Default KAZZAW v LLOYDS TSB ***SETTLED IN FULL***

Here goes folks!!

Just printed off my Data Protection Act letter to send by recorded delivery in the morning.

I'm very nervous about this but have been reading the posts on the forum & it's given me the confidence to have a go.

I've also got a joint a/c with First Direct with my OH. Can I apply to them in my name only or do I have to send something from my hubby giving me permission to apply for both of us?

No if you check out the FAQ's it says if both of you have equal access then you only need the one signature.

Good luck

Data Protection Act letter sent yesterday by recorded delivery.

Just been looking at online banking & found I can search for details of charges from July 2002.

Thought I would make a start on filling in the spreadsheet whilst waiting for the info from LSTSB by post.

Is there a quicker way of doing this or do I just replace the sample info by overtyping with my figures one by one?

I assume that I have got the right spreadsheet with a list of £10 charges from March 2003?

Any help gratefully received!!

You only need to use the spreadsheet for the moneyclaim when you issue the small claims summons. Don't add it in your correspondence to the bank.

The interest referred to in the 1st request letter is very complicated I suggest you read the threads to see if you can fathom out how to work that one out, me personally I ignored it and deleted the interest bit in the letter.

Hope this helps

I wasn't about to send the spreadsheet anywhere yet as I know it is for the moneyclaim.

I was simply going to put in the figures & use it to total my charges. It would then be ready for when & if I need it later.

Thanks anyway.

I only wanted to know if there is a simple way of inputting the figures or if the only way is to manually type them all in?

Thank you. I don't mind if that is the only way. Just didn't want to spend ages doing it then finding out I had been stupid & missed an easier option!!

I am right in thinking I overtype the existing figures? I haven't missed a blank one somewhere?

Cool Re: KAZZAW v LLOYDS TSB

You can just select and delete all the existing data in the spreadsheet if you want, before you start typing in your own - just don't delete any of the formulae in the last 2 columns.

However, if you've got Excel there is a way you can get figures, descriptions and dates into the spreadsheet without typing them all but, unless you've got a lot of charges, or if your not comfortable with Excel, typing could still be the quicker/easier option! I only know about Excel, but there may be a similar method in other spreadsheets.

First, download your statements from LTSB online, back to July 2002. You can only download 150 transactions at a time, so you may need to do several downloads, using a different date each time. When downloading, select the "CSV" format.

When you've finished downloading, copy paste all the data into one large spreadsheet.

The data will be in CSV format (Comma Separated Values). That means each item of data in the row is separated by a comma, instead of being in separate columns. But you can convert it to columns as follows:
  • select all the data (it will all be in Column A)
  • click on the "Data" menu, then select "Text to Columns" from the list
  • select the "Delimited" radio button, then click Next
  • check the "Comma" box, then click finish.
You should then find all the data is nicely separated into columns, as normal for Excel.

After that you can sort/filter your data to isolate your charges (all your charges will be identified by "CHG" in the third column - but that will include any normal monthly charges, and overdraft interest, which you aren't claiming back) and then copy/paste them into the interest spreadsheet.

Well I did say typing in your figures might be easier!

Thanks!

I've typed in the figures & the total without interest comes to approx £2700 from July 2002 to present!! I wondered where my money had been going?!!

I've also opened a parachute A/C with NatWest (Step).

Well I've done all I can at the moment. Will just have to sit back & wait for the info from 1999-2002 so I can start the next round.

I'll amuse myself by reading everyone elses threads & familiarising myself with procedures.

Good luck

But if you find that you have to begin a claim then you should probably start the claim as joint claimants. We have had at least one bank object to a claim on the basis that only one partner of the two joint account holders was named as claimant

Thanks for the advice. I'm thinking of leaving the First Direct joint a/c claim until I've got further with the LloydsTSB a/c which is in my name only. I thought it may be more complicated for a joint account & I also want to prove to my OH that it works before starting with FD. He's a bit dubious at the moment!!

As far as being more difficult for a joint account claim, it's not. It's just the same.
As far as turning your other half into a believer... well, that's a different matter!

Decided to make a start on First Direct. I will be starting a new thread for the FD claim.

Just been looking at the Data Protection Act letter template. Would it be OK to leave the wording as it is & both of us sign it or should I amend the "I" to "We" etc?

There is actually an easier way with lloyds.

do a search for just the charges for 3 month periods.

highlight all of the info and copy/paste them into cells on the right of the spreadsheet after to formulae.

highlight the description, date and the ammounts and drop them into the spreadsheet.

Very surprised to receive statements & breakdown of charges today. Just over a week since sending my Data Protection Act letter!!

I've used the spreadsheet & calculated my charges to be £3413.50 excluding interest which I'm leaving out.

I'm stuck at work this afternoon & have only limited time to scan the threads.

Can someone please tell me where to send the preliminary letter to as I'd like to get it in the post this afternoon?

Blimey that was quick!!

Preliminary request sent by recorded delivery on Wednesday (17/5).

Today (20/5) received standard reply from David Just.

I can see how someone without the support of this website could just give up at this stage. Thanks for being there folks!!

Now I have to find the patience to wait till 31st May to send my LBA letter!!

It's very tempting to send it now but I am determined to take the advice given to others & show the judge I have been fair.

Wish First Direct would send my statements etc so I can get my teeth into that claim.

Oh well! I'll have to do the housework instead!!

But if you do end up filing a court claim, don't forget to add on the 8% interst! It is YOUR money after all

Good luck with it all !
