Check out GaryH's thread GOT A COURT DATE? A guide to the later stages

When you file your court claim you will eventually be given directions by the court and usually they will be to serve any documents you intend to sue as evidence to the bank and court no later than 14 days before the court date. Gary goes into detail of what you should include in the court bundle and the McNamara transcript is on of the items - this can be found on the following thread Peter McNamara BBC radio -Sept 2004- sound file & transc.

Don't worry about a recording as there doesn't seem to be one and the transcript is sufficient enough.

HELP NEEDED PLEASE

I am now at the stage of completing my court claim (form N1) and have a question......

At the bottom of the form it asks for the

'Name of the claimants solicitors firm'

I havent approached a solicitor in regards to my claim....should i have done so ?

Shall i just leave that field empty then ?

Also on the N1 form just below the 'value' section, there is a box asking for defendants name and address and a box asking for amount claimed, court fee, solicitors costs and total amount. Do i leave that blank as well ? Is that for the court to complete ?

You complete the 'Defendant's name and address' with:
'Lloyds TSB Bank Plc
25 Gresham Street
London
EC2V 7HN'

You fill in the 'Amount claimed', 'Court fee' and 'Total amount' boxes too. Leave 'Solicitor's costs' box blank.

I guess now it is time to get my CAG court bundle together !

One more question...lol...Havent got a Claim Number for the N1 Form....I take it this will be forwarded when my claim is filed by the court ???

The claim ref is the only part the court fill in (and the date too).

Whilst it is a good idea to be prepared, relax on the court bundle, probably be 4 - 6 months before one is required. Lloyds usually settle before court bundle.

Nice words for a covering letter below:
'Please find attached 3 copies of a Claim Form and Particulars of Claim in respect of the above matter. Additionally attached is a cheque for x made payable to HMCS to cover the court fee for commencement of proceedings.

Please will you issue the Claim Form and serve it with the Particulars of Claim on the Defendant and return the writer a sealed copy.'

I have read all the need to knows and all the help offered in completing form N1......It is all done now and FINALLY ready to go

Its just that sometimes i find it all rather confusing as there is simply so much help on here with templates etc that it starts to worry me that i am doing things correctly

I can see why there are those out there who give up before this stage as it has taken me from 10am until now, just to get all the relevant paperwork completed

It takes time and it is a lot to take in, once you have done it once though it is quite easy.

Got your PM and you are now ready to go. Although I do not know much about what is required for fee exemption. Just in case may be prudent to read this link first:

N1 Form sent, but i am sure i have messed up after reading the following in another thread

Value:
Bank charges (and overdraft interest if claimed) - £XXXX
Data Protection Act Fee - £XX (if claimed)
S69 8% Interest - £XXX
Total of - £XXXX
Plus daily interest at 8% of £0.XXp from the date of issue until settlement.


I wasnt going to bother with the overdraft interest anyway, but when completing the form i thought that the s69 8% interest was in relation to that, so didnt bother adding it

I also forgot to add the Data Protection Act Fee

The following is what i did include

Value
Bank Charges £xxxx
Total £xxxx
Plus interest pursuant to s69 county courts act from date of issue to date of judgement/settlement at £0.xx per day or at such rate and for such periods as the court deems just.

(I didnt have to include Court fee as i am applying for exemption)

Have i messed up big time ??
