| | Basic Account Customer | Lloyds TSB Unauthorised withdrawals from other accounts Hi All,
I took out a credit card with Lloyds TSB in 2000 and in 2004 they changed the terms and condition of my credit card account. Whilst I accept that they are able to change their conditions, I feel this change has disadvantaged me because they can enter my current account and take the payments as and when they like. Recently this has caused a serious problem for me.
I believe the condition which allows them to take money out of my bank account is unfair and as such, I feel could be considered an unfair term under "The Unfair Terms in Consumer Contracts Regulation 1994". The Unfair Terms in Consumer Contracts Regulations 1994 Unfair terms 4.—(1) In these Regulations, subject to paragraphs (2) and (3) below, "unfair term" means any term which contrary to the requirement of good faith causes a significant imbalance in the parties' rights and obligations under the contract to the detriment of the consumer. Please can I your views on this matter.
Many thanks |

I agree with your point, the Banks make the rules up as they go along.
I believe they call it offsetting, It's happened to thousands of people on this site, regarding Bank Charge refunds.
You win your claim, expecting some cash, and they offset it against another account you have with them. Sour's your 'victory' a tad.
Regards.
Scott.
