Default foxyred v Lloyds ** WON **

I've just sent off a Data Protection Act to the bank via email. Wondering whether I should have posted it instead but oh well, will do so if I don't hear anything back.

I've been on LTSB online to search through my old statements but they only go back as far as 2002. As I was writing down all the charges I was literally shaking at the amount they had been charging over the years.

At one point they had taken £210 out in one go for unpaid direct debits. I was unemployed at that time and the only money going in was my child benefit and income support. I remember how much it had affected me at the time and how depressed I had become with two young children and the bank taking our only source of income all in one go.

I would be more than happy to face them in court in the hope of recouping this money back.

I'm not sure what calculations to take into account though. I have overdraft excess fees, overdraft interest fees, 2 unpaid standing orders, LOTS of unpaid direct debits and a couple of unpaid cheques. Which do I include in the calculations?

Any reply would help.

Thanks loads

Carol

Reply back already, wow. Not saying much though, just that it has been passed on. This is the email I received.

Thank you for the e-mail.
I acknowledge your request for copies of statements of your account since January 2001. Under the circumstances, your e-mail has been passed on to the Manager of the Complaints Unit within Service Recovery and I have asked that he notes your requests and responds to you at the earliest opportunity.

Regards

I was wondering, as these statements might take some time to arrive, and I already have charges noted from January 03, shall I just make a start on these or should I do it altogether. So far the charges are £2,121.53 but I don't know if I'm supposed to be including fees as noted in my previous email. Will someone get back to me and let me know please please please.

Oh yeah, btw, there is a spelling error in the Data Protection Act letter... business is spelt with one s at the end instead of two. I just think it looks more professional if letters are error-free in cases like this.

It was keith Boden that replied to my e-mail asking for the postcode and sort code. My letter was not the Data Protection Act letter, rather the first letter asking for my charges back, plus interest.

If anything, it proves they recieved it

Received response from LTSB requesting ?10 for the Data Protection Act information. I get the feeling that all I am going to get from them is the statements rather than any information about manual intervention or data that they have had to do themselves rather than on computer.

I guess I'll send the letter back allowing them to recover ?10 from my account and see what happens.

Does anyone know how long it takes for LTSB to take money from account for Data Protection Act? I sent my letter last week and checked online statement but nothing taken as yet.

Ah, how very nice of them. I bet they're hoping that you will decide to waive court proceedings too lol.

I have been almost in tears of frustration today. I've got a christening coming up on Sunday and have been saving up as much as I could to make sure that I could get a nice present for my Goddaughter and some new clothes etc. Today I looked online to see how much I'd got as I had planned to go shopping today. Was totally gutted to see that I had been charged 70 pounds for returned DD.

Firstly I couldn't understand what the heck they were for as I've not had any direct debits returned in the last 7 weeks. When I phoned my branch I was put through to 2 different people who were making very little sense at all. I was finally put through to someone else who explained that AOL had submitted 2 DD for payment but that there was not enough in my account to pay them. (Not surprising after LTSB had taken 175 pounds in charges 3 days prior.

After a lengthy conversation and me asking numerous times why I was being charged twice for a transaction that happened all in the same day and for the same company. I asked her specifically to explain to me the process of what happens when a direct debit is submitted for payment. She went on and on.

I then asked her what they have to do to return the DD. She said that they have to contact the company. I then said well it's done by computer isn't it... she hesitated (I was quite surprised at the silence) but then changed tact and went on about what the charges are for again. I said surely if they have to contact the company they would just put information re both transactions in the same envelope or in the same telephone conversation. She said that they don't telephone the companies and they don't write to them. How the heck then can they contact them and complete these transactions on the same day if it isn't computerised?

I should've insisted that she tell me what I wanted to know but I was getting more frustrated everytime she mentioned the fact that the charges were taken because there was insufficient funds in the account. I did lose it a little and said that it was because bleeding LTSB had taken all my money so how could there be funds available.

Anyway to cut it short, she said that she could return one of the payments of 35 pounds to me but not the other. I am a bit annoyed with myself that I hadn't got her to admit that it was all computerised.

Never mind though, it's only a matter of time before I get the information I need from them to start suing their bums.

Ok I think I've calculated correctly. The total charges stand at £1,808.27 which is simply shocking. I'm getting angrier by the second. How have they been allowed to get away with it for so long?

I will start writing the first letter requesting my money back.

I know I don't need to know this yet but can someone tell me how to work out the 8% interest that has to be charged when I fill in my court claim please.

Sent 1st preliminary letter via email yesterday. Received standard reply today from Keith Boden.

"Thank you for the e-mail.

I am sorry to learn that you appear unhappy over the level of charges you have incurred on your Lloyds TSB account.

Under the circumstances, your e-mail has been passed on to the Manager of the Complaints Unit within Service Recovery. I have asked that he notes your comments and issues raised and arranges for a response be sent to you at the earliest opportunity.

In case you haven't received a copy of our leaflet called 'How to voice your concerns' I've attached one to my e-mail. This tells you all you need to know about resolving your complaint with us.

Regards

Keith Boden
Lloyds TSB - Service Recovery
Birmingham"

Shall now start proceedings if nothing else heard within 7 days.
