Hi All,

Great site, really helpfull!
This is just to provide a timeline of my claim against Lloyds but if anyone has any comments please feel free to join in. Thanks again.

14.04.06 sent a letter to my bank requesting a reduction in my charges for the previous month (£170) which i said where excessive for a minor blip of a few missed DD's.

03.05.06 received letter from lloyds saying they were happy to make a one off good will gesture and refund me £70 on this one occassion.

Somewhere during this time i descovered your site and after checking all my online statements back to 2002 went ahead and sent llyods your standard letter requesting repayment of approx £2400 in charges.

02.05.06 send initial standard letter requesting charges returned in sum of £2400 approx

03.05.06 emailed said letter to Lloyds ustomer care email adress.

04.05.06 receive standard letter from lloyds along with info on the ombudsman basically saying they dispute my charges and will not be repaying anything. However they add that they will honour the £70 already agreed.

Will look in the libary now for the next letter in the process to send. I take it that by agreeing to the £70 refund I will not jeopodise my case at all for the rest of it?

Hi Motown Ben,

Next letter to send will be the LBA - Letter Before Action. It's up to you as to whether you give them the 14 days from the intial letter before sending it, but as they've responded you should be fine to send it now.

The LBA gives them 14 days to refund you before you issue your Moneyclaim - you might want to read up a bit more about the process in the FAQs

Edit: As long as you didn't sign anything for the £70, you should be fine

Thanks for the advice. I did sign a letter they sent me but checked before sending it that it only covered the £70 they were refunding so hopefully I should be ok yeah??

Anyway i will post more when i here from Lloyds following sending the LBA.

Have just noticed that Lloyds have deducted another lot of charges from my account this month totalling £130 which has put me seriously out of pocket and means that my car insurance D/D has bounced along with another d/d and put me overdrawn. Im seriously getting very frustrated with Lloyds. I phoned their phonebank express number this morning to complain but as ever there response was "they are the charges you have to live with it basically". Its totally a viscious circle, I AM trying everything to stay in credit and restore some of my battered credit rating but getting no where.

I realise that i have a responsibility to run / maintain my account responibly but for minor infringements im getting charged very silly money. I also think they (Lloyds) have a responsibliity to help where possible and by setting these charges so high it just creates more problems month after month after month for me.

I asked the Lloyds woman if she could provide me with a breakdown of their charges, what they covered and why they were so high. Guess what she would not reveal anything simply stating that "thats what the charges are". sigh. sometimes i wonder if i will get to a point where im not constantly worried about going o/d and having any money.

Got sidetracked somewhere along the way but finally submitted my claim to moneycliam online on the 30.06.06. Now awaiting lloyds.........bring it on, total claim including VAT standings at just over £3k......will keepyou all posted folks

Further Update

Lloyds have acknowledged my claim (on the 10/0707) which gives them 28 days from the date of the claim to (5th July) defend i guess?

Would it be worthwile in contacting them now and saying something like "i will happily end this action now if you pay up" i guess i know what the answer will be ha ha!

Following on from my earlier posts, I have received an Acknowledgement of Service Form today in the post which shows the solicitor as Sechiari Clark and Mitchel and notes that they "intend to defend all of the claim".

Can anyone advise what happens now please. Am I correct in saying that they now have 28 days from the date on the form (in this case the 7/7/06) to file a defence?

What is the likelyhood of them actually submitting a defence?
Would it be a good idea to try and discuss the matter with the solicitors outlining my thoughts and what I see as a tide of similar claims currently being processed, maybe suggest that I am inclined to settle the matter ASAP if possible (though still spelling out that I WILL see it through all the way if required as I beleive, like the rest of us here, that I have a very strong case) to settle.

Any Advice would be most helpful,

hi there

I'm still a bit of a newbie at this, but there is a thread posted (by Reload i think) which shows all the 'template' letters that come from the bank and their solicitors. Just compare them to the one you've got and i'm sure you'll find it pretty standard. If you haven't already done so, just read as many of the threads on this forum as you can, i'm sure you'll find your answer.

If your letter is very different, again i think one of the 'mods' will pick up the thread and help you further.

OK,

so my claim for was submitted on 30.06.06 and i think lloyds filed defence on / around the 05.07.06 but since then ive heard absolutely nothing from anyone. i guess I dont have too many more days left yes?

Ive not received any allocation questionaires or anything else at all.
Anyone have any advice, is it just a awaiting game, should I speak direct to Lloyds solicitors or to the court maybe about this?

Any advice is apprecited as im getting slightly nervous!

I would give the court a quick ring lloyds might not have filed a defence there is no need to remind them no defence and you win by default

Thanks for the advice IHateBanks, I have just spoken to the money-claim help line and they advised that my case has been passed to my local court and that an allocation survey should be with me within a few days. Il report back as soon as I hear any more

Further to my earlier post today, i arrived home this evening to find the following on my door step.

Notice of Transfer of Proceedings (to my local court)
Allocation Questionaire Form N149
A copy of the Lloyds Defence

I have completed The N149 form, whcih seems fairly basic (mainly tick boxes) as per the notes on this site and have the funds available for the costs.

My questions are

Should I drop it off to the court or post it?
Do i need to add further information in the "other Information" section which at present I have left blank?
The N150 form when do I need to fill this in?
Should I attach my brekdownm opf charges etc?

Please anyone who can help I would appreciate anyadvice.

The article in the libary gives a full breakdown of how to complete form N149
N150 is for more complex small claims or fast track so no need to fill in this one

It might help if you go down to the court just to get a feel for the place if you ask nicely they might even show you round

You dont have to attach your spreadsheet but for the sake of arguement later you might as well

anyone off any advise please.

the deadline for the allocation questionaire was I think the 7th and mine was sent off the the court well before this along with the fee. Have not heard anything since from either the court or from SCM. Should I just wait now or maybe contact one of them?

Default Motown_Ben OFFERED FULL REFUND!!!

Arrived home tonight to find Sechiari Clark & Mitchell solicitors fairly standard letter on the mat saying something along the lines that "although we intend to defend these proceedings..........this is not something lloyds wants to get into".

They have offered a full refund of the charges (along with my court fees) in excahnge for the stadard terms and conditions which others have posted full details of. I intend send the signed copy back tomorrow with all the conditions crossed out and a brief note expleining that I do not accept them.

I hope this is is a boost to all those going through the process, it takes a while and you have to push Lloyds to the limit (had not had a court date set buy it could have only been days away from being issued)but eventually.

As soon as my money is in my account a donation will go to this great site.

Thanks all for your help and advice through along the way!
