  1. DX these are charges made up of missed DD and standing orders also over my overdraft charges. From 2006 - 2007 are charges that basically killed me financially.
  2. Dx, Image of my calcs Have not posted any paperwork
  3. Hi Dx Thats what i thought, would you except their offer if you were in my shoes? should i call them and state that they can't off set?
  4. Hi, I have had a Lloyds gold package account since 1997 and it was upgraded in 2004 to a platinum account and then in 2007 the account was closed due to a personal financial crash. I'm very sure that i have never claimed anything. Could anyone point me in the right direction with a template letter. Thanks
  5. Hi, 7 days ago i sent Lloyds a claim for around £3600 which is made up of overdraft charges and interest and just received an offer of £1800 from Lloyds, they also said they would use it to clear off my outstanding balance of £2300. They also state that the debt was sold on to a recovery agent. Should i except their offer?
  6. Thanks DX Would it be worth scanning and uploading the Comms for you guys to take a look?? Not sure what i need to do next?
  7. Dx, Just went through it again and nothing in their that mentions a default. The only thing i can see that i'm not sure about are the following: N1 Initial NOSIA & N2 Subsequent NOSIA
  8. Hi DX, When you mean Comms would that be details of all contact sessions?? this came with my SAR and was stapled together with my loan agreement and a statement showing all payments made and interest.
  9. Hi DX, I have just gone through the transactions sheet that was attached with Lowell witness statement and it does not show a default on it only a write off as a comment on the final transaction on 22/1/2009. I have no default on my Experian credit file and have not received a default form LLoyds so how can i find out the alleged default date? if the default is from the write off date then in January it would be unenforceable. I have a court date of 8th Dec. Thanks
  10. so what next? do i have to settle even though i have not receive a default or none shown on the credit file or screen shots of my lloyds account? all they have sent me was what i posted up on post 16 on this thread.
  11. Hi, received a letter today from BW legal and in it was a Lowell witness statement and this contained a letter from Lowell saying they have bought the debt an Introduction letter from Lowell, copy on the Lloyds loan agreement + T&C's, DD agreement and a load protection acknowledgement all signed by me with date. Along with the info was screen shots of the account showing all payments and transactions with the final transaction on the 22/01/2009 showing the debt being written off I have checked again my credit file and the default is dated 24/7/2009, the default with that date is not on there. Still have not any received any response from BW with regards to my CPR or CCA Request unless the attached doc's mean they have??? very confused now.
  12. Update, Notice of allocation to the small claims dated 13th Oct received on the 18th. I have sent an email tonight saying I'm happy to enter into meditation again!! and court date set for the 8th Dec. Claimant must pay £335 today. Still no CPR or CCA do you guys think they will pay? if they don't what will happen? cheers MrPond
