Default BEET v LLOYDS TSB CREDIT CARD

Now helping Beet with his claim for charges on his credit card. (He's jealous cos I've already had a result with First Direct!! lol)

Data Protection Act letter sent 26/6/06. No info received yet.

Sent an email to contactus@TSB. Keith Boden has been a helpful little soul!! After 3 emails here's his latest reply:

Quote:
Just had a note from Card Services to say that they have received your request. The information is currently being retrieved from archive and they are hopeful that this should be with you soon.

Keith Boden - Lloyds TSB
I have reminded him that we're expecting the info by 7/8/06!!

My son is with Lloyds TSB and has sent his first letter regarding his bank account but he also has a Lloyds Visa Card which has hundreds of pounds of charges, is it the same letter for Credit Card?

If you mean the Data Protection Act Subject Access Request letter then yes it is the same. I amended it slightly to include "credit card account" & of course included the card number

Your lucky!

TSB are refusing to acknowledge that I had a credit card after 1999, even though they defaulted me in 2002!!!

Just a quick question if I may......can you tell me how much TSB charged for Late Payments and Exceeding the overdraft limit between June 2000 and October 2002 (in case i need to estimate my figures)

Many thanks......and good luck

Got really excited this morning!!

Logged into MCOL & no defence received so I finally got to press the "JUDGEMENT" button. Everything went through OK & I even added on the interest accrued since the claim was submitted.

So far so good!!

Just logged on again & LTSB have now submitted a defence!!!!!!!!

Defence received with AQ.

Is there any difference in filling out the AQ form for a Credit Card claim?
I've only done them for Current A/C charges before.

BEET has received a copy of LTSB's AQ today & a request for a copy of his to be sent to SCM.

Surprisingly SCM are unavailable during November & December!!

In section A of the AQ they haven't asked for the usual month to negotiate a settlement. Don't know if this is a good or bad thing?!!

Received Notice of Allocation to the Small Claims Track (Hearing)

Hearing will take place at 10.00 on 4/4/07 at Nottingham County Court & should take no longer than 1 hour and 30 minutes.

Court bundle to be in no later than 14 days before.

It's a pity i can't use the bundle I've just lovingly prepared for my Egg claim which will now be shredded as they've made me an offer today!!

Not only are the banks wasting time they are also wasting trees & printer ink!!

Only problem is all the pages are numbered & when I put Beet's statements & correspondence in the numbers will be wrong. I'm going to cut off the corners where the page numbers are & re-photocopy it. At least it's all sorted in the right order. I just have to edit the index etc which I saved on the pc.

With a bit of luck they'll pay up before then - they've got a couple of months yet!!

My Egg bundle had to be in by next Thursday (18th Jan) & the case isn't till April. But it has forced a settlement from them. I think the judges do it for ths reason.

Yes, the earlier the date for document exchange the better it is for us. It forces the banks hand earlier which usually results in a much quicker settlement.

By 'eck! Doesn't time fly?!!!

It's nearly 4th April & still nothing from SCM! Sent in Beet's bundle in the nick of time but no bundle from the defence. Faxing non-compliance letter tomorrow to Court.

Getting worried now as it looks like Beet may end up in court & I've done everything for him so far!!!

What are the options if they don't submit a bundle or pay up before 10am on Wednesday? Could the case still go ahead?
