or they will send them to you....if you are truly worried about it go into the shop as someone else said and tell them your concerns im sure they will put your mind at rest for you!
  11. Yes they are, they said it was all in the small print but when we asked for a copy of the agreement and small print they said we should have one from when we opened the account...in other words its not in the small print they were talking out of there bottoms! I think its a joke, how they can do such a thing is beyond me im sure there are many other people its happened to aswell for no reason what so ever!
  12. Have you tried contacting the motor insurance company? Im assuming the payment is classed as a one off Direct Debit payment, you can go into your local Halifax branch and fill out an Indemity form, Halifax will then credit the amount back into your account and then request the money back from whoever the motor company was.....simple as, it happened to me last month and thats all i did took minutes!
  13. Next are a complete pain in the backside, my partner went through a similar situation, he opened an account no questions asked, spent on the account paid it off every month, the opening credit limit was £250 and after every month or so it would go up until it was £1000, we had never missed a payment never made a late payment at all so when we tried to use the card which you can apply for so you can shop in store aswell as on line, we were shocked when it was declined as in checking the balance that morning the limit was £1000 and balance was £500 leaving him £500 available, in calling Next we had been advised that something had come to light on his credit file (which we didnt agree to them checking again), which to us was rubbish as he had not applied for any credit since getting the card and like yourself if anything his rating was better than it was when the account was opened. All Next said in a letter is that they are entitled to do a credit check every month and that is what they had been doing but when asked what was the info that had come to light they had no answer...they put his limit from £1000 back down to £375 which ment as he has a balance on the account already of £500 that he was now showing as being over the limit....till this day we still have no clue as to what they were talking about, we also contacted Experian and they also didnt have any new info on his file so can only assume Next made it up.....also with regards to the credit check every month, when he signed the agreement he agreed to have one check for them to open the account not one a month this has now stopped and we have had several credits to the account due to Next being a nightmare, my suggestion is to write Next a letter or email them but im sure the answer would be the same as the one we got! Good Luck!
  14. I would contact the FLA if i were you, i had a similar problem and they were really good you can fill out the details online and they will act on your behalf, it should take no way near 6 months mine was sorted within 4 weeks max.... Good Luck !
