It is only an error on their part and they would have paid it. I think you should go back to them and say that you have made an error and the allocation fee is part of the deal or you go to court.
Everybody should make sure that they get all their costs. The banks are lucky that people are not able to claim for all with terrible inconvenience and difficulty to which they have been put by the banks own blind greed.
