Angry How Many Times Can They Be Sued???

Hi everyone

Unbelievably Lloyds are still at it with us! Hubby has been off work sick due to small operation and his sickness benefit has not come through as yet. He is owed sick pay since 14th December. It could come through any day.

Today I spoke to Lloyds as they have bounced a direct debit and sent another computer generated letter telling us so. His sickness benefit is not through yet because the DSS have had a payment query with his previous employer (now a pension provider), and until that query is sorted they can't pay any benefit. The pension provider are being very very slow in responding to the DSS unfortunately. Got profuse apologies from the DSS today, they are doing all they can to hurry things up and said it could be in any day now.

Told the girl on the phone at the bank all this, and that I hoped the bank was not going to put a punitive charge on our account. OK return the DD as it would take us over £100 overdrawn, but please DO NOT charge us as this is NOT our fault.

Know what she said?

" Many of our customers have complained about these charges and the matter is being looked into officially. We know those charges are illegal but until we are stopped from charging them we will carry on doing so. I will have to speak to a Manager to see if you will be charged this time or if we will waive it in light of what you've told me. Someone will phone you back tomorrow"

Does this utterly stink or what ???

If they carry on like this, can we sue them again for these new charges in the future??? The settlement we are waiting for right now took in illegal charges up to August 2006.

If hubby's sick pay is any more delayed I can foresee more of these letters

I am so sick of them I could scream ! She even asked me if I could put any money in myself to help hubby Er...not from my incapacity benefit which we are LIVING ON FOR FOOD AND ESSENTIALS no I cannot!

Grrr...

Think we all feel like this Spirtgirl, take them to the cleaners and have the last laugh!
I think the charges are unlawful not illegal, bear that in mind for any future letters / rants!

Providing you don't sign any settlement agreement to say that you will never sue them again then you can do it as many times as you need to.

Doubt they record all calls depends who you were talking to - expect you might find that they deny this was ever recorded . I do know that calls at branch management level are more often than not recorded but is unlikely if it was just a call centre or "customer services" - would be fun to ask though.

Hiya Nic

It was business banking so there may well be a good chance it was recorded.

Anyhow I've done a S.A.R - (Subject Access Request) letter to them addressed to the "Data Controller" so we shall see what they come back with.

Still no return of call from the Business Banking Manager who was not available on 17th and who, without fail, was going to phone us back yesterday!!

Lloyds do record all calls. However I have submitted a Subject Access Request for recordings which they have completely ignored (I have also been told various incriminating things as well as plenty of outright lies) so don't hold your breath.

As Lucid said, providing that when they settle you reject any conditions and reserve the right to make future claims in respect to unlawful charges then you can keep on claiming. Im on round 2 with lloyds, going after charges that occured after my moneyclaim started that they would not add on to the settlement

Quite amazingly guys I got a phone call from Lloyds yesterday, a very polite and helpful lady (makes a change eh? ) who said she would be only too happy to send me a copy of the transcript as per our S.A.R., but unfortunately as it was me who was involved in the conversation (even though it was about hubby's account) she would need a letter from me personally requesting the information! She gave me her full contact details and said she would "diarise" my request until next Tuesday by which time she hoped to receive my letter! :o

Needless to say, letter has gone off to her immediately signed by me personally.

Hmmm...am wondering why Lloyds are being so "helpful" all of a sudden I'll report back when I get it!
