  1. Good news is that Lee from Vodafone has contacted me. He says they have checked and that there is no negative on my credit file, however Callcredit are still showing a Default although satisfied. This IS NEGATIVE info. I would ask Lee to send me a copy of what Vodafone sent the Credit Reference agencies in February 2016 to correct my credit file as I am getting fed up with this. If Callcredit are at fault, it will be them I will take legal action against. This inacurate data on my credit file could have very serious consequenses to me in the near future, and should this happen I will gladly sue those responsible.
  2. Well I still have had no reply from Vodafone and my Credit File is still showing adverse info, so it looks like I am going to have to start the process of collecting and collating all information to take this to court, looks like a long summer, but I will win and I WILL claim all expenses.
  3. A big thanks to Lee, but as my post of 25th February Callcredit are still just the same, ie showing a Default. It actually shows all payment info as ok, but shows a default date of 1st May 2015 and Default satisfied on 28th October 2015. It has now been more than 30 days, so it looks like Callcredit are not going to change this now. I would ask Lee if he could get this removed from Callcredit as it is still showing adverse info.   4. Thanks for all your help Lee it is much appreciated. I have checked my file and callcredit are showing as a Default satisfied and give a default date. Payment info is all good however. If you can give them a push to remove this as it is still adverse. Equifax is fine and I cannot check Experian just yet. I find it hard to check my updated credit file often as it seems all the online services only update every month, again if anyone knows different, please let me know. Again a big thanks to Lee, you are the only one that seems to get things moving.
  5. A big thank you to Lee, I have just had an email from him to say that they have arranged for all negative information to be removed from my credit file. I will check my credit file again in 30 days to make sure that it has been removed and report back here then.

  7. Yes I do have a letter from Vodafone saying that they will remove ALL adverse from my credit file. I have contacted the Credit Reference Agencies stating that they are publishing inacurate data, but all they try to do is sell you their services and point me back to Vodafone. I am in the process of collecting all that is needed to take Vodafone to court for this and will if it is what is needed. I will keep this forum updated with events
  8. I have been paying an agreed amount every month now for a long time, but it will simply never get paid of. Last year when I had a bit of money coming to me I offered them about 20% as full and final offer but it was turned down - they wanted 80% so back to the monthly. I was in fact wondering if towards the end of the six years when it is not really going to affect me they would take a smaller offer, just to get things cleared.
  9. We all know that after six years any default on your Credit File is (or should be) automatically removed irrespective of whether or not there is a balance owing. If after six years the default is in fact removed from you Credit File as it should be, but you are still paying an agreed sum back every month, what would happen if you stopped paying this? Can the creditor issue another Default as there is not one showing? Can the creditor use legal action against you, considering there is no Default showing? Any comments would be greatly appreciated.

Vodafone have also placed a Default on my Credit file and after serveral letters and a threat to report them to the Data Protection registrar and indeed the office of fair trading they agreed to set my balance to zero and remove all adverse from my credit file. This was on 8th September 2015, and now in short they did eventually set the balance to zero but never did remove the adverse. Now after several letters to and fro I have a letter back saying they will not remove the Default. I would ask for help from Lee as he seems to be the only one that gets things moving.

After my CCA request to Tesco Visa I did get and within 12 days a photocopy of my original application form, Terms & Conditions and an agreement with my credit limit and charges that can be made and a set of statments. The Application form does have in the signature box "This is a Credit Agreement regulated by the Consumer Credit Act 1974 Sign it only if you want to be legally bound by its terms" The form does also have a date stamp with an illegibal signature on it. My question is - does this comply with ALL the terms of the CCA. I was in dispute about this and I do not agree with the transactions on the statments. I asked Tesco to prove these transactions by providing copies of the signed transaction slips (before chip and pin) - they refused. Tesco then put this into the hands of Westcot. When I disputed the fact with them - they droped it and now Tesco have put it into the hands of Moorcroft who are treatining legal action. Can enyone give me advice on whether the docs sent by Tesco do comply with the CCA and what about disputed transactions. Any advice will be greatefully received.
  13. Default notices are a pain. In my experience companies will never remove them unless forced to. An example I sent a CCA request to a Credit Card company that had defaulted me, they then wrote back to me and said they could not give me a signed copy of my agreement (although they did give me a copy of my application form). When I argued about this they wrote off my balance and marked my credit file as "satisfied" but the default still remains and they refuse to remove it. I have now put it in the hands of the Data Commisioner and hope they can force the issue. The Financial Ombudsman can also do the same, but both are a time consuming excersise. Good luck in getting it removed.
  14. First don't worry about a doorstep collector - thay are just commission agents (they get 18% of what they collect and thats just the guy on the doorstep). If a strange person comes knocking, they MUST identify you before even saying what they are there for. So DONT give them your name and tell them that you won't deal with anyone on the doorstep, if they get pushy, pull out your phone and dial 999 and watch them run. Write to scotcall and say that the debt is in dispute and for them to confirm the owner of the debt. If Capquest own it, no problem they have failed the CCA and need the court to order it. However if it is owned by someone else, then you have not issued them directley with the CCA request. I'm not exactley sure what is the exact case here - can anyone else help. Any how see what scotcall say, you can always write to them saying the debt is in default and as the CCA reqest has not been fulfilled a criminal act has been committed and that you hold them responsible as agents of whoever. They will probably just send it back to whoever sent it to them as it is not "easy commission"
