MCOL query

Hi,

I am about to fill out MCOL but have a couple of questions. The claim is for more than £5k. Is that within the limit of what I can claim via MCOL?

Also, they want me to pay £210 court fees. Is that correct? A friend of mine claimed back £3.5k and only got charged £100 so I wondered if there was a difference.

Lastly, is it worth trying to claim the compounded interest of 29.8% or has that been stamped out now? I know I can do the standard 8% but i also know that before the banks went to court, a lot of people successfully claimed the compounded interest.

today is my deadline to file with MCOL so any speedy advice would be much appriciated.

If you have a choice, it is always preferable to file using N1 at your local court. The two main disadvantages with MCOL are that your Particulars of Claim are limited to just 1080 characters with a maximum of 24 lines and you cannot attach the schedule of charges to your claim.

Both these drawbacks can create problems later on. The banks use these limitations of MCOL to assert, with some justification, that the claim has not been fully particularised.

Therefore I would strongly advise you to file at your local court. It will be transferred here eventually anyway.

thank you for your quick reply. Im quite happy to use MCOL and forward some paperwork to them. Would that be acceptable? I dont mind it being transfered to my local court at a later date.

As well as the problems MB has highlighted, your claim will be automatically stayed too (not that this matters too much now anyway).

More importantly, I am not sure what words you plan on including in your Particulars of Claim, but the wording from here will not fit into MCOL.

By the way you do not have to file your claim exactly on the day that your LBA expires.

I recommend that you do not use MCOL, it is pants.
