  1. Hi all This used to be the norm for me, checking the forum and working out how to deal with debt problems. I eventually managed to get my credit score back up to a point where I could get a credit card, albeit, a high apr Vanquis card. I was in a stable job earning relatively good money and have managed to make the monthly payments for the last 3 years. However, a few months ago, I lost my job and I had started to study for a career change. I have since qualified and even though I still have the experience of my previous job, it is becoming increasingly difficult to find a job. In the last year or so, I have taken on more creditors due to having financial stability. I took out a small loan last year with Avant credit for £1000 which has £715 left to pay in total, I also bought a new pushbike with V12 retail finance of which I still owe £654, I have a further 2 credit cards with capital one and the balances are £567 and £275. My vanquis card is owing £3167 I made a lot of phone calls a couple of months ago to see if I could hold off payments until I am financially back on my feet, but instead, all the creditors backed me into a corner to make arrangements for smaller payments, even though I couldn't afford to meet the payments due to not working. Does anyone know where I stand with this and what I may be able to do as I am now in a position where all of these creditors have now sent these debts to outside companies who are now writing to me and texting me. My credit score has plummeted and this situation is only going to get worse. I still have no work but none of these companies seem to be listening. Thanks in advance
  2. ok, here goes. in 2006, i took out finance with santander on a car which was costing me £240 a month, and i took out ppi originally. the car was costing me too much to run and after about 6 months, whilst keeping up with the payments, i decided to go with something cheaper to run, santander refinanced me on another car that was a cheaper purchase therefore reducing my monthly payments and running costs. a short time after, i was made redundant and this created a problem for paying, but i had cancelled my ppi when i refinanced for the new car. i fell behind with some payments but made an arrangement to add the missed payments to my monthly payments for the rest of the term of the agreement. at this time i couldn't find any work and set about starting my own business, but i could not afford to keep up the payments and so it began to spiral in to an uncontrollable debt. i hold my hands up to the fact that i'm very good at burying my head in the sand and i let it get on top of me. a charging order has been put on my house which my ex wife now lives in and i live elsewhere, but they have tracked me down and i have since made an arrangement with them which i still have not been able to keep up with. the business went under a couple of years ago and i have not been earning much money in my job, but i have now lost my job and bailiffs have been round about it. what do i do as i am unsure of what offer they would accept and i can't afford to lose my car, which isn't the same car. i realise i may be in a 'back to the wall' situation, but i feel in the past i have been backed in to a corner to make arrangements that i, and santander know i can't stick to.
  3. i have a bit of a dilemma in august 2011, i took out a car insurance policy with post office. at the time i owned a mitsubishi lancer evo 4 which is a group 20 and my premium was around £600, i was unable to prove my no claims discount within the 28 days so the premium went up to just over £1000, which was perfectly affordable still. In october i got rid of it for a car which was far more economical, a 2005 vectra sri diesel, group 10 insurance, and when i changed it over, they told me my premium was going up to over £2000:mad2:, which i thought was rediculous, seeing as it is a safer, lower insurance group etc. i know it is 7 years newer than the previous car, but to charge me more than double for a family car with more safety features is crazy. they are charging me £222 per month, and i will add to this, i am 30 years old. i have struggled paying it but have done so, but a couple of weeks ago i lost my job and can not afford my premium, and would like to cancel it, but they want over £900 to do so. is there any way i can get out of it as i have had other quotes around £500-600. i was going to start a new policy and change the details of the current policy to a vehicle much less to insure as this would still work out cheaper but technically is fraud so don't want to do it. there must be some sort of loophole i can use. any info wold be a great help

  6. hi again guys gt my n1 form today and was just wondering about a coupleof issues. i have put in the claim amount but i'm confused about the court fee. can anybodyadvise me as there looks to be a civil court fee of £85 followed by a preparing for hearing fee of £35 and a hearing fee of £150. do i need to add all these fees. thanks in advance

Hi Tilly - Thank you for replying, however it's not the harassment of the calls that is the problem; they are now threatening legal action which surely they shouldn't be as we have had the standard 'waiting for the outcome of the OFT test case before we resolve' letter so they clearly acknowledge we are disputing the charges.... Someone please help - we cannot afford for this to go legal. TIA
  8. Hi There I'm not sure if I'm posting this in the right section so apologies if I'm not!? My DH recently bought a cheap scrambler bike, it was offered to him by a customer at a low price as it needed some bits doing. DH is a mechanic by trade so bought the bike. One of the things to be repaired was the back wheel. DH sourced a guy in Durham who advised him he couldn't get the exact one but could supply one which could be modified to fit although he had to have the sprocket and some other part with it, he couldn't do the wheel on its on. He sold him the wheel on the basis it would be modifiable, to fit the bike, at a cost of £100. Today the wheel turns up and instead of being a 195 he has sent him a 215 which is far too wide and would not be able to be modified to fit. DH gave the guy the specifications over the phone when having the original conversation. He has rung the supplier and told him that he has sent the wrong thing and the supplier is refusing point blank to do anything to rectify the situation telling DH that if he wants it sorted he will have to take it through the courts!!! DH now wants to drive to Durham (miles from us) and take a friend to 'sort it', obviously this is daft. I say if they guy has told you to sort it through the courts then do so. OK so it wont rectify the situation now, DH cannot afford to get another one now and wanted the bike to 'play' on over Christmas so is gutted to say the least, but I figure if that's how the guy wants to play it then bring it on SO, the question is where do we stand legally (sale of goods?) and what can we do to get this swine to sort this out for us.   11. Thanks Maroondevo52 We had a look at this page but weren't clear which adress to use and wondered if someone could clarify. If i use the MK address do we just drop the 1st 3 lines from the 'Data Protection....' address and head it 'Abbey PLC'....? TIA
  12. hi people sent them my letter before action and got a reply pretty much the same as the last one. i'm assuming i now have to file a claim against them in the county court. can anyone please give me some advice on this and how i do it.
  13. hi there i sent my SAR to abbey and received my schedule of charges and have just put together my spreadsheet but i don't know where to send it. could someone please give me the correct address to send my prelim. is it the same as the one where i sent my SAR (data protection manager)
  14. well here i am again with the next instalment of my claim against halifax. i have just received a letter from them after sending them my prelim and they are basically saying that they are not dealing with back charges complaints until the resolution of the legal issues regarding the fairness and legality of their bank charges. is this just a sandard letter or do i have to just sit and wait until the outcome. what is the next step for eme to take. thanks in advance for your advice.
  15. thanks for your help guys, gonna sort this out now and get my money back. i'm assuming it's guaranteed to go to court cos if it didn't you wouldn't get your interest back. i'm confused with this now cos i thought we were supposed to be claiming interest too.
