Default Council Tax - Unfurnished Rental Property

Hi All,

Quick history: I have a small flat in Leeds which I let out. It was emtpy for 5 days over summer and as it is furnished I am liable for those 5 days.
Now I wrote to the council and said that it was unfurnished in those 5 days (Sold the furniture/put in storage etc).

The council have now sent me a summons. (The council tax is £40 and the summons cost is £50).

What are my options? In theory even if the place was furnished, I should be elligable for 50% discount anyway as it was single occupier without a resident.

Also - do the council have to prove that it was furnished?
