  1. Thanks for your advice! I do hope you're right. I'll wait to hear from Cobbetts or the Court by 9th August and will inform everyone of the result. This 'waiver' thing has really got to me.
  2. Ohhhhh s***t! I was there at Leeds Mercantile 28th June. The judge said Natwest had until 9th August to get back to me with either a settlement or otherwise, and now the FSA go and do this 'waiver' thing - how bad is the timing!!
  3. Hi! Just been on FSA website to check the list of Banks/Building societies who have been granted this 'waiver'. Could anyone clarify if NatWest is part of the Royal Bank of Scotland Groups plc. If it is, then that's me up for a long wait!
  4. Hi Parkvale I hope your right about Natwest settling! What is the possibility of them not settling on 28th June, and/or what if they only offer part of the claim - do I accept or hold out for full amount?
  5. Steven4064 Letter from court says 'Your claim is being transferred to Mercantile Court. A case management conference will take place 28th June at Leeds District Registry Court'. Documents sent to court are list of charges, claim form, CMI form partly completed because couldn't understand questions, with covering letter saying if there is any other info required to let me know. Haven't heard anything from court yet. Do you think this will be ok?
  6. Hi, I have same as 'reclaimone' defence paragraph 1., but have never had offer of settlement. Got court date 28th June Leeds. Cobbetts sent letter 20 June requesting information by 4 July. The court date is before this, so i'm not sure what to do. Also, Cobetts request for info paragraph 3.1 states "please specify all the facts relied on by the Claimant in support of the contentions in paragraph 3 above, and in particular please identify (a) the section(s) of the Unfair Contract Terms Act 1977 (b) the regulations of The Unfair Contract Terms in Consumer Regulations 1999 and © the principles of common law relied upon by the Claimant in alleging that the contractual provision(s) referred to are unenforceable. What the hell is all that!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
  7. Hi, I too have 28th June at Leeds. Problem is, since I received the letter from Mercantile Court regarding the date, I have just received letter dated 20 June from Cobbetts (Natwest solicitors) requesting further information to CPR18 by 4 July 2007!. What's going on! I'm sorry but I'm completely confused now! What to do? Where to go? - CAN ANYONE HELP!
  8. Hi, the interest charges i mean are interest charges on charges on account, if you see what I mean? not 8% interest charge.
  9. After reading through hundreds of threads, it appears I can claim for interest charges on account as well as overdraft/DD/referall charges. It works out at an extra £272. But LBA already sent and reply received with rubbish offer of settlement - Can I still add this amount on when put claim in to county court? Help please with this one!!
  10. Hi tigerlilly24! I was gob smacked too when she phoned me! Glad you agree with next course of action. Has anyone else had this happen to them - money deposited into their account? Would be pleased to hear from them. I wonder what kind of person sits in NASTYWESTS litigation department (or where ever), reads the LBA's sent in and decides how to handle it! Obviously someone with few brain cells, thinks they've got a sense of humour, and is bored with the job!
  11. I posted a couple of days ago asking 'where can I get a claim pack' (you may remember or not). It was for a friend who's starting to claim nearly £5500 from NASTYWEST. UPDATE!!!!!!! LBA sent and reply received, offering £60 settlement :o . My friend has not accepted this offer (obviously), she hasn't contacted them at all yet. But hear this! Nastywest have deposited £60 into her account! Very nice of them I thought to give her £60 - but what are they playing at! I have suggested to her to send a letter declining the offer and accepting the £60 (already deposited into her account without her agreement) as part payment on the understanding that she is still requesting the full amount and county court action will commence. Could anyone please advise if this would be the next best step - any help greatly appreciated*******
  12. Hi abcdef, Regarding your 3rd point on interest on charges - is this right? they can't charge interest on charges? If that's the case, how do i claim this? Have already sent prelim letter and LBA, and shortly going to file claim with county court - but haven't included this interest charge in original letter. Is it too late now? Appreciate any advice
  13. Hi, I think your letter is excellent! straight to the point, and no messing! A friend of mine is claiming from NATWEST and is in the same position, would it be possible for her to use your letter? I know there's a similar template letter, but prefer your wording! Sorry if this seems cheeky, but I think its better to ask, rather than just pinch it.
  14. I telephoned the local magistrate court and evetually got to the right department. They're posting a claim pack direct to my friends address. Whilst I was on the phone to them I asked if the claim limit was £5000, they replied yes, but in the pack is information about claiming more than this amount - so that's good news! Right, lets get NASTYWEST sorted! (on my friends behalf of course)! Thanks to everyones replies and I'll keep you posted!
  15. Thanks for your response, greatly appreciated! But I've just had a thought. Can my friend claim through the small claims court for nearly £5500? I understood that it was up to £5000 for small claims . Is that right?
