  1. I apologise. I am appealing a court judgment that Lowell were able to claim a statute barred debt was not statute barred because they said a default notice was issued.

  4. Good Morning and many thanks for your reply. I used the card at my local branch to withdraw some money the same day these transactions took place over 80 miles away. The statement shows clearly where they took place. I have indeed contacted the places where the transactions took place and they clearly show the perpetrators to be 1 or 2 young to middle-aged women of EE appearance. All the bank tell me is 'it was your card, and your pin, therefore you are at fault!! I have been to the Police who tell me I now have to make a report to Action Fraud, which I have done. The bank say I must contact the Financial Ombudsman if I wish to take things further, but they are being slow to send me the 'final letter' which i need for the Ombudsman service need to enable them to act. Good Morning 'renegadeimp', Thank you for your response. I have indeed told the bank in no uncertain terms that 'I' am the victim, and demand they refund the transactions. I cannot believe some of the 'arrogant individuals' I have had to put up with on their helpline(??) As I said in my previous post I have reported the incident to Action Fraud and have given the crime number to the bank. All I seem to be getting is 'stonewalling' from the bank. Being given the runaround is putting it mildly. All of the outlets have cctv footage and ANPR, but the bank don't seem interested. One of the individuals at the bank told me to 'go down and get the footage from these outlets and give it to us so that we can take a look!!! I just don't know what to do anymore.
  5. Hi, I wonder if any of you may be able to give me any constructive advice. Last week I discovered 7 transactions from my debit card over £1000 worth, that I knew nothing about or authorised. These were all chip and pin. The bank are now saying that it was my card and the correct pin used so they are not responsible. The situation is I did not make the transactions, my card and myself were 80 miles away at the time, but cannot get the bank to do anything. They emptied my account and am now in serious financial trouble They have referred me to Financial Ombudsman and having spoken to them, can take several months. I need some help please Can someone tell me if I have posted this on the wrong forum?
  6. Papasmurf, Thank you for your kind words. I feel so much better speaking with someone about this albeit anonymously. I know what I must do. I will be writing my resignation over the weekend. I will speak with my partner over the weekend to about going to the police and the authorities. To all that have responded: I thank you.
  7. Hello Rebel, With the cctv, any kind of undercover work as you suggest would be impossible and to have this kind of talk with the MD would only end in violence towards me. I did take a look at last years accounts a few weeks ago and they appear to have omitted at least two zeros from the true turnover, it really is a horrible situation.
  8. Hello again Papasmurf, I don't think the 'clients are at risk per se, except that the guards may not turn up if they don't get paid. With regard to the VAT and PAYE contributions being paid That is another worry which perhaps I should just go ahead and report my discovery to the authorities. Photocopying anything is not an option. The machine is right next to his desk!! Apart from that every part of the office is under cctv surveillance! It is now clear why the FD resigned. I am going to have to go the same way, I cannot take this situation any longer. He came back in the office this morning with his 'friends' carrying many thousands of cigarettes, his sweeteners he calls them!! I thank you for your interest in my predicament but I just had to let my concerns out somewhere. I now know what I must do.
  9. Hi Andy, Yes, it is a limited company and he is the self-styled managing director. The other directors are his wife and his friend. There is no HR department although his wife maintains she is in charge of HR. Briefly, my position entails raising invoices for payment, credit control (which is a joke) By that I mean I am not allowed to see bank statements etc. I also run the payrol. I have just been told that I have to tell the staff that their wages may not be in the bank until next Tuesday, rather than today. I hate this situation. I do have some knowledge of company law, to the extent that I know there is something seriously wrong going on but don't know what to do.

  11. It seems like I have walked into somebody else's nightmare? I have only been with the company a few months and what I am discovering is frightening!! I took up the position of Financial Controller after the Financial Director resigned, so am an employee rather than an 'officer'. To answer your specific question Papasmurf, and thank you for responding its a relief to be able to talk to someone about this. Last Friday he withdrew £15,000 from one account and £5,000 from the other as his 'spends' whilst he and two of his friends went over to Spain on Sunday. Sadly it doesn't end there. His mortgage in the UK along with his co director is also paid from the company account. On a monthly basis he is withdrawing £6-8,00 a month in 'wages'. It is only a small company but he will not listen. I was told to mind my own ffing business when I questioned the blank stubs in the cheque book. He really screamed at me me across the office that it was my job to get the money in, nothing else.. I am so afraid that if I do report this to the police that he will in some way drag me down with it. I am so worried.
  12. I hope you kind people on this forum are able to offer some constructive advise. My problem is that I have discovered that my employer is removing large amounts of money from the company account, flying out to Spain and using the money to service three personal mortgages on properties he own out there. I have tried to advise him that what he is doing amounts to money laundering but his stance is 'its my company, therefore its my money. He does this on a regular basis and when he does, there is never enough left in the bank to cover wages so the staff invariably have to wait an extra week or so for their salaries but he just doesn't care. He just seems to think he can do as he likes.

  14. Good Evening to All. This is my first post on here and wondered if some kind soul could give me some advice on the next step I should take. I recently started receiving demands from Lowell for an alleged debt to HSBC for £4300.00 which I know I do not owe. This debt is supposed to be from a 'closed' current account. We have not used this account since we sold our house (the mortgage being also with HSBC) over 5 years ago. When we completed the sale the bank settled everything that we owed and gave us the remainder of the equity, almost £20,000. At no time did we even go overdrawn after that. As far as we were aware, there was about £10 left in the account and we have not used it in any way since. The bank always had our knew address, but we have not received any letters from them in all this time. Lowell tell us we have an unpaid overdraft with HSBC to the tune of £4,383.84 which we know nothing about and they say the debt was sold to them last year. They will not give me any evidence of this alleged debt, saying only that if I pay a nominal fee of say, £20, they will send me a copy of the original agreement with the bank. I received today a Statutary demand for the full amount. When I phoned them this evening they tell me that I should agree a payment plan with them to pay off the debt, and if it turns out that, if as I state, I do not owe anything, they will of course return my money. I also telephoned HSBC this evening only to be told they have no record save to say that my account was closed some considerable time ago. I could really do with some assistance here because I do not owe HSBC anything but feel like I am being forced into a corner with the added threat of bankrupcy, a course of action that would lead to dismissal from my employers.
