Default Non compliance with litter clearance

Help please, for some weeks now i've been receiving letters from the council (kirklees ) They were addressed to a former tennant.
I called the return address on one envelope to ask why they were sending letters to the old tennants.

I was asked to open an envelope, then i saw a notice of a fine of £100 for non compliance with litter.

I told them about the mistake and they asked my details, they informed me that to the rear of the property (a plot of land) is full of rubbish.

I was aware of this waste that was in the plot of land, as i had sent them an email 3 weeks before informing them that previous tennants in the same street and flytippers had dumped their rubbish in my plot of land.
I also told them i had witnesses who saw these people dumping rubbish in the land and there was video evidence too.

Now the council tell me its my responsibilty to remove the rubbish !

I am in recept of benefits and i have a disabilty.

If this is council property then they have a duty to clear it up before the next tenant takes over.

Write them a letter telling them that it should have been cleared before you moved in and if they don't, you will have it removed and sue them for the costs.

It's a private home. I've been here almost ten years. The land is private, but my point is that i have witnesses who have seen people dumping the waste in the plot, surely i can't be held respsonsible for other people dumping rubbish on this land ? . Is there anything i can do ?

As it's on private land I don't think there is any responsibility for anyone but the owner to clear it up.
The council can get an order to make you clear it up or do it themselves and bill you.

No they can take you to Court for fly tipping and make you pay to clean it up.
