Question Second letter

Just read through everything again and realised that I now send another letter saying I'm disappointed they haven't replied and give them another 14 days to reply. Is that right? I thought it was seven days and then file the moneyclaim.

Also what happens re the Christmas period because the 14 days will be between Christmas and New Year. Do we allow extra time for that if it comes to it?

Yep thats right, the reason you send off your LBA is to show the courts that you have given them plenty of time to settle the dispute, as for the xmas period it is my understanding that the time allocated are calander days, so itr shouldnt delay you claim.

Yes correct,although in the case of court Sunday does not count and this would allow them an extra day as would bank/public holidays.

Now you are approaching the final stages you should fully read up.....its very important to have a real understanding.
Mistakes at this stage can prove to be costly later !!

Thanks Martin and foxy-stoat. I'm feeling a little nervous now and just want to make sure I get it right. I have read and read what to do both on here and MSE so I suppose it is just reassurance that what I do is right.

Off to type the letter and send it tomorrow - registered of course.

Just one more thing:
Is it best to send this to the Registered address in London or the same address in Birmingham I sent the first one to please?

Have now received the Small Claims Procedure book - delightful bedtime reading!

I never sent a spreadsheet with my initial letter. I typed out the dats from the statements etc and sent that. Do I definitely need to do a spreadsheet? I haven't a clue how to do it but younger son does so can ask him to weave his magic tomorrow if necessary. Thanks.

would that be the interest spreadsheet? If so you only need to send that off when you hit the court stage when you you fill in the N1, just a schedule of charges will do for now.

Well my LBA letter went off this afternoon . Signed, sealed and by registered post. Now I shall wait for the fourteen day deadline to pass unless of course they decide to settle immediately. Fat chance!

I am just about to tackle lloyds about charges.. Is it best to write a letter expressing dissipointment and requesting a data protection act request to see exactly how much i have been charged?

Hi
Firstly you need to send the Subject Access Request letter, all the letter templates are in the library http://www.consumeractiongroup.co.uk...lates-library/ and you also need to read the FAQ: http://www.consumeractiongroup.co.uk...se-read-these/
Spend a bit of time reading round, and make sure you have a good idea of what you are doing before you start.
Oh and start up your own thread, so we can answer any questions and give you support.

I have had an almost immediate reply, much to my surprise as they never replied to the first letter. Is this a standard letter or is it a personal one??

"I am just writing to let you know that we have rec'd your complaint - and to say how sorry I am to learn that you feel you have cause to complain.

Please get in touch if we've misunderstood your concerns or if you have some more information you want us to have. If we don't hear from you in
the next couple of days, we will carry on with our investigation using the information you've already provided.

We expect out equiries to be completed within the next two weeks but we will try to get out response to you sooner if we can. If there's a delay, we will let you know why and we'll give you an idea of when you can expect to receive a full response to your complaint. I hope we can sort things out for you."
