Default Some Help Please got a bit lost

basically i posted a long thread in general forum about reclaiming some charges and someone suggested breaking it down into the relevent banking forums so here it goes.

lloyds tsb student account(girlfriends account). traced through internet banking that they owe around £100 of charges. wrote first letter to them from template file, received usual response of you agreed to t's & c's it's your fault. wrote back pointing out they broke the t's & c's by applying unlawful charges to the account. they wrote back saying take it to the financial ombundsman. do i take it to the Fo or just file with moneyclaim?

problem is she has a £2000 overdraft so can't afford the account to close, but am i right in thinking that if they do close the account then they have to negotiate a repayment schedule? if so then i can only see it as a mixed blessing as at least it would force the hand in repaying the overdraft as opposed to it drifiting along for years and tarting it around to keep interest down?

If it is the preliminary letter that you sent in the first place, and you gave them 14 days to respond, which they have done, then you need to move on to the letter before action (LBA) and give them another 14 days, and if they still don't refund, THEN you can go to Moneyclaim.

The letter they sent is pretty standard, but you would be wasting your time going to the ombudsman. Take another look at the FAQ's and the step by step instructions. Also read some other Lloyds users threads to get a feel for how they are likely to behave. Your girlfriend should get a parachute account to be on the safeside.

The more you read, the more you will understand, and with that comes confidence that you know what you are doing.
