I am in the process of creating a spreadsheet of all the charges taken. Please could someone let me know whether I can claim for "O/DRAFT USAGE FEE" @ £25.

Just drafed up LBA. I have added a small paragraph to tie it into their standard response. Could someone please advise as to whether it is ok.

I am very disappointed that you have not responded satisfactorily to my letter of the 16th April 2007. I now understand that the regime of ‘fess’ which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statue and recent Consumer regulations.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I have always reposed confidence in your integrity and expertise as my fiduciary.

You state in your letter dated 24th April 2007 that the charges that you have levied from my account are not ‘default’ charges and that they are actually a fee for your service. May I take this opportunity to inform you that under the Supply of Goods and Services Act 1982 s.15, your fees must be reasonable and I feel that in this case they are not.

I have calculated that to date you have taken £225.00 from my account, and have enclosed a schedule detailing this.

I require payment in full of this money and if you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs and without further notice.
